HomeMy WebLinkAboutRESO 3231KWHW:KTJ:m,js 6-27-60 10c 0 RESOLUTION NO . 3231 A RESOLUTION OP PRELI MINARY DETERMINATION AND OF INTENTION FOOTHILLS ANNEXATION NO. 1-A SANITARY TRUNK SEWERS AND WATER SUPPLY SYSTEM PROJECT NO. 59-1 RESOLVED, by the Council of the City of Pal o Alto, Cali- fornia, that it does hereby preli minarily determine that the p ubli inter est, con ven ience and necessity require, and that it intends to order the fo llo wing w ork to be done, acquisiti ons and improve- ments to be ma de, to -wit: 1. A. Ma in Trunk Sa nitary Sewers (a) The construction of main trunk sanitary sewer mains, man holes, w ye branches, later als, and appurte- nances a long Junipe ro Serra Boulevard from Hillview Ave nue co Matadero Creek, then ce south erly in ease- ments to be acquired gener ally along s aid creek to the southerly branch of Ar astradero Road, thence north- westerly in easements to be acqu ired gener ally along Arastradero Road about 2300 feet, thence me andering southw este rly in e asements to be a cquired about 3800 feet. B. Water Supply System (a) The con struction of w ater mains, v alve s, hydr ants and appurtenances in easements to be a cquired her ein a long Page Mill Roa d from existing City facili- ties n ortherly of Jun ipero Serra B oulevard to and across Me ta dero Creek, thence continu in g so utherly in easement: to be a cquired herein ge ne rally alo ng Mata dero Cre ek to the so uthe rly branch of Arastradero Road, thence nor th- w ester ly in easements to be acquired her ein genera lly along Arastra dero Roa d about 2300 fee t, thence mean der- ing southwesterly in easemen ts to be acquired about 750• feet, thence mean derin g easte rly in easements to be ac- quired abou t 4200 feet to a reservoir site. (b) The acquisition of a r eservoir site at the termin us of sa id water main a nd the construction there°: of a water storage reservoir and appu rten ances. (c) The acqu isitio n of sites and the construction of booster sta tions and appurtenan ces alon g said ma in at a point a bout 1300 feet sou therly of Ju nipero Serra Boulevard and at a po in t about 1200 feet so utherly of the pointwhere said ma in leaves the gen eral vicin ity of the south branch of Arastra dero Road. All of the blocks, streets and alleys herei n mention ed are shown on maps of record in the offioe of the Co unty Recorder of San ta Clara Cou nty, State of California, and shall be sho wn on the pla ns herein referred to and to be filed with the City Cl erk of sa id City. 3. Whene ver any p ublic w ay 1s her ein referred to as ru n- ning between two public ways, or f rom or to any public way, the interesectiona of the public ways referred to are i ncluded to th e extent tha t work shall be shown on the plans to be done herein. 4. All of sa id work and improvements are to be const ruc- ted at the places an d in the particular locations, of the forma, sizes, dimen sion s a nd materia ls, a nd at the lines, gr ades and ele- va tions, a s, shown and delin eated upon the plans, p rofiles and specifica tions to be made therefor, as hereina fter provided . 5. There is to be ex cepted from the work above described any of such work already don e to line an d grade and ma rked excep- ted or shown n ot to be done on said plan s, profiles an d specifi- cations. 6. Sa id Council does hereby ado pt and establish as the of ficial gra des for aaz.d wor k the grades an d elev ationa to be shown upo n said pla ns, profiles an d, specifica tions. All su ch grades and elevations are to be in feet and decimals the reof with reference to the datum pla neofthe City of Palo Alto. 7. Notice is hereby given of the fact tha t in many c ases said w ork an d improvement will brin g the finished w ork to a grade diffe rent from that form erly ex isting, and tha t to said exten t said grades are her eby cha nged an d that said work will be done to sa id changed grades. 8. The description s of the acquisitions and improvements and the term ini of the work containe d in this Reso lu tion a re gen eral in natu re. A11 item s of work do not nece ssarily exten d for the f ull length of the descripti on thereof. The pla ne and profiles of the work and the. map a nd description's of the acq uisi- tio ns, as contai ned in the Engineers report, shall be controlling as to the correct and det ailed descriptio n thereof. 9. Said co nte mpl ated aoquisitions a nd improv ements, in the opin ion of this C ou ncil ar e of more th an loc al or ordina ry public benefit, and said Council does hereby make the ooets and exile ees thereof cha rgeable upon an assessment dist rict, which, district said Coun cil declares to be the district benefited by said a cqu isitions and im provements, and which is described ae the exte rior boundaries of the com posite and consolidat ed are a of all parcels of property fronting on an d capable of se rvic e i nto said pro po se d improv emen ts, as shown on the maps of the asaessment dis- trict, filed in the office of the City Clerk, to which reference is hereby made. The ma p showing the boundaries of the district bene- fited by said main trunk sanitary sewer facilities is ide ntifi ed as "Improv em ent Project No. 59-1, Foothills An nexa tion No. 1-A Utilities, Tru nk Sew er System", consists of one sheet: da ted June, 1960, a nd the area benefited an d to be a ssessed is shown ther eon as "Are a of Imme diate Bene fit". The m ap show ing the boundarie s of the district bene- fite d by said wa ter supply system is identifie d as "Impro veme nt Pro ject No. 59-1, Foothills Anne xa tion No . 1-A Utilities, Water Supply System", con sists of tw o sheets dated June, 1960, a nd the ar eas benefited an d to be assessed are shown there on as "Area of Im mediate Benefit" and "Area of Seconda ry Be nefit". 10. The Cou ncil hereby declares that the City inten ds to adva nce to the project that portion of the cost the re of repr esen te by assessmen ts against that portion of the a ssessm ent district identifie d as "Area of Seco ndary Be nefit" on said maps fr om avail able f undi wt't3io ut i*iu&nce''Af''bon'd r, d '!' 3: e t*''..e°IwL11 pay that portion or the c osts of the project represented by said as- se ssments as a uoh c osts accrue, and shall s ucceed to all rights un der the assessment and .t o all rights which wo uld have accrued under the bonds had they been iss ued. The right is r eser ved, how ever, to issue bonda to represent the unpaid porti ons of said assessm ents at any time after notic e is given as required by • Sectio n 90 of said Code. 11. Said Cou ncil further declares that all public st re ets highways, lan es an d a lleys w ithin said assessment district in use in the performance of a public function as such, shall be omitted from the assessm en t hereafte r' to be made to c over the c osts and expenses of said ae. quiaitions and improvements. 12. Notice is here by giv en tha t serial bonds to repres ent unpaid assessments, an d bea r in terest at the rate of not to exc eed six per cent (6%) per an nu m, w ill be issu ed hereu nder in the manna; prov ided in Bond Pla n B, Article 3, Chapter 6, of Ordinance No. 1928, The Palo Alto Im provement Proce du re Code, adopted by said Co un cil on April 11, 1960, the last in stallment of which bonds shall matu re no t to exceed nin e (9) year s fr om the second day of July next succeeding ten m on ths from their da te. 13. Except as herein otherwise prov ided for the issuance of bonds all of said wox'k shall be done as provided in Articles 1 and 4 of Cha pter 5 of sa id Code, and Section 17 of Article XIII of the Con stitution of the State of Ca lifornia. 14. Said acqu isitions and improvemen ts are hereby re- terred to the City Engineer of said City, as the officer havin g charge and control of the acquisition a nd constr uction of public improvem ents in and for said City of the kin d described herein, bein g a competent person employe d by said City for tha t purpo se , and said City Engineer is hereby directed to make and file with the City Clerk of said City a report in writin g, presenting the followin g: 4j ( a) Maps and descriptions of the l ands, eas ements, a nd rights to be acquired; (b) Plans and specificatio ns of the proposed i mprovements) to be made pursuant to this Resol utio n; (c) Engineer's estim ate of the tot al costs and expenses of said a cqu isitions and impro vements and of the incidental ex- pen ses in conn ection therewith; (d) Diagra m showing the assessme nt district above referred to, an d also the boun daries and dime nsions of the respective sub- divisions of land within said district as the same existed at th e time of the passa ge of this Resolutio n, each of which subdivisio ns shall be given a separate number u pon said diagram; (e) A pr oposed assessme nt of the total amount of the costs and expenses of the proposed acqu isitions and improve ments upo n the several subdiv isions of land within said district in proportion to the estima ted be ne fits to be r eceiv ed by such subdi visions, respectively, from said acquisitions and improvemen ts, and of the ex pe nses inciden tal thereto. 15.
