HomeMy WebLinkAboutRESO 3210G RESOLUTION NO. 3ai0 A RESOLUTION DETERMINING THAT THE P1BLIC INI'$B80'T AND N&CES$ITY REQUIRE THE ACQUISITION OF EA3EMEYTS FOR STREETS AND THE TAKING OF IMMEDIATE P48SESSION THEREOF WEST CHARLESTON ROAD PROJECT NO. 59-9 RESOLVED, by the Counoil of the City of Palo Alto, Cali- fornia, that WHEREAS, pursuant to Resol ution of Inte ntion No. 3176, ado pted by this Co uncil on Deoember 14, 1959, this Co uncil did, on Maroh 28, 1960, adopt its Reaolution No. 3206 Ord ering Acqui- sition s and Improvements an d Confir mi ng Assess me nt, as modified; WHEREAS, said Resolu tion of Intention and said prooeedir rs were had and taken pursuant to Artiole V of Ordina nce N o. 844 of said City, common ly designated the Palo Alto I mprove ment Proced- ure Code, adopted Janu ary 13, 1941; NOW, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, as follows: 1. The public interest and necessity require the acquisi- tion, constru ction and co mpletio n, by said City, of the public improvements described in said Resolution of Inten tion and in the proceedings relating thereto, and the easem ents and pro perty propo sed to be acquired described therein, and hereinafter des- cribed in Exhibit "A" hereto attached an d incorporate d herein by reference, are neoeesery therefor. 2. The pu blic interest an d necessity require the taking of im mediate possession in connection with the em inent dom ain pro- ceedings. 3. The pu blic Seaeseity requires said acquisitions and improvemen ts; said proposed acquisition s anJ improvemen ts are plan ned an d located in the manner which will be m oat compatible with the greatest public good and the least private injury, and all of said aoqu isitio na are located w ithin the te rritorial limitd of the City of Palo Alto, mM a 4. The City :lbmam .y and the law firm of Messrs. Kirkbrid Wilson, Herzfeld asWallaae, e mployed for that p urpose, are hereby directed to institute a nd om nduct to eonolusi on an action in em- inent domai n for the acquisiti on of said esee ments, to undertake the nec essary motion to obtain i mmediate possession thereof, end to take suoh aotion se is neoeasary therei n. 5. The City Manager is hereby authorized and directed as an altern ative to trial of a ny action in e mine nt domai n initiated hereun der, to ex pen d from the proceeds of asaeeamenta and sale of assessmen t bonds to be issued in said proceedings such moneys as are n eoeasary an d in his opinion may constitute the fair market value of said perca le, baaed upon appraisals of d uly qualifi ed and competent real estate appraisers. 6.
