The purpose and uaea to which said lands will be put ure planned in a manner which will be •oet co•pat1ble with the great-est public good and the least private 1njury. BE IT FURTHIR RISOLV!D that Arnold Rumwell, City Attorney or the City or Palo Alto, be and he is hereby d1rected and em- powered.:· To acquire in the name ot the City of' Palo Alto, a munie:lpal corporation or tne State ot California, the hereinafter deacr111)ed interest in real property, by condemnation in accordance with ·the provisions or the Code or Civil Procedure and of the Constitution or the State or California relating to eminent domain; '!'o prepare and prosecute in the name of the City of Palo Alto such proceeding or proceedings in the proper court having juris- diction thereof aa are necessary for such acquisition; 83 To make application to said court tor an order fixing the amo~~t of such security in the way of money deposita as said court may direct~ and for an order permitting the City of Palo Alto to take immediate possession and us~ or said interest 1n real property, for the purposes aet rorth above; To make deposit or such security out ot proper funds under the control of the Controller or the City of Palo Alto, in such amount so fixed and determined, and 1n such manner as such court in which such condemn.ation proceedings are pending, may direct. The interests in real property, which the City or Palo Alto is by this resolution determining to condemn for public uses, is aitu- ated in the County or Santa Cl~ra, State of California, and described as follows, to-wit: Parcel 1.
