WHEREAS, this 'Counc] .l did, on'M iroh 26, 1962, adopt itn
Resolu tion No. 3479 of Prelimin ary Dete rmi nation and of intentio n
to oonetruet public improvements in a nd fo r said City;
WHEREAS, on April 9, 1962, this Council adopted a resolution
appointing time and pla ce of hogri3O,110.ftsts. :; 1 'M a the -
proposed acqu isitions an d improv ements and di recting notice;
WHEREAS, notice wa s given of the time and place therein stated
in the manner prov ided by law, as appe ars from the affidavits on
file in the office of the City Clerk;
WHEREAS, said matter came on regu lar ly for hearing at the
time therein fixed; and
WHERE AS, all written prote sts and other written communicati ons
were pu blicly re ad at said meeting an d all pe raons desiring to be
heard were fully heard.
NOW, THE REFORE, IT IS ORDERED, as follows:
1. Tha t written protests against said acquisitions an d
impr ov ements signed by the o wne rs of a majority or more of the
area of the lands within the assessmen t distr ict, or of the a rea o
the lands within the assessment district a ssessed for the c osts and
ex pen ses of sa id work, were no t filed w ith the City Clerk at er
before the time set for hear ing.
2. Tha t said pr ote sts be, and e ach of them are hereby,
over ru led.
