RESOLUTION NO. 3303
A RESOLUTION DETER MINING THAT THE PUBLIC INTEREST
AND NECESSITY REQUIRE THE ACQUISITIONS OF EASE-
MENTS FOR SANITARY SEWERS AND WA TER FACILITIES
FOOTHILLS ANNEXATION NO . 1-A
SANITARY TRUNK SEWERS AND WATER SUPPLY SYSTEM
PROJECT NO. 59-1
RESOLVED, by the Council of the City of Palo Alto, Califor-
nia, that
WHEREAS, said Council is conducting proceedings p urs uant to
Resolution No. 3231 of Preliminary Determin ation and c: Intention
adopted by this Co uncil on July 27, 1960, for the imp rovi ng of
Foothills Anne xation No. 1-A, Project No . 59-1, by co nstructing
sanitary sewer and water systems therefor, and the acq uisitio n of
easeme nts is n ecessary in connection therewith;
WHEREAS, sald Resolutio n of Preliminary Deter mi natio n and
of Intentio n and. said proceedings were had and taken pursua nt to
Article V of Ordin an ce No. 1928 of sa id City, commonly d esig nated
the Palo Alto Improvement Procedure Code, adopted April 11, 1960;
NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as
fo llow s:
1. The pu blic interest and necessity require the acqui-
sitio n, con str uction and completion, by said C.Lty, of the public
improvements described in said Resolution of Preliminary Dete r-
mination and of Inten tio n any in the pro ceedings relating thereto,
and the easem ents and property proposed to be acquir ed described
therein, and here in after described in Exhibit " A" nereto attached
an d in corpor ated her ein by reference ar e necessary the refor.
2. The public necessity requ ires said acqu isitions and
improveme nts; said proposed acquisitio ns an d impr ovements are
planned and located in the m an ner which will be most co mpatible
with the gr eatest public good and the le ast private inju ry; and
all of said a cqu isitions are either lo ca ted within or located so
as to provide service to prope rties within the territorial limits
the City of Palo Alto.

3. The City: Attorney a nd the law firm of Messrs. Ki rkbride,
employed .tor th at purpose, are hereby
dir ected to :institute and c onduct to conelusi.n an action in
em inent domain for the acquisition of said easeme nts, a nd to take
such action as is necessary the rein.

an alternative to trial of any action in e minent domai n initiated
eroun der, to ex pend from the proceeds of assessments and sale of
,assessme nt bonds to be issued In s aid pr oceedings, s uch moneys as
'are necessary and In his opin ion may constitute the fair m arket
value of said parcels, based upon appraisals of duly qu alified
a nd competent r eal esta te appraiser s.
5. Reference is hereby made to said Res olution of I ntention
an d rela te d pr oceedings for a particular description of the said
(proposed acquisition s and impr ov emen ts, on file In the office of
the City Cler k of said City.
