I • I~ L l~ • w, • ..,,. ...... ,. ••••• ••~ ,_,,, •• _.....,~,..,,,..._,,.~,, .. ,_,,,..,~"-w" ... ~ •·<••-•P~-~~~-,w-••-~•rl'-~•·•~••. ··-. >--~···••'-• R E S 0 L U T I 0 N ----------N 0 " ~ PROVIDING FOR THE ISSUANCE OF BONDS ENCINA AVENUE ET AL PRO,J'ECT NO. 52-4 • RESOLVED, by the City Council of the City or Palo Alto, California, that \fHBREAS, said Council d1d on the 24th day or March, 1952, adopt 1te Resolution of Intention No. 2267 relating to certain work to be done and improvements and acquisitions to be made 1n said City under ~nd pursuant to the provisions of Article C of Ordinan~e No. 844 of said City, adopted January 13, 1941, entitled "Palo Alto Improvement Procedure Code", and did therein provide that aerial bonds would be issued thereunder pursuant to the provisions or Part 4, Bond Plan c or Article IV or said Code, ref- erence to aaid Resolution of Intention, aa amended, being hereby expressly made for further particulars; WHEREAS, on .July 10, 1952, the Superintendent of Streets of said City or Palo Alto, filed with the Clerk of sa1d Clty a complete list or all assesRments unpaid•thereunder upon the re-· spective assessment and diagram numbers thereon, whereupon said Clerk gave not1ce of the filing of said list and fixed in said notice Monday, the 11th day or Auguut, 1952, at the hour of 7:30 o'clock P.M. as the time when interested persona might appear before the City Council of said City, at the regular meeting pkce of said Council, City Hall, 1n said City and show cause why bonds should not be issued upon the security of the unpaid assessments shown on said list, all of which appears from the affidavits on file in the office of said Clerk; WHEREAS, no protests or object1ona against the iseuance of said bonds were pres-ented before or at the time fixed for said hearing; NOW, THEREFORE., IT IS HEREBY RESOLVED., FOUND AND DETER-MINED, a43 follows: l. That aa1d list of asse5ements unpaid filed by said Superintendent of Streets ae aforesaid was at the time or f111ng thereof in all respects complete and correct, and that since the time of filing thereof no assessments have be-en pa.1d and also that the unpaid assessments 1n the proceedings duly had and taken under and pursuant to said Resolution of Intention, are ao shown on lb:hib1t "A" hereto attached and by reference made a part hereof. 2. That for a particular d~acr1pt1on of the lots bearing the respective assessment numbers above set forth and upon which assessments remain unpaid as above stated,, severally and respec- t1 vely, reference is hereby made to said assessment and to the diagram recorded 1n the office or the aa1d Superintendent or Streets after confirmation by said City Council, the several lots represented by said assessment numbers above set forth being so numbered and designated upon said diagram and assessment as 50 confirmed and recorded, severally and respectively. 3. That the total or aggregate amount or said assessments unpaid !s the sum of $21,530.43. - 465 •· ~; ( {. ~:. 1. ;. 466 4. That the s1gna tures. or the Mayor and Treasurer be impressed upon said bonds by engraved or lithographed process and that said City Clerk ghys1cally sign sald bonds and aft'ix thereto the corporate seal or said City; the interest coupons affixed thereto shall be signed by said Treasurer or bear h1s engraved, pr1nt1!d or 11 thographed signature; and such signing and seallng or said bo~ds by said off1cera, and signing or said coupons by said Treasurer shall constitute and be a eufficlent and binding execution 01· each and every one or sa:td bonds and all of the coupona thereof respectively. Said bonds shall be substantially in the form set forth in Bond Plan C of Article IV of ea1d Palo Alto Improvement Procedure Code; Bald Treasurer and said Mayor and said. Clerk are hereby authorized and d.1rected to so sign and attest respectively. 7.
