RESOLUTION NO. 3330
A RESOLUTION DETERMINING UNPAID ASSESSMENTS
AND PROVIDING FOR ISSUANCE OF PONDS
EMBARCADERO ROAD EAST OF BAYSHORE
PROJECT NO. 59-11
RESOLVED, by the Co uncil of the City of Palo Alto,
California, that
WHEREAS, said Council did on July 11, 1960, p ass a nd adopt
its Resolution No. 3236 of Prelimina ry Deter minatio n and of
Inten tio n, as a men ded, relating to the acq uisiti on and co nstruction!
of public impr ovements in said City under and pursuant to the
provisions of Article 4, Chapter 5 of the Palo Alto Imp ro vem ent
Proce dure Code, and did therein pr ovide that s eri al bo nds w ould be
issued ther eu nder pur suan t to the pr ovisions of Bond Pl an B of
Article 3, Chapter 6 of said Code , re fe rence to s aid Resolution of
Pr elim inary Deter mination and of Intention, as amended, hereby
bein g expressly made for further particu lars;
WHEREAS, notice of the r ecor dation of the assessme nt and
of the time w ithin which assessme nts may be pa id ir:ca sh, has been
duly pu blished and mailed in the ma nner provided by law, and the
time so pr ov ided for receivin g the payment of asseasrnents in cash
has expir ed, and on Janu ary 3, 1961, the Su perin tenden t of Streets
has filed with the City Treasurer a list of all assessmen ts which
now remain unpaid; a nd
WHEREAS, the Cou ncil has du ly considered said list and has
de te rmined that the sa me is an accu rate statement thereo f;
NOW, THEREFORE, IT IS HEREBY ORDERED, as follows:
1. That the a ssessments in said un paid list which now re -
m ain un paid, and the aggregate thereof, are as shown on Exhibit A'
he reto attached and by refer ence made a par t hereof.
2. That for a particular description of the lots bearing
the respective assessm ent number s set forth in said unpaid list an d!
upon which assessme nts remain unpaid, se verally and respecti vely,
refere nce is hereby made to the assessment and to the diagr am re-
corded in the office of the Superintendent of St reets of said City i
after confirmation by said Council, the several lots represented by!
said a ssessment numbe rs being so numbered a nd desig nated upo n said
diagram and assessm ent as so confi rmed and recorded., se verally and
espectively.
3. The unpaid list is in the amou nt of $99,923.85 and bo nds!
shall be issued upon the security of said unpaid assessments in the
moun t of $99,923. 85 in accordance with the p rovisions of Bo nd Plani
B of Ar ticle 3, Cha pter 6 of Ordinance No. 1928 adopted by the City
Co un cil of said City on April 11, 1960, e ntitled "P alo Alto
mprovement Pr ocedure Code", a nd under and pursuant to the pro-
jvislons of said Resolu tion of Pr eliminary Determination and of
Intention, as am ende d, and the pro ceedin gs thereunder duly had and
taken; that said bonds shall be on e hundred (100) in number, shall
Abe dated Februa ry 2, 1961, and bear inter est fro m their date at the
Irate of not to ex ceed six per cent (6%) per annum, and the d.e nomi-
Ination of said bon ds with their respective numbers an d dates of
m aturity ar e as shown on Exhibit "B" hereto attached an d made a
part hereof by reference.
4. Said bo nds shall be issued in series, an d the un paid
lassessmen ts as shown on said list filed w ith the City Treasur er
pf said City an d de termined by said Cou ncil, to gether w ith the
interest thereon, shall remain an d constitu te a tru st fun d for the
redemption an d payment of said bon ds and of the interest which may
be du e thereon , which un paid assessments shall be taxable in annual
eries cor responding in n umber to the n umber of series of bon ds
ssued, an d an annual pr opo rtion of each a ssessmen t sha ll be payable
n each year preceding the da te of the maturity for each of th.e
everal bonds issu ed, an d su ch proportio n of ea ch a ssessme nt coming
Id ue in an y year, together with the ann ual in ter est ther eon , shall
in turn be payable in i nstallm ents as the g eneral taxes of said
City on real p roperty are payable, a nd shall become deli nq ue nt at
the same time and in the same proportionate amo unts a nd bear the
same propo rtionate pe nalties for delinq uency.
5. Said bonds shall be sig ned by the City Clerk a nd City
Treasurer or bear the engraved, printed or lithographed sig natu re
of said Treasurer, a nd the official seal of s aid City shall be
affix ed ther eto. The interest coupons affixed thereto shall be
signed by said Tr ea surer or bea r his engraved, printed or litho-
gra phed signatur e; an d such signing a nd sealing of said b onds by
said officers an d signing of said coupo ns by said Treasurer shall
con stitute and be a sufficien t and binding e xec utio n of each a nd
ever y one of said bonds and all of the coupons the reof respectivelyL
Said bonds shall be substan tially in the form set forth in Bond
'Plan B of said Improvement Procedu re Code. Said Cle rk a nd
Tr easurer of said City are au thor ized an d dir ected to sig n said
bo nds.
6. The interest coupon s a ttached to e ach of said bo nds a nd
evidencin g the interest to accru e thereon shall be numbered con-
secutively and be su bstantially in the following form, to wit:
