WHEREAS, the Counoil of the City of
Halo Alto did, on the 13th d91 of July, 19~6, pass
1ta Resolution o:f' Intention Bo. 426, to order tht
hereinafter deaoribad work to be done and improve-
ment to be made in said City, which Reeolution of
Intention wae dul1 and legally published in the
time, m•rll'.ler and fo:zm ae required by the Improve-
ment Aot of 1911, ae appears from the affidavit
of Lora c. Benning, Pr1nc&pal Clerk of the printer
end publisher o! the Daily ialo Alto Times, now
orj file in the offic.,e of the Clerk of eaid oi t;y;
and
WHEREAS, notices of the paeeage of
said Resolution of Intention ioe 426, headed
"Notioe of Improvement", were dul7 and legally
poeted along the line of said contemplated work
and improvement, and on and &long eaoh and every
open street and highway in the assessment dietriot
described in eaid Resolution of Intention. in
time. form. manner and number ae required, after
the passage o:r eaid Resolution of Intention, ae
appears from the a!:tida.vit of c. L. Dlacker, who
personally posted the same, and who, upon the
completion of tne posting of said notioee forth-
w1 th filed aaid affidavit in the uffice of the
City Clerk. making oath that he completed the
posting of aaid notices on the 17th day of July,
1926; and,
WHEP~AS, all protests or objections
presented n~ve been heard and diepoeed of in time,
manner ~nd form as required by law:
NOW, THEREFORE, this Council finda
that the foregoing recital of facte 18 true and
th~t it haa acquired jurisdiction to order the
work done, and the Council of the City of Palo
Alto DO RESOLVE as follows:
That the public interest and con-
venience require the work herein deeoribed, and
the Council of the City of Palo Alto hereby orders
the i'ollowing work to ·be done e.Jld improvement to
be made in said city, to-wit:
Seotion l. (a) The construction of
a 24 inoh concrete storm water sewer on Waverle7
Street between University Avenue and Lytton
Avenue, including the removal. of the 12 inch
sewe:r· now in place, with manhol '38 and inlet
be.eina.
(b) !he oonetruction o! a ~4 inch
oonorete storm water sewer on O'niversj.ty Avenue
between Bryant Street and Waverley Street, with
manholes and inlet baaina.
(c) The construction of an 18 inoh
oonorete storm water sewer on University Avenue
between Bryant Street and Emerson Street, with
manholee and inlet oae1ns.

University Avenue from the southwesterly line of
Waverley Street to a point 60 feet southweeterly
therefrom, euoh curbs to be of the sizes and to be
laid at the plaoee and of the lengths aa shown on
the pl~ne and epeoifioations hereinafter mentioned.

at the rate of six (6%) per cent per annum will be
issued hereunder in the manner provided by the
11lmprovement Bond. Act of l9lb 11 , the l:aat installment
vf whioh ocnde ehe.11 mature nine (9) years from the
2nd day of July next succeeding ten (10) months
:from their date.
Except ae nereinabove provided for the
issuance of said aerial bonds, all the nerein
proposed work and improvement shall be done in
aocordance with an act of the Legislature of the
l;>tate of California, designated the "lmproveme:at
Act of 1911" approved April 7, 1911 and amendments
thereof.
The City Clerk ie hereby inatru.cted to poet
a notice of eaid work, together with the plane
and spec1f1oatione therefor, conapifcuoualy for
five do.ya on or near the c ounoil ohamr~er door of
said city, inviting sealed proposals or bide for
doing th• work ordered, Said Clerk ie also directed
to publish twice, a notice inviting euoh proposals,
and referring to the epec1ficat1ons poated or on
fi.le in the Dail7 .Palo il to Times, a daily news-
paper published and circulated in said City and
hereby designated for thnt purpose.
All proposals or bids shall be accompanied
by a check payable to the City of 2alo Alto,
certified by a responsible bank, for an amount whioh
shall not be lees tha.n ten per cent of the
aggregate of the proposal, or by a ~ond for the
said amount and so payable, signed bJ the bidder and
two aurctiei, who ehall justify before an7 officer
