PROVIDING FOR THE ISSUANCE OF BONDS
HOMER AVENUE, ET AL
ACQUISITION AND IMPROVEM.BNT
PROJECT NO. 51-16
RESOLVED, by the City Council of the City of Palo Alto,
California, that
WHEREAS, said Council did on the 11th day of February,
1952, adopt 1te Resolution of Intention No. 2223 relating to
certain work to be done and improvements and acqu1a1 tions ';o be
made 1n said Clty under and pursuant to the provisions or Article
V of Ordinance No. 844 or said City, adopted January 13, 1941,
entitled "Palo Alto Improvement Procedure Code," and did therein
provide that serial bonds would be 1seued thereunder pursuant to
the provisions of Part 4, Bond Plan C of Article IV or said Code,
reference to sai.d Resolution of Intention, as amended, beirJg
hereby expressly made for further particulars;
WHEREAS, on June 9, 1952, the Superintendent of Stre~ta
or sa1d City or Pale Alto, filed with the Clerk of said City a
complete list of all assessments unpaid thereunder upon the re-
spect1 ve asee~ament and diagram numbers thereon, whereupon aa1d
Clerk gave notice or the f111ng of said list and fixed in said
notice Monday, the 23rd day or June, 1952, at the hour of 7:30
o'clock P.M. aa the time when interested persons might appear
before the City Council of said City, at the regular meeting
place or said Council, City Hall, in said. City and show cause
why bonds should not be iseued upon the security of the unpaid
assessments shown on said list, all or which appears from
affidavits on file 1n the o.ff1ce of said Clerk;
WP.EREAS, no protests or objections against the
issuance of said bonds were preser.ted before or at the time fixed
for said hearing;
NOW, THEREFORE, IT IS HEREBY RESOI.VED, FOUND AND
DETERMINED, as follows:
l. That aald list or assessments unpaid filed by sald
Superintendent of Streets as aforesaid waB at the time of filing
thereof in all respects complete and correct, and that since the
time of filing thereof no assessments have been paid and also that
the unpaid assessments in the proceedings duly had and taken '..lnder
and pi..trsuant to eaid Resolution of Intention, are as shown on
Exhibit 11 A" hereto attached and by reference made a part hereof.
2. That for a particular description of the lots bearing
the reapect!ve assessment numbers above set forth and upon which
assessments remain unpaid as above stated, severally and reapec-
t1vely, reference is hereby made to said assessment and to the
diagram recorded in the of f1ce or the ea1d Superintendent of
Streets after conf1rmat1on by said City Council, the several lots
represented by said assessment numbers above set forth being so
numbered and designated upon sa.id diagram and assessment as so
confirmed and recorded, severally8ld respectively.
3. That the total or aggregate amount of said assessments
i.mpaid is the sum or $9,880.46.
4. That bonds shall be issued upon the security or said
unpaid assessments in the amount of $9,880.40 1n accordance with
the prov1s1onn of Part 4, Bond .l:'lan C of Article IV of the Palo

Alto Impro.,em.ent Procedure Code, and under and pursuant to the
provisions of Resolution or Intention No. 2223 and the proceed1n~e
thereunder duly had and taken; that ea1d bonda shall be Ten (lOJ
1n number, shall be dated June 9, 1952, and bear interest at the
rate of not to exceed four per cent (4~} per annum from June 9,
1952, and the denomination of said bonds and their respective
numbers and dates or maturity are as follows:

5. That said bond8 shall be 1Bsued in series, and the
unpaid assessments as shown on said list filed by the Supertn-
tendent or Streets and determined by said City Council, together
with the interest thereon, ehall remain and constitute a trust
fund for the redemption and payment of said bot1ds and ·of the
interest which may be due thereon, ~hich unpaid assessments shall
be payable in annual series corresponding in number to the number
of series or bonds issued., and en even annual proportion or each
assess~ent ehall be payable in each year preceding the date of
maturity ror each of the several series or bonds issued, and such
proportion or each assessment coming due in any year, together
with the annual interest thereon, shall in turn be payable 1n
inetallmente as the general taxes of said City on real prop~rty
are payable, and shall become delinquent at the same times and in
the same proportionate amounts and bear the eame proportionate
penalties for delinquency.
6. That the signatures of the Mayor and Treasurer be
impressed upon said bonds by engraved or lithographed process and
that said City Clerk physically sign said bonds and arr1x thereto
the corporate seal of said City; the interest coupons affixed
thereto shall be signed by said Treasurer or bear his engraved,
printed or lithographed signature; and such s1gn1ng and eealing
~r oa1d bonds by said officers, and signing or said coupons by
said Treasurer shall constitute and be a sufficient and bonding
execution of each and every one of said bonds and all of the
coupons thereof reapectively. Said bonde shall be substant!ally
in the form set forth in Bond Plan C of Article IV of ea1d Palo
Alto Improvement Procedure Code; said Treasurer and said Mayor
and said Clerk are hereby authorized and directed to so sign
and attest respectively. ·
7. That the interest coupons attached to each or said
bonds and evidencing the interest to accrue thereon shall be
numbered consecutively and be substantially in the following form,
to wit:
