RESOLUTION NO. 2608~
RESOLUTION OF THE COUNCIJ .. OF THE CIT'~ OF PALO ALTO
FINDING AND DETERMINING 'l'HAT THE PUBLIC INTEREST
AND NECESSITY OF SAID CJ.TY REQUIRE, FOR PUBLIC USE,
FOR THE RELOCATION OF ADOBE CREEK AND FOR DRAINAGE
PURPOSES, CERTAIN LAND LOCA~ED IN THE CITY OF PALO
ALTO / COUNTY 0:£4' SANTA CLARA, STATE OF CALIFORNIA
The Council of the City or Palo.Alto does resolve as follows:
Sectio~ 1. That the council of the City or Palo Alto has
found and determined, and hereby does find, determine and declare,
that the public interest and necessity of said City and of the
inhabitants thereof :require, for public use, certain land for the
relocation or Adobe Creek and for drainage purposes, in the City
of' Palo Alto, County of Santa Clara, State o:r Ca11forn1a.
Section 2. '!'hat the parcels of' real property or land re-
quired for the purpose aforesaid are described as follows:
PARCEL l
Beginning at a point on the Northwester•ly line of
ChR.rlestcn Road as shown on a Record of survey recorded
on June 30, 1952, in Book 37 of Maps at page 10, Offi-
cial Records of Santa Clara County, California; said
point of beginning being N. 5G• 24' E. (called N. 54•
26 1 1011 E. on said Record or Survey) 144 feet from the
Southwesterly line of a 6.01 acre parcel owned or
formerly owned by Louis J. Fr~itas; thence N. 1• 44 1

Section 3. That the Council of the City 01' Palo Alto has
found and determined, and hereby doea 1'1nd, determine and declare,
that the taking of said real property in fee is necessary.
Section 4. The Council of the City or Palo Alto hereby
declares its intention to acquire the i'ee simple to the land de-
cribed ln Section 2 hereof under eminent domain proceedings, and
the City Attorney or the City of Palo Alto hereby is directed to
commence action in the Su~ericr Court in tne State of California,
in and for the County of Santa Clara, for the purpose or condemn-
ing and acq1Jiring ea1d fee simple.
Section 5. The City Clerk shall certify to the adoption of
this resolution by a vote of two-thirds of all the members of the
City Council.

Council or th~ City of Palo Alto is fifteen (15) and that the
foregoing resolution was adopted by a vote of more than two-thi:nis
of all of the members of said Council at its meeting held on the
