A RESOLUTION DETERMINING LIST OF UNPAID ASSESSMENTS
AND PROVIDING FOR ISSUANCE OF BONDS

RESOLVED, by the Cou ncil of the City of Palo Alto, Califo rnia, that
WHEREAS, said Council did on December 14, 1959 ado - *It its Res olution
of Intention No. 3176 relating to certain work to be do ne and improvements
and acquisitions to be ma de !.n said City under and pu rsuant to the pro vis-
ions of Ar ticle V of Ordinan ce No . 844 of said City, adopted Ja nuary 13,
1941, entitled "Pa lo Alto Impro ve ment Pr ocedure Code", as ame nded, and
did ther ein provide that serial bonds wou ld be issued the re under pursu ant
to the pro visions of Bond Plan C of Part 4 of Ar ticle iv of s aid C ode,
r eference to sa id Resolu tio n of In tention being hereby expressly made
for further par ticu lars;
WHEREAS, on July 5, 1960, the Superinten dent of Stree ts of said City
filed with the Clerk of said City a complete list of all assessments u n-
paid ther eunde r upon the re spective assessment a nd diagram nu mber s there-
on , whereupon said Clerk gave n otice of the filing of said list and fixe d
in said notioe Monda y, the 25th day of Ju ly, 1960, at the hou r of 7:30
o'clock P. M. as the time whe n interested person s might appear before the
Council at the r egular meeting place of said Cou ncil, City Hall, Palo
Alto, Califor nia, and show cause why bonds sho uld not be issued upon the
secu rity of the unpaid assessmen ts shown on said list, all of which appea rs
fr om the affidavits on file in the office of sa id Clerk;
WHEREAS, no protests or objections aga inst the issu an ce of said
bon ds wer e pre sented befo re or at the time fixed for sa id hea ring;
NOW, THEREFORE, IT IS HEREBY RE SOLVED, FOUND and ITERMINED, as
follows:
1. That said list of assessments u npaid filed by said Su per intendent
of Streets as aforesaid was at the time of filing thereo f in all respects
complete and corr ect, and that since the time of filin g the reof no
assessments have been paid and a lso that the un paid assessments in the

proceedings duly had and taken unde r and purs uant to s aid Resoluti on of
Intention , are as show n on E xhibit "A" he reto attached a nd by refe rence
made a part hereof.
2. That for a particula r desc ription of the l ots bearing the re-
spective assessment numbers hereinafter set forth and upon which assess-
me nts remain unpaid as a bove stated, se ver ally and respectively, ref erence
is her eby made to said asse ssment and to the diag ram rec orded in the
office of the said Su per in ten dent of St reets after confirmation by said
Coun cil, the sever al lots re pr esented by said assessment being so numbered
and de signated u pon said diagram and a ssessme nt as so confirmed and re-
corded, sever ally an d re spectively.
3. That the total or aggregate amount of aeseseme nta unpaid le
the am oun t of $39,956.74.
4. Tha t bonds shall be issued upon the security of said unpaid
assessments in the am ount of $39,956. 70 in a ccorda nce with the provisions
of Bon d Plan C of Part 4 of Ar ticle IV of the Pa lo Alto Improvement Pro-
cedur e Code, as amen ded, and under and pursuant to the pr ovisio ns of
paid Reso lution of Intention a nd the proceedin gs ther eun der duly had and
taken; that said bon ds sha ll be for ty (40) in number, shall be dated
August 15, 1960, and bear in terest from their da te at the ra te of not to
excee d six per cen t (6%) per an num. The deno min atio n of said bonds and
their respective n um bers and dates of maturity are as shown on Exhibit "B"
hereto a ttache d and by refer en ce made a part hereof.
5. That sa id bonds shall be issued in se ries, an d the unpaid assess-
ments as sho wn on said list filed by the Super inten dent of Streets a nd
determin ed by sa id Council, to gether w ith the in terest the reon, shall re-
main a nd constitute a tru st fun d fo r the rede mptio n an d payment of sa id
bo nds a nd of the interest which may be due the reon, which u npa id assess-
men ts shall be paya ble in annual ser ies correspondin g in number to the
number of ser ies of bonds issued, and an even annual proportion of ea ch
a sse ssment shall be pa yable in ea ch yea r pr eceding the date of maturity
for each of the sever al ser ies of bo nds is sued, a nd such proportion of
ea ch a ssessment comin g du e in any yea r, together with the annual inte rest
ther eon, shall in tur n be payable in in sta llments as the gen era l taxe s of

said City on real property are payable, a nd sh all become delinquent at the
same times and in th e same propo rtio nate am ounts and bear the same pro-
por tionate penalties for delinque noy .
6. That the signatu re of the Mayor and T reasurer be i mpressed upon
:aid bon ds by engraved or lith ogr aphed p rocess and that said City Cle rk
physically sign said bon ds and affi x the ret o the corporate s eal of said
City; the interest cou pons affixed the ret o shall be signed by s aid Treas-
urer or bear his engraved, pr inted or lithog raphed signature; and such
signing and sealing of said bonds by maid officers, and signing of said
co upon s by sa id Treasure r sha ll constitute and be a suffioient and bindtr7
ex ecu tio n of e ach and e ver y on e of sa id bonds and all of the coupons the re-
of respectively. Said bon ds shall be substantially in the for m set forth
in Bond Plan C of Article IV of sa id Palo Alto Improv ement Proced ure Cod e,
as amended; sa id Trea surer and said Mayor a nd sa id Clerk a re h ereby a uth-
o rized and directed to so sign and a ttest re spectively.
7. That the interest coupons attaohed to ea ch of sa id bonds a nd
e'•ridencing the interest to accrue ther eon sha ll be number ed consecutively
and be substantially in the following form, to -wit:
