HomeMy WebLinkAboutRESO 3328KWHW':JS:amf 1? -29-60 10C RESOLUTION NO. 3328 A RESOLUTION DETERMINING UNPAID ASSESSMENTS AND PROVIDING FOR ISSUANCE OF BONDS FOOTHILLS ANNEXATION NO. 2 SANITARY SEWERS PROJECT NO . 59-10 RESOLVED, by the Council of the City of Palo Alto, Califor- n ia, that WHEREAS, said Council did on J une 27, 1960, pass a nd adopt its Resolution No. 3230 of Prelimin ary Determi nation a nd of I nte n- tion relating to the acqu isition and construction of public im- provemen ts in said City under and pu rsu ant to the provisi ons of Article 4, Chapter 5 of the Palo Alto Imp rovement Procedure Code, and did ther ein pro vide that serial bonds would be iss ued there- under pursuant to the provision s of Bond Plan B of A rticle 3, Chapter 6 of said Code, r eference to said Resolution of Prelimi n- ary Deter min ation and of Intention here by bein g expressly made for fur ther particular s; WHEREAS, n otice of the r ecordation of the assessment and of 1 the time within which, assessmen ts may be paid in cash, ha s been duly publishe d and mailed in the man ner provided by law, and t'ne time so prov ided for receiv ing the paymen t of assessm ents in casn has ex pired, and on January 3, 1961, the Superintenden t of Streets' has filed with the City Tr easurer a list of all assessments w hich n ow re main un paid; and WHEREAS, the Coun cil has du ly considered said list an d has determined that the sam e is an accu rate statement the reof; NOW, THEREFORE, IT IS HEREBY ORDERED, as follow s: 1. That the assessments in said unpaid list which now re main unpaid, an d the aggr egate thereof, are as sho wn on Ex hibit) ftA H hereto attached and by reference m ade a part hereof. 2. That for a particular description of the lo ts bear ing the respective assessment numbers set forth in s aid un paid list and u pon which assessments r emain un paid, sev erally an d respec- tively, refere nce is hereby m ad e to the assess me nt a nd to the diagram recorded in the office of the Superintendent of Streets lof said City aft er c onfir mation by said Cou ncil, the seve ral lot s represented by said assessment numbers bei ng so n umbered and desig- na ted upon said diag ram a nd assessme nt as so co nfirmed and recorded] sev erally and respectively . 3. The unpaid list is in the amo unt of $92,386.76 and bo nds shall be issued upon the security of said unpaid assess ments in the amount of $92,386. 76 in accordance with the provisions of Bond Plan B of Article 3, Chapter 6 of Ordinance No. 1928 adopted by the City Council of eaid City on Ap ril 11, 1960, entitled "Palo Alto Improvement Pr ocedu re Code", a nd u nder and p ursua nt to the provisions of said Resolution of Preliminary Deter mi nation a nd of Intention and the proceedings thereunder duly had and taken; that said bonds shall be ninety-three (93) in numbe r, shall be dated Febru ar y 2, 1961, and bear intere st from their date at th e rate of not to exceed six per cent (6%) per ann um, and the denom- ination of said bon ds with their respective nu mbers and dates of matu rity are as shown on Exhibit "B" hereto attached and m ade a par t hereof by refer ence. 4. Said bon ds shall be issu ed in series, and the unpaid ' assessments as show n on said liat filed with the City Treasu rer of said City an d deter mined by said Cou ncil, together with the iin terest ther eon, shall remain an d constitute a trust fund for the r edem ption and payment of said bo nds and of the interest which; ma y be due thereon, wh ich un paid assessments s ha ll be taxable in an nu al series corre sponding innu mber to the number of series of bonds issued, an d an annu al proportio n of each asse ssmen t shall be payable in each year pr ecedin g the date of the maturity for each of the sever al bonds issued, an d su ch pr oportion of each assessment coming due in any yea r, together with the annual inter- est thereon, shall in turn be payable in in stallments as the -2- general taxes of said City on real property are payable, and shall (become d elinque nt at the same time and in the same p ropo rtion ate amounts and bear the s am e prop ortion at e penalti es for delinquency. 5. Said bonds shall be signed by the City Cl erk and City Treasur er or bear the engraved, printed or lithograph ed sig nat ure of said Trea surer, and the official seal of said City shall be affix ed there to. The inte rest co upons affi xed thereto shall be signed by said Tr easurer or bear his engraved, printed or litho- gr aphed sign atur e; and such aigni ng a nd sealing of said bonds by � I said officer s and signing of said co upo ns by said Treas ure r sh all i I !constitute and be a sufficient and binding execution of eac n and 1 ;ever y on e of said bon ds an d all of the c oupons thereof reapecti ve1y4 IjSaid bonds shall be substan tially in the for m set forth in Bona 1 (Plan B of said Improvement Procedure Code.
