RESOLUTION NO. 3481
RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
CONSENTING TO THE ESTABLISHMENT OF OREGON AVENUE
AS A COUNTY HIGHWAY
WHEREAS, on March 28, 1961 the electorate of the Co unty of
Santa Clara approved a $70,000,000.00 Cou nty bond issue to p ro-
vide fu nds for the construction of a County Expressw ay System
as gen erally descr ibed in the Cou nty of Sa nta Cl ara Expressway
Policy Resolutio n a dopted by the Board of Supervisors of said
Co unty on De cember 27, 1960 and in the resol uti on of the Boa rd
of Supervisors of said Cou nty adopted Jan uary 9, 1961; a nd
W HEREAS, one of the projects described a nd contained in
said resolution s was the "Oregon -Page Mill Expressway " between
Bayshore Freeway an d El Camin o Rea l an d lying within the i ncor-
pora ted limits of the City of Palo Alto; and
WHEREAS, the Board of Superv isors by Resolution adopted
March 26, 1962 has determined that it is of general county
interest that a certain existing street in the City of Palo Alt o,
to wit; Oregon Avenue between the railroad tracks of the Southern
Pacific Compan y and Bayshore Fr eeway be made a co un ty highway
within the City; and
WHEREAS, a copy of said resolution has been re ceived by the
City Council an d the City Cou ncil desires to conse nt thereto
subject to the conditions and limitations herein after set forth;
NOW, THEREFORE, the Co uncil of the City of Palo Alto does
RESOLVE as follows:
SECTION 1. That pursuant to the provisions of Article 5
(commencing with Se ctio n 1720) of Chapter 9, Division 2 of the
Str ee ts and Highways Code of the State of Califo rnia the
gov ern ing body of the City of Palo Alto does her eby consen t to

The establishment of Oregon Ave nue bet ween the railr oad tracks
of the Souther n Pacific and the Baysho re Freeway as a county
highway.
SECTION 2. The pr oject limits of said county highw ay as
herein declared shall be substantially as shown on C ounty Pl an
No. 2, a modification of the Palo Alt o Plan A-8, appro ved by the
Boa rd of Supervisors of Santa Clar a C ou nty at its me eting of
Ma rch 19, 1962, a copy of which docume nt is on file in the
Offic e of the City Clerk of Pal o Alt o.
SECTION 3. Said stree t shall be c onstructed and maintain ed
as a county highway substa ntially in acco rdanc e with said pl an
an d said project shall be fin an ce d out of the C ounty Bo nd Issue
of 1961. The insta llation, ma inte nance, const ruction and nature
of lighting a lo ng said street, or an y modification thereof, shall
be su bject to the approv al of the City Coun cil.
SECTION 4. The Co unty shall no t co nsent to the con versio n
of sa id street to a state highway or state freewa y, nor shall
any city stre et, the closing of which is not pro vided for in
said plan he closed either directly or indirectly n or sha ll the
r oadw ays as co nstructed be widened, un less te mporarily nece ssary
during construction oper ation s, except pursuant to an agr eement
betwe en the City Council and Boa rd of Su perv isor s.
SECTION 5. The po lice po wer of the City with reference to said
street, particularly as to the contro l of the speed and weight of
v ehicles thereo n, shall not be limited except that no o rdina nce of
the city relating to the stopping, sta ndin g or pa rking of a vehic le
sha ll become effe ctive as to said highway without prior submission
to and approval by the Boar d of Supe rvisor s n or shall the City
e rec t or maintain an y stop sign s, semapho re or o ther traffic con-
trol signalling device in such manne r as to requir e the traffic
on said highw ay to stop before enterin g or cr ossing an intersecting
street or any railro ad grade c rossing withou t permission of the
Bo ard of Supervisors.

SECTION 6. This resolutio n shall not become effective until
approv ed by a majority of the electors voting thereon at a
spe cial electio n to be held in the City on June 5, 1962.
SECTION 7. The City Clerk shall file a certified copy of
this reso lution with the Board of Supe rvisors and the Registra r
of Voters of Santa Clara Cou nty.
