HomeMy WebLinkAbout1980-10-30 City Council Summary MinutesCITY COUNCIL MINUTES CITY OE PILO ALTO SPECIAL MEETING Thursday, October 30, 1980, 7:30 p.m. The City Council of the City of Palo Alto met on this date at 7:40 p.m., in the Council Chambers, 250 Hamilton Avenue, Mayor Henderson presiding, in a Special Meeting to consider revisions to the Comprehensive Plan. PRESENT: Brenner (left at 10:00 p.m.), Fazzino, Fletcher, Henderson, Levy, Renzel, Sher (arrived 9:05 p.m.), Witherspoon ABSENT: Eyerly Mayor Henderson announced that two Special Meetings had been set for purposes of interviewing appliLants for the Human Relations Commission vacancies. Tne interviews would be a 7:15 p.m. on November 10 and November 17, 1980. PLANNING COMMISSION RECOMMENDS RE RE:lJ5IU Mayor Henderson said they had a memo from Councilmember Eyerly which contained some recommendations Mr. Eyerly would like the Council to consider and Mayor Henderson said he would refer to Councilmember Eyerly's repo when they reached the appropriate sections, Page 318 Councilmember Levy said he had some concerns about the wording in the second paragraph under "Schools," and said he would like to see a new sentence added to read, "With declining enrollment, it is likely there will be further closures in 1980." He said he would also like to remove the word "national" in the last sentence and add "and aging population" to the end of the sentence, so that the sentence would read: ".he decline results from treads toward smaller families, relatively little new residential development in the district, aging population, and very .high priced housing whichencourages'. households with two wage earners and fewer children." The Council agreed to incorporate these changes. Pave 310 Mayor Henderson noted Counc i 1.nber Eyerly's request to add the word "affordable" underPrograa= 2 so the sentence would read: "Evaluate school sites for affordable housing...." Councilmember Levy suggested just adding "and market rate housing" at the end of the Program 2 statement. Mayor Henderson said he mu1d prefer a program which spoke to priorities related to Policy 2. MOTION: Councilor Levy moved, seconded by Withersp on, to add "and market rate housing" at the end of the Program 2 stetenent. 3 78. 10/30/80 Councilmember Fazzino said he was concerned the wording would be inter- preted to mean low income housing and that was not the case. He would prefer to leave the wording as it is. MOTION FOILED: The ration failed on the following vote: AYES: Levy, Witherspoon NOES: Brenner, Fazzino, Fletcher, Henderson. ABSENT: Eyerly, Sher Councilmember Fazzino said he wanted to add wording after the second sentence in the last paragraph which spoke to school sites for future community use. Councilmember Levy asked if the policy was the City won't buy but will lease school sites. Councilmember Fazzino said the first sentence of the paragraph says "sold or leased." Councilmember Renzel said she recalled earlier language in an old program which related to school sites. Mr. Schreiber replied that wording was on page 33, after page 32H, in the 1976 plan. Councilmember Renzel suggested a program regarding public ownership. Planning Commissioner Cullen suggested they take Policy 1 on page 31C and modify the last part to read, "preserved for community ownership or use. 11 The Council agreed to incorporate the wording as suggested by Planning Commissioner Cullen. Pay a 3l E Councilmember Levy said he did not understand the sentence in the first paragraph which reads, "More pressure is placed on City facilities such as the libraries, community centers, Cultural Center, Children's Theater, Community Theater and Junior Museum." He felt the pressure on City facilities was related to the number of individuals using those facilities rather than the number of school buildings that are open. This assess that the remaining schools are also reducing their programs. Mayor Henderson said he understood it to mean pressures resulting from closing of schools and the reduction of schoel Services. Councilor Levy said in the next paragraph he would like to see some language such as, "The City has made some decisions toward acquiring at least some of the land at CubberlEy, Ter man, Ventura, Ortega and Garland for open space or community facilities. A determination should be ado for_.m_h closed school site regarding the City's needs for acquisition.°' Mayor Henderson said he was not aware of decisions on Cubberiey. Courc i lr Renzel said she felt these sites had a l ready been wed in the sentence in the middle of the paragraph. Counc i laoember Levy said he would pass on his comments. !MILE Councilmember Levy referred to the top paragraph on the page and the sentences ding, 9n fact, sale of some of the land for housing may be the economic key, providing funds to preserve open space and recreational activities on the remainderof to land. Such trade-offs should be ex- plored at each site considered for re -use." He knew this to be the Mike Cobb proposal. It implies that the City will buy and resale school district land. 379 10/30/80 If that is, in fact, what it implies, he felt that 1 -es a very far-reaching proposal which he would not like to see in the Plan without extensive Council discussion first. Mr. Schreiber said he didn't believe that that was the intent. No specific reference was made to Mr. Cobb's suggested process for doing that. Councilmember Levy asked if when they say, "sale of some of the land for housing," is the City the subject there? Who le going to sale the land? Planning Commissioner McCown -Navies said she felt the intent was more to describe the economic tradeoff. Funds generated from sale for housing might be the source of funds used to preserve other areas for open space and recreational uses. There was no intent to indicate how that process would take place. Councilmember Levy said the only way he could see that tradeoff taking Place world be if the City, in fact, gets funds from the sale. Therefore, in some way, the City would have to take over ownership, receive the funds and protect other sites for open space. MOTION: Councilmember Levy moved, seconded by Brenner, to delete the last two sentences, commencing with "In fact, sale of some of the land..." in the paragraph at the top of page 3IF. Councilmember Brenner said by deleting the sentences they weren't saying that it wouldn't be an approach, but she agreed that it shouldn't be in the Plan without adequate Council discussion. Councilmember Fazzino said he understood Councilmember Levy's concerns, and he suggested that the wording be °some tradeoffs need to be explored in order to provide funds for open space and recreational activities." Councilmember Renzel suggested that the wording be modified to say, "Tradeoffs between public and private cvmership should be explored at each site considered for re -use." MOTION REWORDED: Councilmember Levy ;roved, seconded by Brenner, that the language in the first paragraph be modified to say, "To accomplish this, tradeoffs between public and private ownership should be explored at each site considered for re -use." MOTION PASSED: The motior passed on a unanimous vote, Councilmember Sher and Eyerly absent. The Council also agreed to delete the two sentences in the middle of: the paragraph which begin "In fact, sale of some of the land for housing..." Page 316 Councilmember Renzel requested that in the last paragraph, first sentence, that the word "total" be plural, page 31N, Mayor Henderson referred to the top paragraph and the sentence which speaks to the acquired l6 acres adjacent to Greer Park and said he would like to add the words, "The project will te done in 1'80 and will be completed in compliance with the approved master plan." Council mber Witherspoon they also had some plans to do other parks such as Eleanor 'ark, etc. Mayor Henderson they have already spoken of the purchase in order to expand the park and this is sometiing which has been approved by the Council- and he felt they needed to add one sentence which says -.hat is p h 1ng. 380 10/30/80 Planning Commissioner Wheeler said she had the same'problem when this was discussed by the Commission. The page they are on now is history. Perhaps the place to put such wording as suggested by Mayor Henderson is en page 31J, under Program 5, first paragraph. Mayor Henderson said he would come back to his concerns later. Councilrnember Renzel said that her impression was that Byxbee Park also includes the golf course and possibly the airport and the refuse disposal area and a large number of other things. A few things are specifically mentioned but she thought that all parts of Byxbee Park that are, in fact, dedicated ought to be listed here. Council agreed that staff would add appropriate wording regarding listing all parts of Byxbee Park which are dedicated. tam 311 Mayer Henderson referred to the paragraph in the middle of the page where it says, "The 1969 Parks and Recreation Study pointed out neighborhood park deficiences in the Downtown area," and in place of the words which complete the paragraph he would like it to read, "To help correct these deficiencies, the City developed the Scott Street Mini Park south of University Avenue. The City purchased the downtown park north site to serve the Brea north of University." Under Program 4, he would like to first sentence to read, "The City purchased the downtown park north site to serve the area north of university Avenue between Alma and Middlefield." Then, he suggested that the last sentence of the last paragraph read, The City will renova the 11 houses on the property by 1985..." Councilm nber Levy asked if they could remove even more. Is it necessary to go into the fact that they developed the park in the mid-19O's and the entire block was dedicated in 1980? Councilmember Brenner clarified that he wanted to drop the sentence that the park plan was dedicated in 1980? She said she thought that was the intent. MOTION: Mayor Henderson moved, seconded by Fazzino, to delete the first sentnence in the paragraph under Program 4 and replace it with, "The City purchased the Downtown Park North site to serve the area north of University Avenue between Alva and Middlefield" and to ado "on property" in the last sentence in that paragraph. MOTION PASSED: The motion passed on a unanimous vote, Councilmembers Sher and Eyerly absent. MOTION: Councilme rer Levy moved to remove two sentences in the last paragraph under Program 4 beginning, "The City developed part..." and 'The entire block was dedicated..." The +motion, died for lack of a second. Council agreed to clarify the reference to dedication of Timothy Hopkins Park. Page 31d Mayor Hende:son eaid he felt. ghat Program 6 has been misleading. Bol Peek, combined with Gunn High School, is equivalent in arta to a district Park.. Much of the nearby Tetmafl site is going to be retained as City facilities, and he thought it was deceiving to think that -they are going to develop a 20 plus acre district perk. Councilmember Fazeino said that in looking at -the paragraph, it agrees with Mayor Henderson. He thought the paragraph was pretty straight forward. 381 10/3O/80 Mayor Henderson wondered why they needed to speak to that at all. Councilmember Fazzino suggesteJ taking out the word "district" and say, "as appropriate, acquire and develop on one or more sites park facilities west of Alma." MOTION: Mayor Fenderson moved to clarify wording in Program 6. The motion died for lack of a second. MOTION: Councilmember Levy moved, seconded by Witherspoon, to add "by Palo Alto" after the word "retention," in the next to the last paragraph so the sentence reads, "The park is an attractive open space area, bit it may become necessary to evaluate its retention by Pass► Alto in light of the need..." MOTION PASSED: The motion passed on a unanimous vote, Councilmembers Sher and Eyerly absent. Page 31K Councilmember Levy referred to Policy 5 and the reference to vandalism. As he recalled in the report which was done on parks, there was a figure for vandalism in Palo Alto parks last year at something like $9,000 in cost. If that's correct, it seemed to him it was low enough and there is no need to take further action and he would suggest taking out the phrase, "less prone to vandalism." Kayor Henderson said they went through that one night at great length and felt it was a good statement to leave in the Plan. There is in- creasing vandalism everywhere. He wanted to add a program on the next page that does something about it, Councilmember Fazzino suggested adding "and other pxobtems" at the end of Policy 5. Carleen Bedwell, Director of Social and Community Services, provided a comparison of polio: -reported offenses in parks. Vandalism in 1977 was 2.9% of the total, 8/10ths of a percent in 1978 and in 1979 it was 1.5% of the total reported crimes. In terms of criminal activity, van4alism was relatively minor, but other criminal activity in the parks uas Increasing. Commissioner Cullen pointed out that the section refers to both schools and parks and vandalism at school site: has been rising. Mayor Henderson clarified that while the whole section was schools and parks, they were now dealing with programs specifically directed at parks. -MOTION: Councilmember Levy moved, seconded by Fazzino, that Policy 5 read: 1 akt:,parks safer." MOTION FAILS! The motion failed on the following vote: AYES: Fazzino, Levy, Witherspool FOES: Brenner, Fletcher, Henderson, Renzel ABSENT: Eyerly, Sher Council agreed to add the words "a►hd other - problem" 3t the end of the Policy 5 statement. Page 311 NOTION: Mayor Henderson moved, seconded by Witherspoon, to add a new Program l2 to state: "Cstanlish special regulations in individual parks as needed and provide adequate police surveillance." Councilmember Renzel said she was concerned about boxing in use of parks in response to the squeaky wheels in the neighborhood, and limiting too strongly the kinds of uses in parks. Mayor Henderson said they did move in that direction by