BY IEMMEOL!TION , The Council of the City of Palo Alto does RESOLVE as follows: Section 1. Pzoof of the giving a ndposti ng of notices by the Buildin§Anfrittor4as provided by law with respe ct to the building at 444' High Street has been filed with the City Clerk. At th e hearing testimony of Stewart Bottema, Chief Building Inspect or, w as received together with pictures of the property. Seetleon 2. Upon the basis of the testimony and e vid ence rec- eived the following facts are found to be true with respect to said property: a. The building at 444 High Street was or iginally const ructed in 1916. It *as' used primarily ae a resbiluratkt until approxi- mately 1950 when this use was din snu ed. The building has ret ained vacant fen 1950 to t eprosent date. b. T4tewalla ar e constructed of brick and apparin tly Without rein forcing steel. The roof leaks and sage conside rably a nd thereby creates a hazard to public elkety. c. Tha electrical wiring has been partially remove d an d damaged and constitutes a v iola tion of the Palo Alto Electric al Ordinance. In many places bar e wir es hang lbosa fro m the ceilin g. If energized, the present wiring would constitute an extreme fir e hasatd. d. The plumbing ifatallations are e xten siv ely damaged and deteri- orated and have been partially r emoved. In many in stances the plumbin g is not conetructed in confor mity with the Palo Alto Plumbing Code. The building has no sanitary facilitie s. e. The inter ior partition s and supporting walls hav e bee n re mo ved in many places and cre ate a real ha zard tha t the roof framing members will give way an d the roof and adjo ining walls collapse. f. The wom da floor and its supporting membe rs are decayed an d ro tted a nd the floor covering has been remov ed. g. The pre mises have n ot bee n served with wa ter , gas or elec tric utilities since so me time prio r to 1950. h. The front face of the building shows evidence of se ttling and r esultant crac king betw een the br icks and creates a hazard to public safety. i. Flues an d chimneys re quire d by the Palo Alto Building Code hav e bee n removed. Holes have been le ft in the walls and ro of and the interio r of the bu ilding has bee n directly exposed to the weather. - 1 - • j. The b uilding is in n eed of r epairs and alte rations requi red by the P alo Alt o Building C ode in an am ount f ar e xce eding the 50% valu e of the eltaingtb uilding. 1. The building can not be reaso nably repair ed so that it will either be a safe building or so that it will no longer exist in violation of the Palo Alt o Buiidi ngCode . The building constitute s a public n uis an ce which can effectively be abated o nly by demolition or removal of the same , Section ,. The building is f ou nd to be d anger ous to human life and detrimen tal to health through lack of maintenance and repair generally and throu gh improper sanitary faciliti es . The exterior walls, floors and roof are so deteriorated, broken and debaged as riot to e!C'tlude rain or wind and by reason of such condi- tion ar e da nger ous to huma n life and detrimental to health . The suppor ting walla are deteriora te d, damaged and r emov ed to the extent that walls list or lean and form ina dequate s upp ort for the roo f a nd by reason of such condition are dan gerous to human iife and de trimental to hea lth. The bu ilding has become unfit for hu man habita tion or occu pan cy and a public nuisance within the terms of the State He alth and Safe ty Code. The building is structurally unsafe , co nstitutes a fire ha zard, is dange ro us to human life , and in relation to e xisting use co nstitute s a hazar d to safety a nd health and public we lfare by r ea son of inadequate maintena nce , dila pidatio n, o bsolescence and abandon ment, and is an unsa fe building within the terms of the Palo Alto Building Code. The building cannot r ea so nably be repaire d and the nuisa nce can reasonably be abated only by demolition or remov al. Sec tion 4. The owne r of said building is directed to abate said n uisan ce by demolition thereo f within 30 da ys of the postin g thereo n of a copy of this resolutio n. The o wner is info rme d that if he doe s not so demolish said building, the City of Palo Alto will do so and that the c ost there of will be made a lien on the la nd upon which the building is situa ted. -2- INTRODUCED AND PASSED: Dec emb er 11, 1961 by majority voice vote .
