RESOLUTION NO . 3557
A RESOLUTION DETERMINING UNPAID ASSESSMENTS AND PROVIDING
FOR ISSUANCE OF BONDS
WELLSBURY WAY, ET AL
PROJECT NO . 60-1
RESOLVED, by the Co uncil of the City of Palo Altu, Califor nia,
that
WHEREAS, said Cou ncil did on March 26, 1962, pass a nd adopt its
Resolution No. 3479 of Preliminary Determination a nd of I ntention
relating to the a cquisition a nd constr uction of p ublic improvements
in said City un der and pursua nt to the provisions of A rticle 4,
Chapte r 5 of the Palo Alto Impro veme nt Procedure Code, and did there-
in provide that serial bonds would be issued thereunder p ursuant to
the provisions of Bond Plan B of Article 3, Chapter 6 of said Code,
referen ce to said Resolu tion of Preliminary Determination and of
Intention her eby being expressly made for f urther particulars;
WHEREAS, notice of the recordation of the assess ment a nd of the
tim e within which assessments may be paid in cash has bee n duly p ub-
lished and mailed in the manner prov ided by said Code, and the time
so provided for receiving the pa yment of a ssessments in cash has
expired, and on September 7, 1962, the Superintendent of Streets has
filed with the City Treasurer a list of all assessm ents which now
remain unpaid; and
WHEREAS, the Cou ncil has duly considered said list an d has de-
termined that the sam e is an accu rate statement thereof;
NOW, THEREFORE, IT IS HEREBY ORDERED, as follows:
1. That the a ssessments in said unpaid list which n ow remain
unpaid, and the aggregate thereof, are as shown on Exhibit "A" hereto
attached and by reference made a part hereof.
2. That for a particu lar description of the lots bearing the
respectiv e assessment numbers set forth in said u npaid list and upon
which assessm ents remain u npaid, severally and respectively, reference
is hereby made to the assessmen t and to the diagram recorded in the
office of the Superintendent of Streets of said City after confirma-
tion by said Council, the se veral lots rep resented by said assessme nt
nu mbers being so numbered and designated upon said diagram and assess-
ment as so co nfi rmed and recorded, se ve rally and respecti vely.
'.-3. The unpaid list is in the amount of $223,336 .75 and bonds
shall be issued upon the security of said unpaid assessments in the
amount of $233,336.75 in accordance with the provisions of Bond Plan
B of Article 3, Chapter 6 of Ordinance No. 1928 adopted by the City
Council of said City on April 11, 1960, entitled "Palo Alto Impro vement
Procedu re Code", and under and pursuant to the provisio ns of said
• Resolution of Pr el:.minary Determination and of Int ention and the p ro-
ceedings thereun der du ly had and taken; that said bonds shall be two
hundred twen ty-four (224) in number , shall be dated Octobe r 2, 1962,
and bear in terest fr om their date at the rate of not to exceed six
pe r cen t (6%) per ann um, a nd the denomin ation of said bo nds with their
r espectiv e n umbe rs and dates of matur ity ar e as shown on Exhibit "B"
hereto a ttached and made a part hereof by refere nce.
4. Said bonds shall be issued in series, and the unpaid assess-
m en ts as shown on said list filed with the City Treasurer of said City
and determined by sa id Council, together with the in terest thereon,
shall remain an d constitute a tru st fund for the redemption an d payment
of said bon ds an d of the interest which may be due thereon, which un -
'paid assessmen ts shall be taxable in annual series cor respon ding in
nu mber to the number of series of bonds issued, and an ann ual propor-
tion of each assessmen t shall be paya ble in each year preceding the
date of the ma turity for each of the sev er al bonds issued, an d such
pr opor tion of each assessment comin g due in an y yea r, together with
the annu al interest thereon, shall in tu rn be payable in in sta llm en ts
as the general taxes of said City on real property are payable, an d
shall be come delinque nt at the same time an d in the same pr opor tionate
a mounts and bear. the same propor tionate pena lties for delinquency.

5. Said bonds sh all be signed by the City Clerk and City
Tre asurer or bear the engra ved, printed or lithographed sig nature of
said Cle rk, and the official seal of said. City shall be affixed there-
to. The interest coupons affixed thereto shall be signed by said
Treasurer or bear his engra ved, printed or lithographed signat ure;
and such sig ning and sealing of said bonds by said officers and sign-
in g of said co upons by said T re as urer sh all constitute and be a
sufficien t and bindi ng execution of each a nd every o ne of said bonds
and all of the coupons thereo n resp ectively. Said bonds shall be s ub-
stantially in the form set forth in L"ond Plan B of said Impro veme nt
Pr ocedu re Code. Said Clerk and Treasurer of said City are authorized
and dir ected to sign said bonds.
6. The interest coupons attached to each of said bonds and
ev idencin g the in terest to accrue thereon shall be numbered cons ec-
utively and be su bstantially in the following form,' to -wit:
