RE SOLVED, by the Coun cil of the City of Pal o Alto, California,
WHERE AS, sa id Co uncil is conducting proceedi ngs pu rsu ant to
Resolution No. 3278 of Prelimina ry D eterminati on and of Inte nti on
adopted by this Co uncil on September 26, 1960, for the wide ni ng and
improving of San Antonio Avenue, Project No. 59-4, in said City, and
the acqu isition of additional e ase ments as n ecessary in connecti on
ther ewith;
WH EREA S, said Re solution of Preliminary D ete rmina tion and
of Intentio n and said proce edings were had and ta ke n pu rsuant to Article V
of Or dinan ce No. 1928 of said City, commonly designated the Pa lo Alto
Improv ement P roce dure Code, adopted April 11, 1960;
NOW, TH EREFORE, IT IS FO UN D, DE TE RMIN ED a nd OR DE RED,
as follows:
1. The public interest and n ece ssity requ ire the ac quisition ,
c on struction and co mpletio n, by sa id City, of the public impr ovemen ts
described in said Resolutio n of Pre limina ry Determination and of
Inte ntion and in the proceedings relating thereto , and the e asements and
prope rty propos ed to be acquired describe d ther ein, and here ina fter
describe d in Exhibit "A " hereto a tta ched an d in cor pora te d herein by
re ference are ne cessary therefor.
Z. The p ublic necessity requires s aid acquisiti on and improve-
ments; said proposed acq uisitions and impr ovements are planned and
Located in the mann er whi ch will be most compatible with the gre atest
pu blic goo d and the least priv ate inju ry; and all of s aid acquisitions ar e
Lo cated within the territorial Limits of th e City of Palo Alt o.
3. The City Atto rney and the law firm of Messrs . Kirkbride,
Wilson, Harz feld $ Wallace, ernployed for that p urpose, ar e hereby
directed to in otitu te and co nduct to conclusion an acti on in emine nt d om ain
fo r the acqu isition of sa id e asements, and to take s uch acti on as is
ne cessary the rein.
4. The City Man ager is hereby au thorized and dir ected, as an
alternative to tria l of any a ctio n in eminen t domain initiated hereu nd er,
to e xpe nd fr om the procee ds of a sse ssme nts a nd sale of assessment bonds
to be issu ed in said procee din gs, suc h mo neys as are n ecessar y and in
his opin ion ma y con stitute the fa ir market v alu e of said pa rcels, based
upo n a ppra isa ls of duly qua lified and compe tent re al esta te appraise rs.
5. Tha t an o rder of immediate possession be obtained in said
a ction, an d that a warran t or warrants be issued to the Cou nty Clerk of
Sa nta Clara Coun ty in the amoun t or amo un ts determined by the Court to
be deposited as a conditio n to the right of immedia te po sse ssion, as
follo ws: Tha t the amou nt requ ired to he deposited for the possessio n of
the pa rcels be dra wn fro m the appropriate con struction funds of said City
and if there ar e n ot sufficie nt moneys the rein , that the amount necessary
therefo r be transferred thereto as a Lo an fro m the genera l oper atio n fu nd
of the City.
6. Th at said lands and e asements bo sought to be taken are
ea sements f or th e const ru cti on, reconstr uction and m ai ntenance of
streets and street imp rov em ents including that n ot limited to sidewalks,
dra inage facilities, water mains, street lighting fa cilities, sanit ary
sewer s a nd other utilities on the property more p artic ularly d esc rib ed
in ExLibit "A" hereto attached and by reference made a p art hereof .
7. Re fe re nce is hereby m ade to said Resolution of Int entio n and
relate d pro cee dings for a pa rticular descripti on of the said proposed
acqu isitions and improvements, on file in the office of the City Cle rk of
sa id City.