eliminating alcoholic beverages in Cogswell Park and made a statement of approving staff's ability to come in and set other regulations. Councilmember Renzel said that after the meeting on Monday night she received a phone call from a neighbor of the Downtown North Park and said the presence of the vallybali playing mowed all the people who were drinking out of the park. MOTION PASSED: The motion passed unanimously, with Councilmember Renzel abstaining, and Council bers Eyerly, Sher absent. Mayor Henderson read Councilmember Eyerly's proposal for page 311 that there should be a sentence on Council's park inventory with the policy of use to be left to the wisdom of staff. He said he wasn't sure of the intent of the proposal. Councilmember Penzel maid she was concerned about the definition of "maximum visibility" under Program 9. Does it mean they are going to floodlight all the parks? Does it mean they are going to chop down all the landscaping? She suggested changing the word "maximum" to "adequate.' Council agreed to accept the word change. Councilmember Renzel said she felt thr word;ng in the first paragraph under Program it was a little awk.ard. Sbe suggested that the wording be re?r► inged to read, "Most Palo Alt -7_,5s fah safe in their parks, according to a 1974 survey." The Coun i l agreed to accept the r rd flit: URBAN DESIGN Councilmember Fazzino said he would like to sea the object'..ee contain a very strong statement concerning commitment to tree planting as a part of the Urban Design program. MOTION: Councilmember Fazzino moved, second by Witherspoon, the last objective -read: "itilitize tree planting on public and prIvate property to enhance the creal i ty of the urban env 1 rorment . " Commissioner Cullen said she agreed with the objective but felt that,. planting might be too restrictive, and they might want to broaden it to include maintenance of the tree stock and the remell of that stock. POTION RESTATED: Councilmember Fazzino moved, seconded by Witherspoon, that the last objective read: "Encourage maintenance of tree stock and renewal of present stack." !MOTIOI! PASSED: The motion passed on an unanimous vote, Council,nembers Eeerly and Sher ab ent. Mayor Henderson said Mr. Eyerly had a proposed change on this page --last paragraph, first sentence, in thy: right column. The suggested word eg is: "Parking lots ap parkin structures can be a pervasive._ threat to existing scale throughout the City." Councilmember Witherspoon asked what is meant by "scale?" They are talking about visible t =steeess of parking lots which she agreed with but she seeded some c1ari 1. 3$3 1.040/90 Y Mr. Schreiber replied that "existing sca ° refers to the pattern of buildings and vegetation. If buildings are torn down and parking lots put in, the parking lots disrupt the scale in the sense of continuity of appearance. Councilmember Witherspoon said in the case of a line of identical buildings, the break might be ran advantageous one and on the other hand a huge parking garage might not be. She wasn't sure the sentence added anything to the Plan. Councilmember Reuel said she had trouble understanding the paragraph also and Mr. Schreiber's interpretation had completely alluded her. What she had understood Vrom it was than the need for parking lots and parking structures is the threat because that is what will cause the changes. Perhaps it should read, "The need for parking lots and parking structures is -the most pervasive threat to the existing scale..." Mayor Henderson felt they just couldn't say the "need" because the actual parking structures are the threat. Councilmember Witherspoon said she felt the paragraph ahead of it already says it and this paragraph is repetitive. Councilmember Brenner suggested inserting the word "pedestrian" so the sentence reads, "...existing pedestrian scale..." She felt this would be appropriate if what they are trying to do is make the downtown area a pleasant place to walk from one place to another. MOTION: Councilmember Brenner moved, seconded by F'ietcher, to insert the word "pedestrian." Correction 1 /19/81-Chng word "alluded to "eluded" MOTION PASSED: The ration passed on a unanimous vote, Counc i lmembers Eyerly and Sher absent. Councilmember levy referred back to Councilmember Eyerly's proposed wording. He felt that "probably are the most" is an awkward phrase. He felt that Me Eyerly's proposal to take out those words and substitute "can be a'. was a good idea. MOTION: Councilmember Levy moved, seconded by Witherspoon that the words "can be a" be substituted in the first sentence of the paragraph. They endorsed the programbut their concern WS the use of historic building codes rather B d 10/30/110 than the procedure that the Council approved some months ago which was to allow the Chief Building Inspector flexibility under the 1979 Uniform Building Code. As a result of the Historic Resources Board meeting on Tuesday night, he understood they would be coming back with some suggestions regarding certain uses of the historic building code within the next couple of week. He felt it would be consistent with what they have before these now. If there is a change later on, they can come back and clean it up at that time. Mayor Henderson asked if that ;idn't follow under "allow flexibility?" He didn't think they needed to worry about Program 9. Mr. Schreiber said he felt any changes could take place as a matter of course. Page 35C Councilmember Fazzino referred to Program 11 and asked that it be changed to read: "Maintain and strengthen the City's design review procedure..." The Council agreed to add the word "strengthen" to the statement. Councilmember ber Fazzino said it the first paragraph: under Program 11, he would like to add_e line at the end of the paragraph. MOTION: Counci lme nbee Fazzi;;c moved, seconded by Witherspoon, to add the line: "the City should, after some time, consider= the success of this voluntary program to preserve Palo Alto's valuable historic resources and determine whether other programs might be necessary." Councilmember Yazzino said he wanted to emphasize their commitment to historic preservation. 1hey have a voluntary program which is working well and he felt that after some time they will want to evaluate it to determine that it continues to work well. Councilmember Witherspoon said if they don't name what is 3oing to `e one, it will never be done. Mayor Henderson said this was just policy that they wee ;:ire to dc it. Councilmember Brenner_ eeid she had a problem with the notion. She fe't it was redundant and unnecessary. e. Commissioner Cullen said, speaking as a resident of Profeeservil;e, she felt it would be unusual to insert this at this point withoot'44 notice to residents of the area. The motion passed on a unanimous vote, Councilmember Eyerly absent. ttat3D Mayor Henderson said that Councilmember Eyerly ha requested that the last paragraph in the righthand column, except for the last sentence which appears on page 35E, be deleted. Councilmember Witherspoon, said she felt that Councilmember er Eyerly's objection was that he didn't like banks and offices being singled out as "bad guys." Council has also had communication from other merchants in the area expressing their concerns about how they are going to keep the pedestrian scale visually alive in Downtown. She would like to give this as an assignment to the Architectural Review Board for some creative thinking without just banning offices or banks. Mayor Henderson said he was comfortable with the paragraph. He asked for a motion to rive the paragraph, except for the last sentence. No motion was made. Councilmember Fazzino said he would like to add language to the text prior to_ this last paragraph in the righthand column to state: "Palo A/to has taken many steps to assist with the increase in senior housing in the downtown area. The City should encourage retail developments such as grocery stores which meet the needs of these people." Councilmember Fletcher said she felt it was wishful thinking to say "encourage" unless the, take specific action. She suggested an alternative would be to limit new uses in tee downtown area to retail and residential. She read some excerpts from the letter presented to Council tonight from Don Surath, a copy of which is on file in the City Clerk's office. Basically, the letter expresses the concern felt by downtown retailers about encroach- ment of the area by office buildings and financial institutions. She pointed out that M.eelo:Per .:las seen a -►eduction ;in sales tax and or - some time now has considered banning nenrete41 uses on Santa Cruz. The same situation is true in Los Altos. Nonretafl uses are not conducive to a healthy shoppieg atmosphere. She urged the Council to adopt a policy to limit new uses in the downtrm area to r tail and residential only. Mayor Henderson asked if Councilmember Fa&einowould like to put a motion on the floor,. MOTION: Councilmerber Fazzino moved, seconded by Henderson, to add the language: "Palo Alto has taken many steps to assist with the increase in senior housing in the downtown area. The City should encourage retail development such as grocery stores which meet the needs of these people." Councilmember Renzel s#id they now had anoth r next with the word "should" in it: She would rather they say that the loss of grocery stores is a problem for seniors in the dow:Itcwn area and then later on suggest a program or a policy if they like. Perhaps It fits under Land Use. He asked that staff give some thought to where these items might fall and they will come back to this discussion later. No action was taken on the motion on the floor. Councilmember Fletcher referred to the paragraph in the middle of the lefthand column and the sentence, "older retail areas lose their vitality Quickly when a number of sites become vacant or are occupied by vacant buildings, parking lots, stretches of blank walls and drive-in businesses." Her proposal was to prevent new drive-in businesses. It is not only a design problem, but a health and traffic prhlem. Mayor Henderson suggested they not take action on it now and let tte staff find a place in the Plan for this proposal. Commissioner Cullen said she felt some of the concerns being talked about relate to a social element, which was considered and rejected in the last Plan. Councilmember Renzel referred to the second to last paragraph in the right- hand column and said she would like to delete the sentence, "These proposals are encouraged in the Housing and Employment sections of the Plan and were first submitted for City approval in 1979." She felt it was superfluous language. The Council agreed to delete the sentence. Councilmember Fazzino said every time he drives down El Camino he gets more upset and thought they could do more things to beautify it. MOTION: Councilmember Fazzino moved to add the following lengage to the second paragraph in the righthanl column: "The City should consider retroactive requirements for landowners which could bring abet a more beautiful roadway without imposing a major economic burden on store owners." Councilmember Fazzino said he was simply asking the City to explore other prug rams . The motion died for tack of a second. Councilmember Witherspoon said s.'te had some concerns for a property owner whose property,Was along where they are proposing the non -access strip How'... :old that person be able to utilize his land?' 387 10/30/80 Councilmember Renzel said this was just a policy statement and it would have to be implemented through the Zoning Ordinance; they are other steps which .geed to be taken. This is just establishing the framework under which a change in the Zoning Ordinance might be made. Councilmerber Levy said he felt this was a rather specific suggestion and he would be uncomfortable with it until they have given notice to the property owners and given them an opportunity to speak to it. Councilmerrber Brenner said she recalled the earlier policy statement about this subject to which Councilmamber Renzel referred. It was considered at length in the earlier discussion and one of the major issues was traffic being blocked on El Camino. It is a fairly dear case of the change in atmosphere between strip commercial and neighborhood/commercial. She said she supported the motion. That additional parking has never been approved nor come before the City. As she has seen it proposed by Stanford it is land that is part of the Arboretum. Page 35F Councilmember Fletcher referred to the paragraph beginning with "Scenic routes are selected..." and questioned if a road had to be wide in order to be aesthetically pleasing. Further down in the text it.stateS, 'Santa Clara County has also proposed Page Mill Road between Foothill Expressway and Skyline Boulevard as a scenic highway" and said that road certainly isn't wide. MOTION; Councilmember Fletcher moved, seconded by Renzel, to delete the words "wide enough to be" in the first sentence of the paragraph. The motion passed unanimously, Councilmember Eyerly absent. Councilmember Renee] said she was under the impression that they had already adopted Arastradero Road between Page Mill and the western City limits as a scenic highway, or a scenic route. Does this language suggest that other jurisdictions are also considering similar designations? Mr. Schreiber said she was correct and Arastradero Road runs through a number of jurisdictions and part of it in an unincorporated area. The City has identified it as a scenic route in the Plan and for parts of it there is a 200 foot setback. Councilmember Renzel suggested that the last sentence in the second paragraph under "Designated Scenic Routes," be the first sentence in the paragraph. The Council agreed to reierse the order of the sentences. Councilmember Witherspoon said on Page 42 the policy was to add Willow Road, University Avenue, Embarcadero, etc. She thought they probably ehould be listed in his section as wail. What does it take to add them? Did anyone ever make a motion to take Program 23 out? Mr. Schreiber said he thought the last page had been left out. Council - member Witherspoon is correct that the material that ends on page 35F is then followed an page 42 by a heading "Scenic Highways Policies and Prog rams . " Councilor Witherspoon asked if the present proposal was that those should be deleted or continued. Mr. Schreiber relied that should be contained in the Plan. Councilmember Witherspoon said it is true that '.they haven't taken any action in three years since this was originally Proposed.. What does it take to get this expidited? If a policy is a program, what do they do now? Mr. Schreiber said he believed there would be some type of resolution procedure, but he would have to chock en that. Councilmember Witherspoon said then all they have to do at this point is to alert the City Manager that they will look for it on the next Council agenda. Mayor Henderson noted that pages 42 and 43 are part of the Urban Design Program ih the Plan and staff will make the correction. Councilor Witherspoon asked if they didn't also have to add the Arastradero Bike and horsdtra!ils which they just proposed. She thought she was talking about deligrrated traits on page 42. Mr. Schreiber said that trails and paths are in the Transportation section. 38 g 10/30/80 Councilmenber Fletcher referred to page 43 and asked whether "Harbor Road" was such a road; she had never heard of it. Couicilmernber Witherspoon said she had discussed the issue of riding and hiking trails with staff at the break and she agreed that it belonged in the Transportation element. Her suggestion would be that staff draft some general wording on a policy which states that it is their intention to develop a system of riding and hiking trams to add to the bike trail system in the City. She understood that it had not been previously included in the Plan because of litigation in the foothills. .MOTION: Councilmember Witherspoon moved, seconded by Henderson, to direct staff to develop language to include hiking and riding trails. Mr. Schreiber said that before they leave this section, he wanted to address the comments made by Councilmember Fletcher about restricting offices in the downtown area. Counclbenber Fletcher said she would like to add a new program on page 350 with speaks to the issue of drive -up windows, Program 17A. Three years ago the Council reelected a flat rate stricture for very sound reasons. They can't avoid the issues of cost of service and cost of the systems involved. It would lock them into a flay rate where they set the policy of separate metering for swimming pools and hot tubs, which may only be gas, but it could be electricity. The purpose of that would be to then charge higher rates for that type of use. Mayor Henderson advised that this only applied to commercial and industrial. MOTION: Coencilmember Levy moved, seconded by Witherspoon, to delete the first sentence in the paragraph. Councilmember Fazzino said he could support this if it were just a semantic change, but he strongly supports the concept of avoiding economic and personal hardship. If that were deleted, he wanted to add a line to the end of the next sentence which said as long as requirements don't repre- sent an economic burden to the new owner. He had no problems with the incentives in voluntary programs. Councilmember Levy said he thought the sentence said that where those programs fail, they are then going to talk about stronger measures. He would like to stay with voluntary incentive programs at this point and eliminate the vague threat. Mr. Schreiber said the tension that exists is the tension between voluntary programs and mandatory measures. He understood that the utilities department is working on a rimer of things which go beyond voluntary encouragement in the conservation program. They are looking at possible mandatory measures such as required solar in new developments. The Commission's intent is to say that where the City goes beyond voluntary programs, it should only be undertaken where it's feasible and not cause economic nor personal hardship. It's a rail issue which the Council will be facia in the next year. Councilmember Levy said he didn't understand the whole series of connections. Counc i 1 rRenzel said this loos like it is text and not policy but in a place where there is policy language. Mayor Henderson said it is under Policy E. Councilmember Renzel said the language "where It mild not be feasible" is superfluous. Where they are not feasible, they aren't going to happen. slot Mayor Sher said the text before the bled paragraph is added relies on voluntary programs and incentives and the new paragraph suggests that they may not work. There may be a need for mandatory requirements. The "except° clause states, however, that there wouldn't b►9 mandatory requirements if it as ren't feasible. The state requirement is a proposed requ f recent that these things be done before a house is sold. Mayor Henderson suggested .hat the sentence begin, "An example is the proposed state requirement..." in place of "City staff is seriously considering a state requirement..." The Council agreed to change the wording. Mayor Henderson said Counci 1mee r Eyerly had a proposed change to the boxed paragraph on the left bottom of the page. He asked that it be reworded to recognize that they now have a solar utility. Mayor Henderson said they have a solar program and he questioned the use of the word "utility." Councilmeiber Witherspoon said they do have a such more aggressive solar program than they did when they wrote the Plan in 1976 and she felt Mr. Eyerly wanted to acknowledge that fact. Mayor Henderson said it was too strong a statement to say that the City should operate a solar utility program, but he ugreed some emphasis should be given to the program. Vice Mayor Sher said a lot depended on the definition of solar utility. Solar utility means that the City is actually generating electricity through the solar method and that's not the case. Mr. Zaner said they have applied for a grant, along with a group of other cities, and the project itself is designed to investigate and promote solar utilities. That phrase is being used by the group of cities engaged in the process. Counscils er Witherspoon suggested putting the wards in the present tense: "The City should continue to encourage... " They are farther along with the programm than the paragraph says. Mayor Henderson suggested that the staff include wording in the paragraph which notes the City's solar program, and that the first sentence of the paragraph read: "The City should continue to overcome other problems with solar energy by operating a municipal solar program..." The Council agreed to Mayor Hendeerson's suggestion. Councilmember Renzel referred to Program 28? "Recover precious metals from sedge slab" and said wen though the city is doing that, she didn't feel it rises to the Comprehensive Plan category. At some point the sewage slugde won't have as much precious metal. MOTION: Councilmember Reuel moved to reword Program 28 to say, "Allow precious metals to be recovered from sewage sludge." The motion died for lack of a second. Councilmember Levy referred to Program 27 and the second sentence which states, "Support, where economically justified, efforts to have recycled materials treated in similar fashion as raw materials," and said that didn't read right to him. They have a program here to petition the state and federal government to change their laws. Is it appropriate in this Plan to have a program that asks state and federal entities to change their laws. He would like to eliminate Program 27. It is a worthy goal, but he didn't think it was appropriate for tde Plan. MOTION: Councilmember Levy moved to eliminate Program 27. Page 59A Councilmember Renzel wondered why Byxbee Park has been changed to 1700 acres. Mayor Henderson suggested they leave that to staff to correct if necessary. The Council agreed that staff would respond to the question about specific programs for making substations earthquake proof. Councilmember Fletcher said she would like to address the matter of retail versus other uses in downtown. Mr. Schreiber tells them it bettrngs in the Employment Section Perhaps they could just speak about it generally and if action is taken, find a place to insert it. During the break, she spoke with two persons from the downtown area and was informed about reta i l businesses which are going out of business and being bought out. The Russell -Huston clothing store which has been in the downtown area for 30-40 years is being bought out, from what she heard, by Imperial Savings, The Brass Bed store is being bought out by Union Bank. She felt they were at a crucial time of making a decisfs'n of whether they want to continue to have a viable downtown because she thought it was rapidly slipping away from them. In order to encourage retail in the downtown area, they are going to have to have a program to institute new regulations which state that new uses will be limited to residential and retail. Councilmember Renzel suggested a program which would say that through the zoning ordinance consider says to limit the proliferation of nonretai1/ commercial uses in the do ton area. Mayor lenders meted that they work on sane wording : for the Plan and then have the specific item on the agenda at a future date.
