The impr oving of Embarcadero Road f rom East B ayshore Road n or theaster ly abo ut 2500 feet by grading, removing trees, bushes a nd existin g stru ctur es in the right of way, constructing or rec onstructi ng Portlan d cemen t concrete cur bs, gu tters, sidewalks and drivew ay apr ons , constr ucting base pavem ent and wearing surface, constr ucting se wer, water a nd gas services where required, con structing wate r mai ns, valves, hydrants an d appurtenan ces, in sta lling e lectr olier s, junction b oxes, electr olier con du it an d appurtenances. (b) The co nstruction of storm drain pipes, catch b asi ns, manh oles a nd a ppurten an ces from the existing storm se wer pumping st ation at Palo Alto airport Sou thwester ly an d Sou theaster ly in an existing dr ainag e ditch about 1100 feet to Embarcadero Roa d, then ce starting 2200 feet No rthe asterly from East Bayshore Road running then ce par allel with and a bout 1001 feet Northwe sterly of the cente rline of Emba rc adero Ro ad a distance of a bou t 920 feet to Emba rc adero Ro ad, thence in Embarcadero Road Southwesterly a bout 1300 feet to East Bayshor e Road; an d from a point in Embarca de ro Road 220 feet,mor e or loss, Northeasterly from East Bayshore Road runn in g thence in the la nds of the City of Palo Alto Northerly about 565 feet to the Easterly lines of the la nds of Kumaga i an d Nagatoishi, then ce Northwesterly about 1200 feet in an easemen t to be a cquired a long the Northe asterly line of the lands of Nagatoishi and Takamoto. (c) The relocation of the existing sanitary sewe r ou tfall line of the Ea st Palo Alto Sa nitae y District from the present metering station ad- jacent to the Pa lo Alto Municipal Golf Co urse, runnin g then ce Northeaster ly in Embarca der o Road abou t 300 feet, thence Sou theas terly in an easeme nt to be a cquir ed about 800 feet to the ex isting outfa ll sewer of the City of Pa lo Alto, together with the con stru ction of a n ew metering sta tion. All costs of all wor k and acquisitions described in this sub -par agraph (c) will be contributed by the City. (d) The acqu isition of all easeme nts and the con struction of a ll impr ovements aux iliar y to any of the a bove a nd neces sary to c omplete same. 2. All of the blocks, stree ts and alle ys her ein men tione d are shown on maps of recor d in the office of the County Reco rder of Santa Clar a Coun ty, State of Califor nia, and sha ll be shown on the pla ns herein re- ferred to a nd to be filed with the City Clerk of said City. 0 0 3. When ever a ny public w ay is herein referred to as running betwee n tw o pu blic waye, or from or to any public way, the i ntersections of th e public wa ys referred to a re incidded to the e xtent that w ork shall be shown on the plans to be done herein. 4. All of said work a nd imp ro vements are to be constructed at the places an d in the particul ar locations, of th e fo rma, eases, dimensions a nd ma ter ials, a nd at the lines, grades and elevations, as sho wn and de- lineated upon the plan s, profiles and specifi cations to be made therefor, ae he reinafter prov ided. 5. There is to be excepted from the work abo ve d esc ribed any of such wor k a lready done to line a nd grade and marked e xc epted or shown not to be done on said plans, pro files and specifications. 6. Said Council does hereby a dopt and eetablish as the official grades for ea ld work the grades and e levations to be shown up on said plans. profiles and specifications. All such grade, and elevations ar e to be in feet and decimals ther eof with refer en ce to the datum plane of the City of Palo Alto. 7. Notice is hereby give n of the fact that in man y cases said work and improvement will bring the finished w ork to a gra de different from tha t for mer ly ex isting, and that to said ex tent sa id grades are hereby cha nged a nd that said work will be don e to said changed grades. 8. The description s of the acquisitions and improvements a nd the ter mini of the work conta ined in this Rosolu tion ar e general in nature. All items of work do not n ecessar ily extend for the full length of the descriptio n thereof. The pla ns and profiles of the w ork an d the map an d descr iptions of the a cquisition s, as conta in ed in the Engineer's r eport, sha ll be co ntr olling ae to the corre ct and detailed descr iption thereof. 9. Said contemplated a cquisitions and improvemen ts, in the opinion of .this Council are of more than local or or dinar y publiic bene fit, and sa id Coun cil does hereby make the costs and expenses the reof chargeable upon an assessment district, which district sa id Council de cla res to be the district benefited by said a cqu isitio ns and improvements, a nd w hich is described as the exterior boun dar ie s of the compo site and consolidated a rea of all parcels of pro per ty fro nting on an d capa ble of ser vice in to sa id 1 U proposed improvements, as shown on the map of the asses sm ent district iden tified as "Assessm ent Diagram ", filed in the offic e of the City Clerk, to which r efere nce is hereby made . 10. Said Council furthe r declaree that all public streets, high ways, lanes and alleys withi n s aid aasessme nt district in use in the performance of a public function es such, shall be omitted fro m the assessme nt her e- after to be made to cover the costs a nd expenses of said acq uisitions and impr ov ements. 11. Notice is here by given that serial b onds to represent unp aid assessmen ts, and be ar interest at the rat e of not to exceed six per cent (6%) per an num, will be issued hereunder in the man ner p rovided in Bond Plan B, Ar ticle 3, Cha pter 6, of Ordin ance No . 1928, The Palo Alto Improve- ment Pr ocedu re Code, ado pted by said Coun cil on April 11, 1960, the l ast in stallme nt of which bonds sha ll ma ture no t to exceed nine (9) years from the second day of July next succeeding ten months from their date. 12. Ex cept as here in otherwise provided fo r the issuance of bonds all of said work shall be do ne as provided in Articles 1 and 4 of Ch apter 5 of said Code, and Sectio n 17 of Article XIII of the Constitution of the State of California . 13. Sa id aoquisitione and impr oveme nts are her eby referred to the City Engine er of said City, ae the o ffice r hav in g charge and contro l of the acquisition and co nstru ction of pu blic improvemen ts in and for said City of the kin d descr ibed herein, being a competent person employed by said City for that pur pose, and said City Engineer is hereby directed to make and file w ith the City Cler k of said City a repo rt in wr iting, pr esenting the follo wing: (a) Maps and description s of the lands, easements and r ights to be a cquir ed; (b) Plan s and specifications of tne proposed impr ovements to he made pu rsu ant to this Resolution; (c) En gineer's estimate of the to ta l costs a nd expenses of said a cquisitions and impro ve me nts an d of the incidenta l e xpenses in connec- tion therewith; 0 (d) Diagram showi ng the assessment dist rict above referred to, and also the bounda ries a nd dimensions of the respectiv e subdivisions of la nd w ithin said district as the same e xisted at th e tim e of the passag e of this Re solution, each of which subdi visio ns shall be gi ven a separate nu mber upon said diagram; (e) A proposed assessment of the total amount of the costs and ex- pen ses of the propos ed acquisitions a nd improvements upo n the se veral subdiv isions of lan d within said district in pr op ortion to the estimat ed ben efits to be received by such subdi visions, resp ectively, fr om said acqu isition s and impr ovements, an d of the expe nses incidental the reto. 14. If a ny ex cess shall be rea lized f rom the ass essme nt it sh all be spent fo r the main tena nce of said acquisitions a nd impro vements, unless the Council shall hereafter deter min e that said amount, or any part thereof, shall be applied as a credit to each assessment herein. • (} 1 hereby certify the foregoing to be a f ull, true and cor rect copy of a resolution duly passed and adopted by the City C ou ncil of th e City of Palo Alto, Californi a, at a regula r meeting there of held on the 11th day of July, 1960, by the f ollowi ng vote of the members the reof: AYES, and in favor ther eof, Councilmen: Ball.
