A RESOLUTION OF THE COUNCIL OF THE CITY OF PALO ALTO
GIVING NOTICE OF THE PROPOSED ANNEXATION OF CERTAIN
UNINHABITED AND UNINCORPORATED TERRITORY IN THE COUNTY
OF SANTA CLARA STATE OF CALIFORNIA CONTIGUOUS TO THE
CITY OF PALO ALTO, DESIGNATED AS "FOOTHILLS ANNEXATION
NO. 4" AND GIVING NOTICE OF THE TIME AND PLACE FOR
HEARING OF PROTESTS THERETO
WHEREAS, pursu ant to the "A nnexation of Uninh abited Territ ory
Act of 1939," there has been pr esent ed to the Cou ncil of the City
of Pa lo Alto a petition e xec uted by Nea ry Rock Q ua rry, Inc . by G.
Tea ry, Ge orge Neary, Neary Ente rprises by E. Neary, Ynd_Ethyl Neary
requ esting the annexatio n of that certain p roperty situat ed in the
Cou nty of Santa Clara , State of Calif ornia, and described on
Ex hibit A a ttac hed hereto and made a part h ere of .
W HEREAS, sa id territory is uninhabited, unincorpor ated te rri-
tory con tiguou s to the City of Palo Alto; and
WHEREAS, said petitio n is ex ecuted by the owners of all the
ter ritor y propo sed to be ann ex ed; and
WHEREAS, the County Boundar y Co mmissio n of Santa Clara County,
California , ha s a ppr oved the proposed ann exa tion boundaries of said
property;
NOW, THEREFORE, be it resolve d by the Council of the City of
Palo Alto;
Sectio n 1. That pursuan t to the "Annexation of Uninhabited
Territory Act of 1939" the Cou ncil of the City of Palo Alto here by
giv es notice of said proposed ann exation.
Sectio n 2. Said territory hereby is designated for iden tificatio n
as "Foothills Anne xa tion No. 4".
Section 3. The 23rd day of January, 1961, at the hour of 7:30 p.m.
of said day, in the Co uncil Chambe rs in the City Hall in the City
of Palo Alto, County of Santa Cla ra , State of Califor nia, is her eby
fixe d as the time an d place when and wher e any person own in g re al
pr operty within the uninhabited territory above de scribed and pr oposed
to be an nexed to the City of Palo Alto an d hav ing an y objectio ns to
the proposed an nexation may appear before the Counc il of the City of
Pa lo Alto a nd show cause why suc h unin habited terr itory should no t
be so a nnexed to said City of Palo Alto. Such prote st must be in

w riti ng, may be filed at a ny time bef ore the h our set fo r h earing
objecti ons to the proposed a nnexation, a nd shall state the name or
names of the owner or owners of property affected and the d escription
and area of such pr operty in g eneral terms.
Se ction 4. The City Clerk of the City of Pal o Alto is hereby
authoriz ed a nd directed to cause a copy of this res ol ution to be
published at least twice, b ut not oftener than once a week, in the
Palo Alto Times, a newspaper of general circul ati on publish ed in
said City of Palo Alto, the city to whi ch it is p roposed to annex
the aforesaid ter ritory, said publication to be co mplete at least
twenty days prior to the date set for th e he aring .
And the said City Cler k is further a uth orized and di re cted to
cause written notice of such propo sed annexation to be m ailed to
each perso n to whom land within the ter ritory pr op osed to be anne xed
is assessed in the last equalized county assessme nt roll available on
the date of the above
