RESOLUTION NO . 3213
A RESOLUTION OF INTENTION TO ACQUIRE AND
CONSTRUCT IMPROVEMENTS
BIRCH STREET
PROJECT NO. 59-3
RESOLVED, by the Coun cil of th e City of Palo Alt o, C ali-
for nia, that
1. The public interest a nd convenien ce require, and it
in tends to o rde r the acquisitions and imp rov em ents described as
fo llows, to -wit:
I ACQUISITIONS
(a ) The ,acqu isition of easements for street and
utility purpo ses along the n or theasterly side of Birch Street,
10 feet wide from a po int abou t 97.50 fee t southeasterly of She r-
idan Av enue to Sheridan Avenue; rangin g from 15 f eet to 20 feet
wide from Sherida n Avenu e to Gr ant Avenue; 20 feet wide from
Grant Av enu e to .Sher man Avenue; and ranging from 10 feet to
2.66 feet from Sherman Avenue to the alley between Califo rnia
Ave nue an d Sherm an Av enu e; toge ther with acquisitions for c urb
retur ns at a].1 stree t intersections.
(b) The acquisition of easeme nts fo r street and
utility pu rposes alo ng the southwesterly side of Bir ch Street,
ranging from 7.68 feet to 13 feet wide from Page Mill Road to
Sh eridan Avenue; r anging from 15 feet to 10 fe et wide from Sheri-
dan Av en ue to Grant Avenue; 10 feet wide from Grant Av enue to
She rman Aven ue; ran gin g from .13 feet to 2.70 fee t wide fr om a
poin t about 40 feet southeasterly of the alley betwee n Ca lifornia
Avenue a nd Sher man Avenue to said alle y; and rangin g fr om 5.03
feet to 10 feet wide fr om said alley to California Avenue ; to-
gether with acquisitions zor curb retur ns at all„street in ter-
sections.
(c) The acquisition of trees, bushe s, shrubs, and
other or namental v egetation alo ng the proposed outer strip of
Birc h Street, together with facilities fo r irriga tion thereo f.

Av enue District Street Improv ement, an d on the improvemen t pla ns
on file in the office of the City Engineer , to which refere nce
is hereby made for particulars.
II CONSTRUCTION

m oving tr ees, bushes and existing stru ctures, c onstructing or re-
con str ucting Portlan d cement concr ete cur bs, gutters, sidewales
and dr iveway apro ns, storm water catch basins, man ho les, drain

pipe and appurte nances, c onstructing cr ushed rock base pavement
with plant mix wearing surf ace and concrete ce nter strip, and
constructing sanitary sewer, water and gas se rvices where re-
quired.
III GENERAL
The acquisition of all p roperty and eas ements
and the construction of all improvements auxiliary to any of the
above an d ne cessary to complete same .
2. Whenever any public way is herei n referred to as
running between two public ways, or fr om or, to any p ublic way, the
in ter se ctions of the public ways refe rred to ar e included to the
extent that work sha ll be shown on the plans to be do ne ther ein .,
3. Sa id streets and highways are more particularly sh ow n
in the records in the office of the County R eco rd er of Santa Clara
Cou nty, California, and are shown upon the pl ans herein referr ed
to filed with the City Clerk of said City.
4. A11 of said work an d improv emen ts are to be con-
structed at the places and in the pa rticula r locations, of the
forms, size s, dimensions and materials, a nd at the lines, grades
a nd e levations as shown a nd delineated upon the plan s, profiles
and specifications made ther efor, an d filed in the o ffice of the
City Cler k, reference to whic h is he reby made for a full, deta iled
description of su ch proposed wor k a nd for fu rther particular s.
5. There is to be ex cepte d from the wor k herein de scribe
ar.y,of su ch work alre ady done to line and gr ade and marked ex-
ce pted or shown not to be do ne on .. saidplans, profiles and spe ci-
fications.
6. No tice is hereby given of the fact that in many c ases
said work an d improvements will brin g the finished work to a grade
differen t from that former ly ex isting, a nd that to said ex tent
said grades are hereby changed and that said work will be don e to
said changed gr ades.
7. Said Cou ncil does her eby adopt and establish as the
oficial grades for said work the grades and elev ations shown u pon

said plans, profiles and sp ecificatio ns. All such grades and
elevations are to be in feet and decimals ther eof with refer enc e
to the datum pl ane of the City of Palo Alto.
B. The descripti ons of the acquisiti ons and improvements
and the te rmini of the w ork contain ed in this resolutio n a re g en-
eral in nature. All items of work do not necessarily extend for
the full length of the description there of. The pl ans and pro-
files of the work and the maps and descriptio ns of the acquisi-
tions, as contained in the Enginee r's report, shall be controlling
as to the corre ct an d de tailed desc ription thereof .
9. All of said wor k and improv ements sh all be d one und er
the supervision of the City En gineer of said City and all said
wo rk and mater ia ls shall be done an d furnished to his satisf ac-
tion.
10. The City will co ntribute sixty-two and o ne-half per
cent (62. 57.) of all cost of a cquisition s an d improvements in ex-
ce ss of sixty feet. (60') in width. Said co ntemplated acquisiti ons
a nd improvements, in the opinion of this Counc il, are of more than
lo ca l or o rdinary public benefit, and the ba lance of the cost and
e xpenses of doin g said ac quisition s and impro vements a nd expenses
incidental ther eto , shall he made c har geable upon the district
benefited tv•,er eby, the proper ty so be nefited and the exte rior
boundaries of such distr ict being described as follows, to -wit:

15. The Clerk of said City sh all cause this R esolutio n
of In tentio n to be publish ed twice in th e Palo Alto Times, a
daily ne wspaper, published a nd circul ated in the City of Palo Alto
which said paper is hereby design at ed fo r that purp ose, and which
is hereby design ated as the newspaper in which all furth er notices
required to be made herein shall be publi shed.
