RESOLUTION NO. 3237
A RESOLUTION OF PRELIMINARY DETERMINATION
AND OF INTENTION
ALMA STREET UNDERGROUND ELECTRIC UTILITIES
PROJECT NO . 60-4
RESOLVED, by the Council of the City of P alo Alto,
California, that it does hereby p reliminarily det er mine that the
public in tere st, convenience a nd necessity requi re, a nd th at it
intends to order the following work to be done, acquisitions and
improv em ents to be made, to wit:
The constr uction and acquisition of a right of se rvice
in the fo llowin g work, acquisitio n and imp rove ments:
The r er outing of 4 spans of primary power line f rom
Palo Alto Avenu e and Alma Street to the south westerly
side of and a cr oss the Southern Pacific Railroad
right-o f-way; the remova l of 2 spans of second ary power
line from Alma Street a nd the rerouting the reof alo ng
the sou thwesterly side of and acr oss Alma St reet and the
rem ov al of J{ existin g stree t lights an d wooden poles
along Palo Alto Avenue a nd Alm a Street and the c on-
struction of new street light lum ina ires: with undergro und
wiring box ers and appurtenances, all as shown on the plan
date d 4/21/60 and la belled "Pr oject No. 60-4, Alma Street
Under groun d Electrica l Utilities, Iftt po sed Re -Routing
0. H. Ele ctric Facilities, Vicin ity the Palo Alto Apart-
ment", on file in the office of the City Clerk to which
refer en ce is hereby m ade for par ticulars.
2. All of the blocks , streets and alleys her ein men tioned
ar e shown on maps of record in the office of the County Recor der
of Santa Clara Cou nty, State of California , and sha ll be shown
on the cla ns here in r eferred to and to be filed with the City
Cler ic of said City.
3. Whe neve r any public way is her ein referred ] to as run-
ning between two pu blic ways, or from or to an y public way, the
interse ctio ns of the public ways refe rred to are inclu ded to the
e xten t that work shall be shown on the plans to be done here in.
4. All of said w ork and impr ov emen ts ar e to be constructe d
at the placer an d in the particular lo cations, of the forms,

sizes, di me nsio ns and materi als, and at the lin es, grades and
elevations, as sho wn and deline ated, upo n th e pl ans, p rofiles and
specificati ons to be made the refor, as he reinafter pro vid ed .
5. There is to be e xcepted from the work above described
any of su ch work alre ady done to li ne and grade and marked e xcep-
ted or shown n ot to be d one on said pla ns, p rofiles a nd specifi-
cations.
6. Sa id Coun cil does hereby adopt and establish as the
official gr ades for sa id work the grades a nd elevatio ns to be
shown upon said plans , profiles and specific ations. All such
grades an d elevation s are to be in feet and decim als the reof with
re feren ce to the datum plan e of the City of Pal o Alta.
7. Notice is hereby given of the fact that in ma ny c ases
sa id. wor k aid improvem ent will bring the finish ed work to a gr ade
differen t from that formerly existing, and that to said extent
said gr ades ar e her eby changed and that said work will be done to
said changed gr ades,
S. The description:: of the acquisition s a nd improveme nts
and the term ini of the work co ntained in this Resolution are
gen eral in natu re. All items of wor k do n ot necessarily extend •
fo r the full length of the description thereof. The plans anci
pr ofiles of the work a nd the leap and de ecriptlons of the a cqu isi-
tions, as contained in the Engineer 's report, :ha11 be controll-
in g as to the correct a nd deta ile d description thereof.
9. Said contemplated acquisitions and improvemen ts, in
the opinion of this; Cou ncil a re of m ore than local or ordinary
public ben efit, and said Council does hereby ma ke the co sts a nd
ex penses ther eof chargeable upon an aseesament district, w hich
district said Coun cil declares to be the district ben efited by
said acquisitions and impro vements, an d which is described as the
exte rior bounda. ri.ea of the com posite an d consolidated area of a ll
parcels of property descr ibes: as follows, to wit:

Lots 1 and. 2, Block 1, University Pa rk, the NWIy
5.00 .feet of Lot 3, the SWIy 85.20 feet of Lots 5 and
6, and the NWly 5.00 feet of the SW1y 85.20 feet of
Lot lV of Block 1, University Park.
10. Said Council f urther declares that all public str eets,
highways, lanes and alleys within said assessment district in use
in the per formance of a public functio n as s uch, sh all be omitted
from the assessment hereafter to be made to co ver the costs and
expenses of said acquisitions a nd impro ve ments.
11. Notice is her eby give n th at seri al bonds to represent
un pa id ass essm en t.,, and bear interest at the rate of not to e x-
ceed six pe r cent (6;) per annum, will be is -s ued hereu nder in the
manner prov ided in Bond Plan B, Ar ticle 3, Chapte r 6, of
Ordin ance No. 1928, the Palo Alto Im provement P rocedure C ode,
adopted by sa id Council on April 11, 1960, the last inst allment
of which bonds sha ll matur e not to ex cee d four (lr) years from
the secon d day of July next succeeding ten months from their date.
12. Except ao herein other wise provided for the issuance
of bo nds all of said wo:r lc :sha ll be done as pr ov ided in Articles
1 and 4 of Chapter 5 of said Co de, an d Se ction 17 of Ar ticle XIII
of the Constitu tion of the State of Californ ia.
13. Said acczuisition3 and im prov emen ts ar e hereby r eferred
to the City En gin eer of said City, he being the officer hav in g
chan ge a nd control of the acquisition an d constr uction of public
impr ov ements in a nd for said City of the kind described herein,
being a co mpeten t person employed by sa id City for that pu rpose,
a nd said City En gin eer is her eby directed. to ma ke and file with
the City Clerk of sa id. City a r eport in writing, presenting the
following:
(a) Maps a nd descriptions of the lands, easem ents, an d
r ights to be acquired;
(b) Plano and ;spe cifications of the proposed improve men ts
to be ma de pu rsuan t to this Resolu tion;

(c) Engineer's estimate of th e total costs and expenses
of said acquisitions and imp ro vements and of the incide ntal ex-
pe nses in co nnection th erewith;
(d) Diagram showing the assessment district above referrer
to, and also the bound aries and dimensio ns of the resp ective
su bdivision;; of land within said district as the s ame existed
at the tim e o: the passage of this Res oluti on, each of which
subdivisions ,sha ll be given a sepa rate nu mbe r upo n said diagram;
(e) A proposed assessment or the total amou nt of the costs
a nd e xpen ses of the pr oposed acquisitions and improve ment,- upon
the sever al ,subdiv isions of lan d within s aid district in pro-
portion to the estimate d ben efit to be rec eived by such sub-
div ision s, r espectively, fro m said acquisitions I nd impro ve ments,
and of the ex pense_ incidental thereto.
14. If any excess shall be r ealized fr om the assessment
it sha ll be spen t fo r the maintenance of said a cquisitions and
improvements, unless the Council sha ll her eafter determine that
said am ount, or any part thereof, ;-hall be applied as a credit
to each assessment here in .
