RESOLUTION NO . _1164
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
JEQUESTING THAT TOWN OF LOS ALTOS HILLS AGREE ON
LOCATION OF NATURAL GAS LINE IN PAGE MILL AND
ARASTRADERO ROADS
WHEREAS, the City of Palo Alt o desires to furnish certain
u tilities, to wit, natural gas, to portions of its city lying
generally southwesterly of Stanford Unive rsity, and
WHEREAS, the most convenient and economical ro ute f or a
ga s distribution line f or s aid p urpose is determined to be along
the existing right of way of P age Mill Road and Arastrade ro Road,
as shown on the map affixed heret o, marked EXHIBIT A and by
reference made a par t hereof, and
WHEREAS, portions of said public roads lie within the
corporate limits of the Town of Los Altos Hills, and
WHEREAS, there is grante d to the City of Palo Alto, a
mu nicipal corporation of the State, the right to construct, oper-
ate and mainta in gas pipes, mains and co nduits with the necessary
appurtenances, acro ss, a lo ng, in, under, over, or up on any road,
street or highway within any other mun icipa l corporation of th e
Sta te, upon the condition that the municipal corporationsshall
first be given the opportunity to agree upo n the location of the
use and the terms and con ditions to which the u se sha ll be subject;
NOW, THEREFORE, the Council of the City of Palo Alto does
RESOLVE:
1. The City of Palo Alto her eby respectfully requests that
the Town of Lo s Altos Hills agr ee with the City of Palo
Alto that the location of said gas pipes, mains, co nduits,
and appurtenances shall be within the existing right of wa y of
Page Mill Road and Arastr adero Road, as shown on EXHIBIT A,
and so as to interfere as little as possible with other
ex isting u ses of said road, and tha t the terms and

co nditions to which the use shall be subject be as foll ows:
(a) That said installation be constructed, oper ated
and maintained in s uch m an ner as to affo rd security
for life and property.
(b) Th at said inst all ation be constructed in accord ance
with the standards set ..orth in City of Pal o Alto
Standa rd Specifications, a copy of which is affixed
hereto, marked EXHIBIT B and by reference made a
part hereof .

SECTION 3
PROSECUTION AND P ROGRESS
SUBCONTRA CTING. No subcontr actor will be re cogniz ed as such,
and all per sons. engaged in the wo rk of c onstruction will be c onsidered
as e mplo yees of the Contracto r a nd he will be held resp onsible for
their work, which shall be subject to th e pr ovisi ons of the C ontract
and Specification s.
The Co ntractor shall give his person al attention to the fulfillment of
the Co ntract and shall keep the work und er his contr ol.
Where a por tion of the wor k which has been subc ontract ed by the C on-
tractor is not being prose cute d in a manner satisf acto ry to the Engi-
neer, the subcontractor shall be re moved immediat ely and shall not
again be emplo yed on the wor k.
b) ASSIGNMENT OR TR ANSFER OF CONTR ACT. The Contract or sh all
give his per so nal atten tion to the faithful pe rfo rma nce of this C ontr act
a nd s hall not a ssign, transfe r. co nvey or o therwise dispose of hi s Con-
tract. or his right, title or intere st Li or to the same or any part th ere-
of, without pr evious written consent of the Su re ty and of the City.
CHARACTER OF WO RKM EN. If any subcontr actor or per son employed
by the Contractor s hall fail or refuse to carry out the dir ections of the
Engineer or shall appear to the Engineer to be incompetent or to act in
a disorderly or improper ma nner, he shall be disc harged immediate ly
on dema nd of the Engin eer, and su ch person shall not again be emplo ye d
on the work.
TEMPO RARY SU SPENSION OF WORK. The Enginee r shall have the
autho rity to suspen d the work wholly or in part, for such period as he
may deem necessary, du e to unsuitable weathe r, or to such othe r co n-
ditions as are co nsidered u nfa vo rable for the suita ble prosecution of
the work, or for su ch time as he may dee m necessar y due to the failure
o n'the 'pa rt of. the Con tractor to carry out orders giv en, or to per form
any provision of the Contract. The Contractor s hall immedia te ly co m-
ply with the written o rder of the Engineer to suspend the wo rk wholly or
in pa rt. The wor k shall be resume d when conditio ns are favorable and
methods are correcte d, as o rdered or a ppro ved in writing by the Engin-
eer..

GENERAL PROVISIO NS
T IME OF COMPLETION AND LIQUIDA TED DAMAGES. In cas e th e
work ca lled for under these Specific ations is not furnished and com-
ple ted in all parts ;and requirements within the time spe cified in the
Contra ct, the City Council sh all have the right to ext end the time for
completion or not, as may seem best to s erve the interests of the
City. , a nd if it is decided to extend the time limit for the. completion
of the Co ntract, it may charge the Contr actor or Sureties. and deduct y
from the final bill for the work, the actual cost of engineering. inspe c-
tion, superinte .nde nce, an d other overhead expenses which ar e di rectly
cha rgea ble. to the Con tracto r, and which accrue ' duringthe. period of
such e xte nsion, e xcept the cost of final surveys and p reparati on of the
final estimate which shall notbe included in such cha rges.
If said Contractor shall be delayed in sa id Work by the acts' or n eglect
of said C ity, or its employees or tho se un der it by contract or other-
wise, or by the changes ordered in the work, or by st rikes, lock outs.

ca uses beyond the Contractor's control, or by delay auth ori zed by the
City, or by any cause which the City Council shall decide to justify

In the event of such termination of the C ontr act or':}: control, the

a nd perform the Contract upon giving the notice and undertaking
such project as heroin provided.
If the Surety shall fail within fifteen (15) d ays afte r receiving n otice

to the City of its inten tion to take over and pe rform s aid Contract,
and Surety does not commence performance thereof within fift een
(15) da ys after hitting given such notice of its intention to take over
and perform sa id Con tra ct, the City may take ov er the work and
prosecute the same to completion, and deduct the cost th ereof from
any moneys due or therea fter to becothe due to the Contractor und er
the Contract. In taking over said wo rk, the City may complet e the
same by co ntract or by any other method which it may deem. advis-
able.
In taking over said work, the City may take possession of all or any
pa rt of the Contractor's ma te rials, tools. equipment, plant and other

GENERAL PROVISIONS
c) SUPERINTENDENCE. The Co ntractor sh all at all times during his
absence'be represented on the work by a superinte ndent or for em an
whom: he has :a uthorised and who is competent to receive and carry
out any instructions that m ay be gi ve n to him by the Engineer or his
representatives, and the Contractor will be held liable f or the faith-
ful obser va nce of any instruction s which may be delive red to him or
his authoriz ed r epresentativ e on the work.
LINES AN D GR ADES. When th e Contractor requires stakes or
marks,, he sha ll notify, the Engineer of his requirements a r eason-
a ble length of time in advance of his starting oper ations th at r equire
su ch sta kes a nd marks.
Sta kes a nd marks se t by the Engineer• shall be c arefully preserved
by the Contractor. In case such stakes and markings a re dest royed
or damaged by reason of the Co ntra cto r's operation s, the cost of
r epla cing or restor ing them may be deducted from any mon eys du e
or to become due the Co ntra ctor.
IN SP ECTION. The Engineer shall at a ll times have access to the
work dur in g its co nstruction, and sha ll be furn ished with ev ery
reasonable facility for ascertain ing that the stock and materials
,ed and employed, and the wor kmanship, are in a ccor dance with
the re quirements and intentions of these specifications . All work
done and a ll materials furnished` shall be subje ct to his inspection
and approva l.
The inspection of the wo rk sha ll not relieve the Contr actor of any
of his obligations to fulfill his Con tract as prescribed, a nd defect-
ive work sha ll be made good a nd unsuitable ma te rials may be rejec ted.

R EMO VAL OF DE FECTIVE AND UN AU THORIZED WO RK. All
work which has been r ejected shall be remedied, or re moved and
r eplaced by the Contracto r in an acc eptable man ner and no c om-
pemsition will be allowe d him for such re moval or replace me nt.
Any work done beyond the line s and grade s sho wn on the plans or
established by the Engineer , or any extra work done without writte n
au thority will be co nsidered as unauthorised and will not be paid for .

Upon fa ilure on the part of the Co ntractor to comply fo rthwith with
any order of the E ngineer made under the pro visions of this a rticle,

GENE RAL PROVISI ONS
FIN AL IN SPECTION. The Engin eer will, n ot make th e final inspection
until the work provided and contemplated by the Contract ha s been corn-
pleted and the final cleaning up performed.
IN TERFE RENCE WITH UTILITIES. The Contract or shall n ot interfere I
with the operation of water and g as distributing systems.. Where it is
necessary to shut off wate r or gas to m ake conne ctions to existing pipes,.
ea ch per son having water or gas' connections in the district affected mug(
be notified at le ast two (2) hours in advance of the time that the water or
gas will be shut off.
No mate ria l or other obstr uctio n shall be placed within 15 feet of a fire
hydra nt. Fire hydrants shall .be maintained at all times readily access-
ible to. the Fire D epa rtment.
In case it should be necessary to move the property of any ow ner of a
public utility or franc hise, such owne r will, uponproper application by
the Co ntractor, be notified by the City Engineer to move su ch property
within a specified reasona ble, time, a nd the Contractor shallnot int er-
fer e with su ch pro perty u ntil after the expiration .of the time specified .
The right is r eserved to the owners of public, utilities or franchis es to
enter upon the stre et or 'the site of the work fo r the purpose of making
r epairs or cha nges to their properties that ma y be made necessary by
the work. The City of Palo Alto, its agents and: emplo yees, shall also
have the right to enter upon the street or s ite of the wor k fo r the pur-
po se of repairing se we rs, or making connections therewith, or of mak-
ing r epairs, or c hanges to culverts, catc h basins. storm water sewers ,
wa ter ma ins and service s, gas mains and s ervices, ande lectrical fix-
tures and conduits.

CONTROL OF MATERIAL
a) SOU RCE OF SUPP LY AND QUALITY OF MATERIALS. Only mater-
ia ls confo rming to the requiremen ts of these specificati ons and
approved by the En gineer s hall be used in the wo rk. At th e option of
the En gine er the source of supply of ea ch of the materials shall be
approved by him befor e the delivery is started. All materials pr o-
poe.ed for use may beinspected or tested at a ny time during their
pre par ation and use. Afte r trial, if it is foun d that sour ces of supply
which have bee n approve d do not furnish a uniform product, or if the
pro duct from any surce proves unacceptable at any time , the Con-
tractor shall furnish approved material fro m other appro ved source s.
No materia l which, after approval, has in any way become unfit for
use sha ll be use d in the wo rk.
b) STOR AGE OF MA TE RIALS. Ma te rials shall be so sto red as to in-
sur e the preservation of their quality a nd fitness for the wor k. When
considered necessary by the Engineer ,; they shall be placed on woode n
platfor ms or o ther .hard, cle an surfaces and not on the ground. They
sha ll be place d under co ver when so dire cted. Store d materia ls shall
be so lo cated as to facilitate prompt inspectio n.
c) DEFE CTIV E MATERIALS. All mate rials not conforming to the re-
quirements of these specifications shall be considered as de fective
and all su ch materials, whe the r in pla ce" or no t, shall be reje cted.
They shall be removed immediately from the site of the wor k, unless
otherwise permitted by the Engineer. No rejected material, the
defec ts of which have been su bee ently co rr ected, shall be used

TRADE NAMES AND ALTERNATIVES. For convenience in desig-
natio n on the plan s or in the specif cations, c ertain equipment or
article s, or materia ls ma y be dernignsted under a t rade name or the
name of a manufacturer and his catalog ue information. The use of
altern ative equipment or an a rticle or mate rial which is of equal
quality and of the required char acte ristics for the •purpose intended
will be permitted, subject to the a pproval of the Engineer, in accord-
ance with the following requirements.
The burden of proof as to the comparative quality and suitability of
alternative equ ipment or articles or mater ials shall be upon the Con-
tr actor and he sha ll furnish, at his own e xpense, all information
nece ssa ry or related thereto as required by the Engineer. The
Engineer shall be the sole judge as to the comparative quality and
suitability of alternative equipment or articles or mater ial* and
his decision shall be final.
The above provisio ns shall no t be co nstr ued as per mitting the use
of a lternative equipment or a rticles or materials fo r equipment or
articles or mate rials which are not designated under a trade na me
or the na me of a manufa ctu rer and his catalogue information, and
for which spec ificatio ns are set .for th.
SA MPLE S AND TESTS. All tests of materials fur nished by the Con-
tractor shall be made by the Engine er or his, a uthorized repre se nta-
tive in accorda nce with common., recognized standa rds of natio nal
organizations, or such specia l methods and tests as are in use at
the Division of Highways laboratory of the Sta te of California, or in
the special provisio ns.
Fie ld tests of ma terials will also be made by the Engineer when
deemed necessary and these tests shall be made in accorda nce with
standard practices of the Divisio n of Highways.
The Contrac tor sha ll furnish, without cha rge, such samples of all
mater ials as. are requested by the Engineer. No material shall be

DE SCRIPTION. Earthwo rk shall consist of p erf orming all op er a-
tions necessary as described in S ection 12 (a) of th e Calif orni a
Specifications.
TREES. All tree s whic h fail to cle ar the finish ed work by at least
two feet shall be removed unless it is shown on the plans, or the
Enginee r directs, that a tree or trees a re to remain. Contract or
shall remove such tr ees in advance of the construction of the per-
ma nent impro ve ment and sha ll dispo se of them as directed by the
Engineer. The trunks of the tre es shall be rem oved to a depth of
not less than two fee t below subgrade a nd the resulting cavity shall
be backfilled and compacted, using approved materi al. Ca re shall
be taken in r emovin g tre es to insure that damage is n ot done to
adjacent improvements.
c) SURPLUS MAT ERIAL. Surplus material shall be disposed of by
the Contractor at a torte and in a manner satisfac tory to the Engin-
eer. The Palo Alto dumps are available fo r disposition of surplus
materials.

valve boxes, a nd mo nument boxes as well as those to be installed
as an ite m of work under the Contr ac t, shall be set to finis hed grade

in the Contract will be set by the City. Frames and boxes shall be
set in conc rete. The concre te shall be held two inches lo w in a reas

that por tion of the roadbed surface which has been prepared, as
specified, and upon whic h a layer of specified roa dbe d material or
base or surfacing or pavement is to be place d.
In .0 cases the details of the operations of preparing subgrade shall
be under the direction of the Enginee r who :s hall have author ity at all
times to sto p the opera tio ns, if in his opinion these specific ations
are no t being complied with in a manne r which will result in the type
of subgra de specified.
The finished subgrade shall be true to grade a nd cro ss-section, hard,
uniform and smo oth.

All pipe and appur tenances shall be . carefully lowered into the trench.
Under no c ircumsta nces shall water main materials, be dropped or
du mped into the tren ch. Every: precaution sh all be taken to prevent

the lin e. At times when pipe laying is n ot in propose, the open
ends of pipe sha ll be closed by at. watertight plug or other means

be placed at a depth of 24 inches belo w curb grade, whereas gal-
van ized iron conduit may placed 9 inches below curb g rade.
E ither type of co nduit sha ll be installed 6 inches under the edg e
of the wa lk. The conduit shall be under the property edge of th e
walk if the walk and curb are integra l, or under the street edg e
of the wa lk if curb and walk ar e sepa rated by a planting strip. A
piece of timber at least 2" x 6" in section shall be placed for sup-
port under any transite conduit when it crosses o pen holes or back -
filled trenches. The condu it running pa rallel to the shall be
c urved out from u nder the walk so as to enter the ju nction bo x at
the e nd. These short expose d lengths of conduit nee d not be gal-
va nized iro n but the cro ssings of a planting area between sidewalk

All bends and risers to the electro liers shall be at the Contractor's
option either 2« inch traneite bends or 2 -in ch galvanized iron when
conn ecting to 2 -inch tra nsite pipe. In an y single run only one siz e

cou plings or adapters, and W he rever the girl: may be
damaged on galvan ited iron conduit, as at joints, the e xposed iro n

It shall be; incumbent on the Contractor to t est all transits conduit
installations in the presence of a.r'eprese nteti ve of the Engine er.
Such tests shall be m ade by blowi ng a rag %rouge each run with
compressed air. A string shall be attach ed to the rag so that any
bre aks disclosed by this test can be located from the length of the
string. Any breaks so disclosed shall be repaired and the test
repea ted.
Junction boxes shall be Forni "Electrical" reinforced con crete
boxes, 16 -inch x 27 -inch x 16 -inch deep (net insid e) with covers,
or appro ved equal. They shall be located j+tst out from und er the
sidewalk so that they can be used for pulling ; wire, and they shall
be buried with the to p at least 6 inches belay; grade, under the p ro-
perty e dge where walk and curb are integral add .uader the street
edge wher e the parking strip is provided. The City of P alo Alto
shall be fur nished with a map showing all junction. box locations .
Junction box locations areto be marked with the letter "E" indented
in the sidewalk.
Fo r pole rise rs the Contractor sha ll e xtend the co nduit 10 feet up
the ris er pole. The r iser a nd the elbow undergrou nd shall be gal-
vanized iron. Enou gh ca ble shall.be furnished to r each the top of
the pole plus 6 feet extra.

STRE ET LIG HTING CONDUCTOR CABLE
a) D ETA ILS. Ca ble sha ll be 5.000 -volt single conducto r, No. 8,
solid or stranded, non-leaded, with 10/64 inch oz one -re sistant
insulation to meet ASTM Specifications D -5T4 a nd 4/64 inch grade
1 neoprene jacket per Appendix lc of IPCEA "Gene ral Specifica-
tions for Rubber and Ru bber -like Insulatio n, " Splices shall be
made ,in accordance with City of P alo Alto Drawing No. 12187.

Two feet of ca ble shall be looped in each junctionbox.
b)- TEST. All electrolier systems will be given a final inspection
and test be fo re acceptance by the City. The ele ctr ical te st shall
consist of a high potential test between all wiring and ground and
a continuity test. In the event tha t the system fails to pass the
first acceptance test, subsequent' tests will be made at the Con-
tractor's expense.
