Resolution of Intention Jo. 422 to order the here-
inafter described work to be done and improvement
to be made in said oity, which Resolution of Inten-
tion was duly and legally published, in the time,
manner and form ae required by the Improvement Aot
of 1911, ae appears from the &ffidavit of Lora C.
Benni:og~ Frincipal Clerk of tne printer and
publisher of the Daily Palo Alto Times, now on file
in the offioe of the Clerk of said City; and
WHEREAS noticea of the passage of said
F.esoJ.ution of Intention No. 42.2, headed "Notice
of Improvement". were duly and legally posted along
the line of said contemplated work e.nd improvement.
and on and &long eaoh and every open street and
highwa1 in the aeeesement dietriot described in
said Resolution ot Intention~ in time, form, manner
and number as required. after the paeaage ot said
Resolution of Intention, ae appears from the affidavit
of c. L~ Bl~oker, who personally posted the same,
and who, upon the completion of the posting of said
notioee. forthwith filed eaid affidavit in the office
of the City Clerk, making oath that he completed the
posting of eaid notices, on the 8th day of July,
1926: and

NOW, THEREFOP.E, this Council finds that
the foregoing recital of facts ie true and that it
hae acquired jurisdiction to order the wo:rl done,
and the Council of the City of Palo Alto DO RESOLVE
as follows:
That th6 public interest and convenience
require the work herein described and tne Council
of the City of Palo Alto hereby orders the following
work to be done ar.d improvement t~ be made in said
city, to-wit:
The construction of a 21 inch cement oonorete
storm water se•er 1n and along A~ma Street from the
Seale Avenue sewer line, as sllown on the plans here-
inafter mentioned, to $ point 220 feet northwesterly
from the northwesterly line of Seale Avenue.
The oon•truction of a 16 inoh cement
concrete storm water eewer in and &long Alma Street
!rom & point 220 feet' northweeterly from the north-
westerly line of Seale Avenue to the sewer line in
Churchill Avenue, as shown on the plans hereinafter
mentionede
The oonetruction of an 18 inch cement
concrete storm water sewer in and along Emerson Street
from the northweeterly line of Oregon Avenue to the
sewer 11.ne in Nevada Avenue, ae ahown on thtt plane
hereinafter mentioned.

Alma Street, eouthweeterly, for a d1etanoe of 212
feet as shown on the plane hereinafter mentioned.

concrete atonn water sewer from a point on the
Alma Street sewer line, wnioh point is 220 feet
northwesterly from the no:rthweeterl7 line of Seale
Avenue, for a distance of 9b feet soutnwesterly
across tne propert1 of the Southern iaci!ic Company
to the center line of a 10 foot public right-of-
way between Lote 8 and 9 in Block P, Southgate,
as ehown on the plans hereinafter mentioned.

ooucrete storm water sewer in and along the center
line of a 10 foot publio r1ght-6f-way between Lots
8 and 9 in Block P, Southgate, to the curb line
of Mariposa Avenue as shown on the plane hereir.after

That all of said sewers laid 1n and
along the avenues above named are lai~on a line
25 feet southeasterly from the northwesterly line
of said avenues; and all of es.id eewera li.id in
and along the streets above mentioned ere laid on
a line 2b :feet northeasterly :from the eouthweeterly
line ot said streote.
The above storm water sewers with manholes
and inlet baei~• 8l'ld special inlet on •ar1posa
Avenue, are to be constructed of the sizes and for
the dietanoea and at the plaoee shown on the plane
therefor adopted herewith entitled wPlane and Pro-
files tor the Construction of Storm Water Sewers
for the Oregon ATe:cue and Seale Avenue Drainage
Districts, City of !alo Alto, Santa Clara Count1,

been adopted by the Board of .Public Works at its
meeting held on the 26th d~ of June, l92b, &nd by
this Council on the 29th day of June, 1925, and hereby
referred to as the plane and epeoifications for tnie
work, and the Eame are hereby declared to be so referred
to ae and for a further and more particular del<'r1pt1on
of' said work.
All of the herein proposed work shall be done
in pursuance of 8Jl aot of the Legislature of the
State of California, 4e•1Snated~ "Improvement Aot
of 1911, n approved April 7, 1911, and amendments
thereto.
The Oit7 Clerk is hereby instructed to post
a notioe of said work, together with the plane ezd
epeoif1oat1one therefor, oonspiououely tor five days
on or near the oounc11 ohamber door of said oity,
inviting sealed proposals or oide for doing the work
ordered. Said clerk ie also directed. to pu.~ieh
tw1oe, a notice inviting such propoaals, and referring
to the epeoifioatione posted or on file in the Daily
Palo Alto T1me1, a dail7 nftwspaper published and
circulated in eaid city and hereby designated for that
purpose.

by a responsible ba.nk, tor an a.mount which shall not
be lees than ten per oent of the aggregate of the
proposal, or by a bond for the eaid amount and eo
payable, signed by the bidder and two 81lret1es, who
ehall justify before any officer competent to
administer an oath, in double aaid amonnt, and oveT
and above all statutory exemptions.
Said sealed proposals or bids shall be
delivered to the Clerk of the Couno11 of said City,
on or before 8 o'clock P. M. on the lOtn day of
August, l92b, said time being not lees than ten
de.ye from the time of the first poet1rJ8 and publica-
tion of the notice of eaid work, and inviting sealed
proposals, on which day and hour all propoeale or
bide will be publicly opened by said Council.

resolution was duly and regularly adopted oy the
Council of the City of ~&lo Alto, at an adjourned
regular meeting therPof held on Monday, the 20th
day of July, 1926, by the following vote, to-wit:
