PROJECT NO.60-1 RESOLVED, by the C ouncil of the City of P alo Alto, Californi a, tha t it doe s hereby p reliminarily determi ne that the public inter- est, co nvenience and necessity require, and th at it i ntends to order the wor k to be done, acquisiti ons a nd imp rove ments to be made, as hereinafter described . 1. All of the blocks, str eets and all eys herein me ntioned are shown on maps of record in the office of the Cou nty Recorder of Santa Clara Coun ty, State of Califo rnia, and shall be show n on the plan s herein referred to an d to be filed with the City Clerk of said City. 2. Whenever any pu blic w ay is her ein referred to as r unni ng between tw o pu blic w ays, or from or to any public way, the inter- sections of the public wa ys referred to ar e in cluded to the extent that wor k shall be shown on the plans to be do ne therein. 3. All of said wo rk an d improveme nts are to be constructed at the places and in the particu la r loca tions, of the forms, sizes, dimension s and materials, and at the lines, grades and elevations as shown and de lineated upon the plans, profiles a nd specification1 to be ma de therefor, as hereina fter provided. 4. Ther e is to be excepted fr om the work described any of such wor k a lready don e to line and grade and mar ked ex cepted or shown not to be done on said plan s, profiles and specifications. 5. Said Council does hereby a do pt and establish as the offi-i cial grades for said w ork the grades and elev ation s to be shown upon said plan s, profiles and spe cifications. All su ch gr ades an d elevation s are to be in feet and decimals thereo f with refer en ce tc the datum plane of the City of Palo Alto. 6. Sa id work, ac quisition s and Improvements are mor e par- ticu larly descr ibed as follows: 1777 a) The acq uisition and opening of Wellebury W ay from Middlefield Road so uthweste rly to the no rtheasterly terminus of Wellebury Way as it appears on the m ap of Tract No. 2867, and the opening of a c ul-de-sac from a point on said Wellebury W ay ab out 130 feet n ortheaste rly of said existi ng terminus so utheasterly about 200 feet, and the improvi ng thereof by grading, r emov ing trees, bushes a nd existing struct ures, a nd the constructio n therein of base pavement and wearing su rfa ce, Portland ceme nt concrete cu rbs, gutte rs, sidewalks and drive way apr ons, s anitary se we r m ai ns, manholes, w ye branches, laterals and appurten an ces, street lightin g facilities, sto rm dr ain pipes, catch bas ins and appurtenances, and utility laterals and s ervices as requ ired. b) The acquisition an d opening of a c ul-de-sac from a point in Mayview Avenue betwee n Middlefield Road and Grove Avenue s ou theasterly about 400 feet, and the improving there of by grading, removing tr ees, bushes and ex isting structures, and the const ructio n of base pavement and wea ring surface, Portland cement con crete cu rbs, gutters, sidewalks and driveway a pro ns, sanitar y sewer m ains, ma nholes, wye bra nches, later als and appurtenances, street lighting facili- ties, utility latera ls an d services as requi red, a nd storm drain pipes, catch basin s an d appurtenances from the southeaster ly terminu s ther eof southeaste rly in an easement to be aoquir ed herein to Adobe Cr eek. c) The a cquisition and open in g of Christine Dr ive from its prese ntly sou thwester ly terminus south- w ester ly, n or thw este rly and southwesterly to Middle field Road, and the impr oving thereof by gr adin g, removing trees, bushes and ex istin g struc- tures, an d the construction therein of ba se pavemen t and wear ing surface, Portland cemen t con cr ete curbs, gutte rs, sidewa lks and driveway a pron s, s anitary sew er m ains, m anholes, wye branches, laterals an d appu rtena nces, utility later als and services as r equ ired, an d storm drain pipes, catc h ba sins an d a ppu rtenan ces in the e asterly portion thereof and in an easemen t to be acquir ed herein from the termin us of the proposed opening southea ster ly to a man hole in East Mea dow Dr ive. d) The a cqu isition and opening of a street kn own as Miranda Gr een from a point in Miranda Av en ue north- ea ste rly abo ut 530 fee t, a nd the improving the reof by grading, remov in g tre es, bushes an d e xisting structures, an d the con stru ction ther ein of base pavem en t an d wearing surface, Portla nd cemen t con- crete cur bs, gutters, sidewalks and driv eway aprons, a san itar y sew er m ain an d manhole in the cul-de-sac at the ea sterly terminu s, storm drainage cr oss drains , ca tch basin s and appur tenances across said stre et at a pproximately its m id -point, thence easterly in an ea sement to be acquir ed herein to an existing cre ek, an d utility serv ices and la terals as required. 2 J '. e) The acquisition and opening of a c ul-de-sac com- monly known as Diablo Way, from a point in El Camino Way southeasterly of West Meado w Drive northeasterly about 225 feet, and the imp roving thereof by g rading, removing trees, b ushes a nd ex isting struct ures, and the co nstructio n therein of pass pavement a nd wearing s urface, Portl and cement concrete curbs, gutters a nd sidewalk s, street lighting facilities, storm drain pipes, catch ba sin s and appu rtena nces from its easterly terminus in an easement to be acquired he rein n orthea sterly to Wilkie Way, a nd utility services and latera ls as required. f) The acquisition and opening of the portion of Colon ial Lane not now dedicated betwee n Gre er Road and Mor eno Avenu e, and the improving thereof by grading, r emoving trees, bushes a nd existing str uctu res, an d the con str uction therei n of base pavement an d wearing surface, Portla nd cement concrete curbs, gutters, driveway aprons a nd side- walks, and utility later als an d services as re- quired. g) The improv in g of Page Mill Road from Junipero Serra Bo ulevard northeasterly 2350 feet, more or less, Hansen Way from Page Mill Road to El Camino Real, and Hiliv iew Aven ue fr om Hanover Street to Junipero Serr a Boulevard, by the installation of eleotroliers together w ith con du it, conductors, junction or pu ll boxes, a nd all n ecessary ap- pu rtenances. h) The acquisition of a ll lands a nd easements and the construction of all improv em en ts au xiliar y to any of the a bove and nece ssa ry to complete the same. • i (different f rom th at forme rly e xisting, and that to said extent said grades are hereby cha nged and that s aid wo rk will be do ne to said cha nged gr ades. 8. The plans and p rofiles of the wor k an d the maps an d descriptions of the acquisitions, as con tained in the Engineer 's report, shall be oontrolling as to the oorrect and detailed description thereof. 9. Said con templa ted a cqu isitions and improveme nts, i n.the opinion of this Council, ar e of more than loc al or ordi nary public ben efit an d said Cou ncil does hereby make the costs and expe nses thereo f charrable u pon an assessment distr ict, which district said Coun cil declare s to be the district ben efited by s aid aoqui- 3sition e'a nd improvemen ts, the exter ior bo undaries of which are ydeacr ibed as the cotermin ou s exter ior boundar ies of the composite a nd con solidated a rea of all paroe la of pr operty fr on ting on said proposed acquisitions and impr ovements, more partioularly sho wn on a map thereof identified as "Assessment Diagram, Improvement Pr oect 60-1, ¥ellebur y, Way, Et Al.", on. -file in the office of the City Clerk, which indicate s by a boun dary line the extent of the territor y in oluded in the pn opoee d district and which shall gove rn for all deta ils as to the ex tent of the aseeeement district. 10. Said Cou ncil further dec lar es that a ll pu blic streets, highwa ys, la nes and a lleyye within said assessmen t distr ict in u se in the per formance of a public fu nction as su ch, sha ll be omitte d fr om the assessm en t herea fter to be made to co ver the costs and expense s of s aid acqu isition s and im provements. 11. New is hereby given that aer ial bon ds to re presen t unpaid assessments, and bear inter est at the r ate of not to excee d six per oent (6%) per annum, will be issued hereunder in the li, 7. N otice is he reby gi ven of the fact that in many cases said work and improvement will b ri ng the finished wo rk to a g rade manner p rovided in Bond Plan B, Article 3, Chapte r 6, of O rdinance No. 1928, The Palo Alt . Impr ovement Prosed u . Sa id acqu isitions and improvements are hereby refe rred to the City E ngin eer of said City, as the officer h avi ng charge an d control of the acquisition and construction of p ublic improve- men ts in and for said City of the kind desc ribed .;h erei n, being a competen t person employed by said City for that purpose, and said City Engin eer is hereby directed to make and fil e with the City Clerk of said City a report in writing, presenting the follow in g: a) Maps a nd descriptions of the lands, easemen ts and rights to be acquired; b) Pla ns and specifications of the propo se d improvements to be made pu rsu an t to this i�sol�$On; 'a)En gine er's estimate of the total costs and ex pen ses of ead.taegtit$3. tioh e an4 im provemen ts an d of the inciden tal ex penses in connectio n ther ewith; d) Diagr am show ing the assessment distr ict above re ferred to, and also the bou ndaries an d dimensions of the respective su bdivi- sions of la nd within sa id district as the same existed at the time of the passa;e of this Resolution, e ach of which subdiv ision s shall be given a sepa rate number u pon said diagram; e) A proposed assessmen t of the tota l a mount of the costs and ex penses of the proposed acquisitions and improvements upon the several subdivisions of lan d within said district in 5 10* o C" proportion to the estimated benefits to be received by such sub- divisions, respectively, from said acquisitions and imp rov ements, a nd of the exp enses incidental thereto. 14. If any exc ess shall be realized f rom the ass essme nt it shall be spent for the m ainte nance of said acquisitions and improv emen ts unless the Council shall here afte r determine th at said amoun t, or any part thereof, shall be applied as a credit to each assessment herein.
