gection 1. ]C mployees wh o ha ve worked for the City in its
gov ernmental capscity as, disti.s uiahed f;pm its proprietary
capa city, hav e had no i nsura nce coverage or oth er prote cti on
in tho nmecase s where third pe rsons might be inju red thro ugh the
employee's ne gligence' or ca reless ness in thos e insta nces wherein
the City itself was not liable .
Section 2. The City has determin ed that it Sh all in the
future obta in insur ance or other indemnity for such employees.
S. sction 3. The City believes it to be a proper public purpos e
to do this as is evidenced by the provisions of Go vernment C ode
Section 2002 extending such coverages to State and C ounty employees
an d providing for defense of actions asserted against such empl oyees,
at the expe nse of the public agenc y inv olved.
Section 4 There is hereby ex tended to a ll employees the right
to hav e defe nse of such actions at the e xpen se of the City to be granted
se here in specified.
1. If the City Attorney determine s that there is a conflict
of interest which prevents him from pro perly r epr esenting
the emplo yee, he shall notify the em ployee to tha t effect.
2. The employee sha ll then sele ct an attor ney of his own
c hoice a nd present to the council the financial arrange -
me nts made with the a ttorney for such repr ese ntation.
3. The Coun cil will then indicate its appr oval or disapproval
of the arra ngeme nts made by the emplo yee.
4. Whe n the Coun cil a pproves such arrangements, it shall by
such appro va l agree to pay directly to the attorn ey
involved the amounts incurr ed or to be expended upo n
pre se ntation of fu lly itemized bill there fo r.
