A RESOLUTION OF PRELIMINARY DETERMINATION
AND OF INTENTION
FOOT'i£ILL3 ANNEXATION NO. 2
SANITARY 3ElIPS
PROJECT NO. 59-10

RESOLVED, by the Council of the City of Palo Alto,
California, that it does hereby preliminarily determine that the
public interert, oonvenienoe and necessity require, and that it in-
tends to order the following work to be done, acquisitions and
improvements to be made, to -wit:
1. A: L'Hermj.tte Subdivision and Adjacent Areas
(a) The conatruotion of sanitary sewer mains, man-
holes, drop inlets, flushing inlets, wye branches,
laterals and appurtenances in Arastradero Road from
Hubbard rive southwesterly to the City and County of
San Francisco Row, thence eouthwesterlyan additional
430 feet more or less.
B. Brio es Partition oana arden Miranda ..-visio
(a) The construction of sanitary sewer mains, man-
holes, drop inlets, flushing inlets, wye branches, late
rale and appurtenances in easements to be acquired here
in from a point in Miranda Avenue about 1125 feet south
easterly of Moana Court, thenoe northeasterly about 200
feet, thence generally northwesterly through lands of
Kruger, Ikingee, Rhamy, and Prusmack to Miranda Avenue
at a point about 1400 feet southeasterly of Monne Court,
thenue northwesterly in Miranda Avenue to Moans Court,
thence in Moana Court for its entire length, thence in
a generally northwesterly direction in easements to be
acquired herein along property lines to a point in old
Miranda Avenue about 170 feet northerly of Miranda
Avenue, thence southerly in old Miranda Avenue to Miran�
Avenue, thenoe westerly asrose the SeP.R.R. Row to an
easement to be acquired herein along said Row, thence
northwesterly along said easement and said Row to Miran•
Avenue, thence continuing aeroaa Manuela Avenue to and
along an existing ditch within the S.P.R.R. Row to and
along a oul-de-sao within Oak Hill Tract to the existi
main trunk sewer in Arastradero Road; and an easement
to be acquired herein across the southwesterly corner of
the property at the northeasterly corner of said S.P.R.R,
Row and Arastradero Road from an existing manhole to the
centerline of Arastradero Road; and in the ssutheaaterly
extension of theaeement along the southwesterly side of
said S.P.R.R. Row to serve the lands of Franks; and in
eaaementa to be acq uired he rei n alo ng rea r lines of lot
fronting on Mi ra nda Ave nue from a point abo ut 270 feet
northweste rly of Means Court southeasterly about 115
feet, thence northeaste rly about 220 feet to the lin e
he reinbefo re described; a nd from a poi nt on said last-
mentioned lin e at the northeasterly ea rner of the l ands
of A. Reid easterly abo ut 50 feet; and along old
Miranda A venue from a point about 170 feet no rthe rly of
Miranda A ven ue no rtherly about 154 feet.
(b) The eonstruotio n of an ejecto r st atio n on a
site to be acqui red at the northeast erly oo rner of land
of Baldwin and a pr essure li ne fr om s aid station ab out
180 feet to old Miranda Aven ue (if req ui red).
(c) The acquisition of dispos al rights in the
existing main trunk sewer and sewage disp os al f acili-
ties of the City of Palo Alto .
C. Manuela Acres, Mesa Tract, Oak Hill Tr act
(a) The con str uction of sanit ary sew er mains, ma n-
holes, drop in lets, flushing inlets, wye branches,
la terals and appur tena nces in Robb Road from its weste r
ly term inus ea sterly about 120 feet, thence northerly i
easements to be acquir ed a lon g property li nes about 225
feet, then ce wester ly in easemen ts to be acquired ab out
50 feet an d easterly in easements to be acquired to
Man uela Avenue; in Ro bb Road fro m Manuals. Avenue wester
ly abou t 410 feet; in Man uela Av enue from a point about
350 feet southeaster ly of Robb Road to Mesa Aven ue; a nd
from a point abou t 175 feet norther ly of Mesa A ve nue
northerly to the S. P.R. R. Row; in Manuela Court from
Manuela Aven ue w ester ly abo ut 500 feet; in Mesa Avenu e
and Oak Hill Avenu e for their entire len gths.
(b) The acqu isition of disposal rights in the
existing main trun k sewer an d se wage disposal facili-
ties of the City of Palo Alto.
D. Ge neral
The acquisition of all lands, easeme nts and r ights
auxilia ry to a ny of the abov e and n ecessa ry to co mplete
same.

2. All of the blocks, stre ets an d alleys herein mentioned
are shown on maps of record in the office of the County Recorder
of San ta Clara County, State of California, a nd eha ll be shown on
the plans herein referred to an d to be filed with the City Clerk
of said City.
3. Whenever an y pu blic way is herein refer red to as run-
ning between two public ways, or from or to any public way, the
intersections of the public ways referre d to ar e included to the
exten t tha t w ork shall be sho wn on the plans to be done herein.

4. All of s aid work a nd improveme nts are to be co nst ruc-
ted at the planes a nd in the p articula r locations, of the forms,
size s, dime nsions and materials, a nd at the lines, g rad es and ele-
v ations, as shown a nd deline ated upon the pla ns, profiles and
specifications to be made the refor, as hereinafter p rovided .
5. There is to be excepted from th e work abo ve desc ribed
a ny of such work already don e to li ne and gr ade and ma rked excep-
ted or shown n ot to be done on s aid pl ans, profiles and sp ecifi-
cations.
5. Said Counoil does hereby adopt and establish as the
official grade s for said work the grades and elevations to be
sh ow n upo n sa id plans, pro files and apeoitioationa. All s uch
grades and elev ation s ar e to be in feet and decimals ther eof with
refer en ce to the da tu m pla ne of the City of Palo Alto .
7. Notice is he reby given of the fa ct that in many oases
said work and improvem en t will bring the finished work to a grad e
differ en t fr om tha t former ly e xisting, and that to said exte nt
said grades are hereby ohan gea a nd tha t said work will be done to
sa id change d grades.
8. The descriptions of the acqu isitions an d improve ments
and the termini of the w ork contained in thia Resolution are
gemera1 in nature. All items of work do no t necessar ily exte nd fo
the full length of the descr iption thereo f. The plans and profile
of the wor k an d the map and de scriptions of the aoqu isitio ns, as
con tained in the Engineer's r epor t, shall be controlling as to the
corr ect and deta iled description thereof.
9. Said oontemplated a cquisition s and impro veme nts, in
the opin ion of this Coun cil ar e of mor e than loca l or or dinar y
public benefit, and sa id Council doe s hereby made the costa a nd
expen ses thereof chargeable upon an assessme nt dlatric t which
distr ict said Council declares to be the district ben efited by
said a oqu isitions and impro veme nts, and which is descr ibed as the
exterior boundar ies of the co mpo site and consolidated area of a ll

paroels of property t ea.tipee on and capable of se3-vioe i nto said
propos ed improveme nts, as sh own on the map of the ass essme nt dis-
trict identified as "Assessm ent Diag ram ", filed in the office of t
City Clerk, to which. refe rence is her eby made .
10. Said Co unoil fu rthe r decl ares that all public st reets,
highways, lane s and alleys withi n s aid assessment district in use
in the performance of a publio functio n as s uch, shall be omitted
from the assessment hereaft er to be made to o over th e costs and
ex pe nses of sa id acqu isitions and i mprove ments .
11. Notice is her eby given that s erial bo nds to r epresent
unpaid assessments, and bear interest at the rate of n ot to exceed
six per cent (6%) per an num, will be issued hereunder in the mann
prov ided in Bond Plan B, Article 3, Chapter 6, of O rdi nance No.
1928, The Palo Alto Improvement Procedure Code, adopted by said
Council on April 11, 1960, the last in sta llment of which bo nds
sha ll mature n ot to exceed nin e (9) ye ars fr om the second d ay of
July ne xt su coee ding ten months from their date.
12. Except AB herein otherwise pr ovided for the issuance
of bon ds all of sa id w ork shall be don e as pro vided in Ar ticles
1 an d 4 of Chapter 5 of said, Co de, and Sectio n 17 of Ar ticle XIII
of the Con stitutio n of the State of California.
13. Said acquisitio ns and impr ovemen ts ar e hereby referr ed
to the City Engineer of said City, as the officer hav ing charge an d
con tro l of the acquisition and oonatr uotion of publia impro vements
in an d for sa id City of the kin d deacribed herein, being a competent
person em ployed by said City fo r that purpose, and eaid City
Engineer is her eby directed to make an d file with the City Clerk of
said City a report in writing, pr eatnting the following:
(a) Maps and de scriptions of the lan ds, easements, and
r ights to be acquired;
(b) Plane an d specification s of the pr opose d improvements
to be made pursu ant to this Resolution;
(c) Engineer's estimate of the total c osts and e xp ens es
of said aoquisitions a nd improvements and of the incide ntal ex-
penses in co nnecti on therewith;
(d) Diag ram showing the asaeamment dist rict ab ove r efe rred
to, and also the bou ndaries a nd dimensi ons of the respective sub-
div isions of land within said district as the same existed at the
time of the passa ge of this Resoluti on, each of whioh subdi visions
sha ll be given a separate numb er upo n s aid diagra m;
(e)A proposed a sse ssment of the total amou nt of the costs
and expe nses of the proposed acquisitions and imp rov ements upon
the sev era l subdbiaion a of la nd within said dietriot in prop ortio n
to the estimated be nefits to be r eceived by such subdivisions,
respective ly, fr om said acqu isitions and improvements, and of the
e xpen se s incidental thereto.
14. If any excess shall be r ealised fr om the assessment it
shall be spent for the maintenanc e of said acquisitions and improve
ma ntis, un less the Coun cil sha ll hereafter determine that said amoun
or any par t thereof, shall be applied as a credit to ea ch aeseasme n
herein.
