CONFIRMING AMENDED ASSISSM!iNT
THIRD STREET ET AL
PROJECT NO. 51-1
RESOLVED, by the Council or the City or Palo Alto th.at
WHEREAS, said Council did on the 14th day or July, 1952,
order the City Engineer to make and file with sa1d Council an
amended assessment or the parcel or property the rormer asaeaament
upon which under Resolution or Intention No. 2093 or said Council
1e deB1gnated upon the original assessment and diagram and confirmed
by ea1d Council on July 9, 1951, and recorded in the office or the
Superintendent or Streets or said City, as diagram and assessment
No. 170;
WHEREAS, said City Engineer did on the 15th day or July, 1952,
pursuant to said order, file with the Clerk or said City an amended
diagram and assessment;
WHEREAS, said Council fixed Monday, the 28th day of July, 1952,
as the time for hearing said amended assessment and caused notice or
said hearing to be published twice in the Palo Alto Times, as appears
rrom the affidavit or publication on file 1n the office of the Clerk or e~id City; and
WHXREAS, at the time and place fixed for said hearing, no
protests or objections were made or presented to the proposed amended
assessment, and all matters and things pertaining to said amended
assessment were fully heard and considered by said Council;
NOW, THEREFORE, IT IS ORDERED that said amended assessment
filed with the Clerk 01· said City pursuant to resolution ordering
same be and the same 1s hereby ratified, approved and confirmed.
IT IS FURTHER ORDERED, that the Clerk of said City shall
deliver sa1d amended asaesoment to the City Engineer, together with
a certified copy or this resolution thereto attached, and said
City Engineer shall thereupon record such amended assessment with
a certificate at the end thereof by the Clerk or said City that 1t
is the amended assessment approved by the City Council.
The C!ty Engineer shall note opposite the assessment in said
original diagram and assessment No. 170 that 1t has been displaced
by said amended assessment, giving the date, and shall credit upon
said amended assessment all payments theretofore made upon the
original assessment. When said amended assessment has been recorded,
the City Engineer shall cause the original assessment involved to be
cancelled.
I hereby certify that the above and foregoing resolution was
duly and regularly adopted by the City Council or the City of Palo Alto
at a regular meeting thereof held on the 28th day of July, 1952,
by the following vote:
AYES: Blois, Cashel, Cathcart, Drysdale, Hill, Marshall, Miller,
Mitchell, Montrou11, Simpson, Welle, Wickett.
NOES: None. _...,.,
