wer e had and taken pursuan t to Article V of Ordinance N o. 844 of
said City, comm only designated the Palo Alto Improveme nt Proced ure

NOW, THEREFORE; IT IS FOUND, DETERMINED a nd ORDERED, as

1. The pu blic interest o ur n ecessity requ ire the acqu isi-
tio n. constructio n a nd completio n, by said City, of the pu blic
improvements desc ribed in said Resolution of Inte ntion an d in the
pro ce edings relating thereto ,. and the eaeespents and property pro -
posed to he acqu ir ed de scribed therein, and hereina fter described

immedia te possession in connectio n with the eminent domain pro-
ceedin gs.

grea test public goo d and the least priv ate injury, a nd a ll of said

4. The City Attorney and the la w firm of Messrs . Kirkbride,
Wilson, He rzfeld & Wallace, employed fo r that p urp ose, are hereby
directed to institute and . conduct to c onclusi on an action in emi-
nent dom ain for the acquisition of s aid easeme nts, to undertake
the necessar y action to obtain immediate possession there of, a nd
to ta ke sack action as is necesoa ry therein.
>. The City Manager is he reby autho rized and directed as an
alternative to tr ial of any action in eminent domain initiated -
hereunder, to expend from the proceeds of assessments and sale
of asseeemen t bonds to be issu ed in said proceedings such mo neys
as are n ecessa ry and in his o1nion may constitute the fai r ma rket
value of said par cels, based upon appr aisals of duly q ualified
and competent r eal e state appraioer s.
6. Referen ce is hereby made to said Resolution of Inte nti on
and related proceedings for a par ticula r descr ipt?;on of the said
