RESOLUTION NO . 3327
A RESOLUTION OF PRELIMINARY DETERMINATION
AND OF INTENTION
TO ACQUIRE OR CONSTRUCT IMPROVEMENTS
EL CAMINO REAL
PROJECT NO. 61-1
RESOLVED, by the Council of the City of Palo Alto, Calif-
ornia, tha t it does hereby p relimin arily determine, that the p ubl-':.I
interest, con venience a nd necessity require, and that it intends
to or der the follow ing wor k to be done, acquisitions and improve-
men ts to he made, to wit:
1. The acqu isition and/or construction of that portion within
the city limits of the City of Palo Alto of the f ollo wi ng improve-
ments:
a) Portland. cemen t con crete curbs a nd gutte rs along the
southwesterly side of El Ca min o Real fro m a poi nt ab out 250
feet northwesterly of Wells Avenue to Stanford Avenue a nd
fr om Sher idan Avenue to Lambert Avenue, and along the north-
easter ly side of El Camino Real from Wells Avenue to Churchill
Av enue, from Acacia Ave nue n orthwesterly 120 feet more or less .
b) Portland cement concr ete sidewalks along the southwester-:
ly side of El Camino Re al from Sherida n Avenu e to Lambert
Avenue.
c) Street lightin g facilities and appurtena nces alon g both
sides of El Camino Real from Wells Avenue to Matader o Creek.
u) The acquisition of all easements, pr oper ty and wo rks
and the con stru ction of all impro vements aux iliary to any of
the above an d necessary to complete same.
2. All of the blocks, streets and alleys herein men tioned are
show n on ma ps of record in the office of the County Recor der of
Santa Clar a County, State of California, an d shall be shown on they
plans her ein r efer red to and to be filed with the City Clerk of
said City.
3. Whenever an y public way is herein referred to as running
betw een two pu blic ways, or fro m or to any public wa y, the inter-
sections of the public ways refer red to a re in cluded to the ex tent
that w ork shall be show n on the plans to be done her ein.
4. All of said wo rk and imp rovement are to be constr uct ed at
the places a nd in the particul ar locations, of the fo rms, sizes,
dimensions a nd mate rials, and at the lines, grades and elev atio ns,
as shown and delineated upon the plane, profiles and specific-
ations to be made therefor, as herei naft er p ro vided.
5. There is to be excepted from the work abo ve desc ribed any of
such work a lready done to line and gr ad e and marked excepted or
shown n ot to be done on said plane, profiles and specifications.
6. Said Council does hereby adopt and establish as the official
grades for said work the grades and el evations to be shown up on
said plan s, profiles and specifications. All such gr ades a nd
eleva tions are to be in feet and decimals the reof with refere nce
to the datum plane of the City of Palo Alto.
7. Notice is her eby given of the fact that in many cases said
work a nd improvement will bring the finished work to a grade
different fr om that for merly ex istin g, and that to said exte nt
'said grades a re hereby changed and tha t said work will be don e to
said changed gra des.
8. The descriptions of the acquisitions and improv ements and
the termini of the w ork contained in this Reso lution are general in
nature. All item s of work do not necessarily extend for the full
length of the de scr iption thereof. The pla ns and pro files of the
work a nd the map and descr iptions of the acquisition s, as contained
in the Engineer's repor t, sha ll be controlling as to the correct
Eand detailed description thereof.
9. Said contemplated acquisitions and im provemen ts, in the
opin;on of this Council are of more than local or ordin ar y public
bene fit, and said Co unc il does hereby ma ke the costs and expenses
thereof chargeable upon an aasessment district, w hich district said
Coun cil declares to be the district benefited by said acquisitions
and im provem ents, and w hich is described as the exter ior bounda ries!

jof the composite and (consolidated area of all parcels of property
fronting on said p rop osed improvements, as shown on the m ap of the
assessment, district id entified as "Assess ment Di agram ", filed in
the office of the City Clerk, to which reference is h ereby made.
10. Said Council further decla res that all public streets,
(highways, lanes and alleys within said assessment district in us e
in the performance of a public functi on as su ch, shall be omitted
from the assessmen t hereafter to be mad e to cove r the costs and
jexpense s of said acquisitions and improvements .
11. Notice is hereby given that serial bo nds to represent
unpaid assessments, and bear interest at the rate of not to exceed
six percent (6%) per annum, will be issued here unde r in the ma nne r
pr ovided in Bon d Plan B, Article 3, Chapter 6, of O rdinance No.1928,
The Palo Alto Improvem ent Pro cedur e Code, adopted by said Cou ncil
on April 11, 1960, the la st in stallment of w hich bonds shall mature
not to exceed nin e (9) years from the second day of July next suc-
ce eding ten months fr om their date.
12. Except as her ein otherwise prov ide d for the issuance of
bon ds a ll of sa id w ork shall be don e as provided in Articles 1 and
4 of Chapter 5 of said Co de , and Section 17 of Article XIII of the
jConstitution of the State of California.
13. Said acquisitions and improvements are hereby referred to
the City Engin eer of said City, as the o fficer having cha rge and
cortrol of the acquisition and construction of public improvemen ts

Ipetent per son employed by said City for that purpose, an d said

(City Engineer is hereby directed to make an d file with the City
!Cler k of said City a r eport :ln writing, pr esenting the follow in g:
(a) Maps and descriptions of the lan ds, ea sements, rights a nd
property to be acquired;
li (b) Plans and specification s of the propo sed impr ov emen ts to

made pu rsuan t to this Resolution;

(c) Engineer's estimate of the tot al costs and expe nses of
ismd acq uisitio ns a nd improvements and of the i ncidental expe nses
.in connection the re with;
(d) Diagram showing the assessment district above referred to,
and also the bou ndaries and dimensions of the respective s ubdiv-
ision s of land within s aid district as the same existed at the
time of the passage of this Resolutio n, each of which subdivisi ons
shall be given a separate number upon said uiagram;
(e) A proposed assessment of the t otal amou nt of the costs anal
ex penses of the pro posed acquisiti ons and improvements up on th e
severa l subdivisio ns of land within said district in proportion to
the estimated benefits ;;o be received by such subdivisions,, res-
pe ctively, fr om said acquisitions and improve ments, and of the
expenses in ciden ta l thereto.
1%i. If any ex cess shall be r ealized from the assessment it
shall be spent for the ma intenance of said acquisitions and im-
prov ements unless the Council shall her eafter determine that said
amoun t, or any part thereof, shall be applied as a credit to each
assessm ent her ein.

held on the 12th day of December, 1960, by the following vote of
