PROVIDING FOR THE ISSUANCE OF BONDS
LOMA VERDE AVENUE, ET AL
ACQUISITION AND IMPROVEMENT
PROJECT NO. 51-15
RESOLVED, by the City Council or the City of Palo Alto,
Cal1t'orn1a, that
WRERKAS, 8a1d Council did on the 11th day of February, 1952,
adopt 1te Resolution or Intention No. 2221 relating to certain
work to be done and improvements and acqu1e1t1one to be ma.de in
said City under and pursuant to the provisions or Article V of
Ordinance No. 844 of said City, adopted January 13, 1914, entitled
"Pa.lo Alto Improvement Procedure Code," and did therein provide
that aerial bonda would be 1eeued thereunder pursuant to the
provisions or Part 4, Bond Plan C of Article r.I of ea1d Code, ref-
er.ence to 8a1d Resolution or Intention, as amended, being hereby
expresisly ma.de for f11rther particulars;
WHEREAS, on June 9, 1952, the Superintendent of Streets
or sa1d City or Palo Alto, r1led with the Clerk or said City a
complete 11et of all aa8esements unpaid thereunder upon the re-
spect1 ve assessment and diagram numbers thereon, whereupon said
Clerk gave notice or the filing or said list and fixed in oa1d
notice Monday, the 23rd day of June, 1952, at the hour or 7:30
o'clock P.M. ae the time when interested pereons might appear
bet' ore the CH;y Council of sa1<l City, at the regul9.r meeting place
or said Council, City Hall, in said City and show cause why bonds
ehould not be issued upon the security of the unpaid assessments
shown on said list, all of which appears from the affidavits on
file in the office of said Clerk;
WHEREAS, no protests or objections against the issuance
of said bonds were presented before or at the tlme fixed for said
hear-ing;
NOW, THEREFORE, IT IS HEREBY RESOLVED, FOUND and DETERMINED,
as follows:
1. That said list or assessments unpaid filed by said
Superintendent or Streets as aforesaid was at the time or f111ng
thereof 1n all respects complete and correct, and that e1nce the
tj.me of filing thereof no aeseesments have been paid and also
that the unpaid assessments in the proceedings duly had and taken
under and pursuant to said Resolution of Intention, are as shown
on Exhibit "A" hereto attached antl by reference made a part
h~reof.
2. That for a particular description or the lots bearing
the respective assessment numbers above eat forth and upon which
assessments remain unpaid aa above stated, severally and respec-
tively. reterence is hereby made to said assessment and to the
diagram recorded 1n the office of the said Superintendent of
Streets after confirmation by said City Council, the several lots
Nrpresented by said. aaseaoment.numbers above set forth being so
confirmed and recorded, severally and reepect1vely.
~ 3. That the total or aggregate amount of said aeees3mente
unpaid 1s the sum or $197,201.73.
4. That bonds shall be issued upon the security or said
unpaid asseosmenta in the amount of $197,201.70 1n accordance
with. the provisions or Part 4, Bond Plan C of Article l'V of the
Palo Alto Improvement Procedure Code, and under and pursuant to
• .1 the provisions of Reeolut1on or Intention No. 2221 and the

5. That said bo·nde shall be issued j.n eeriesA and the un-
paid assessments as shown on said list filed by the Superintendent
of Streets and determined by said City Council, together with the
interest thereon, shall remain and constitute a trust fund for
the redemption and payment of ea1d bonds and or the interest
which may be due thereon, which unpaid assessme:its shall be
payable in annual series corresponding 1n number to the number of
series or bonds issued, and an even annual proportion of each
assessment shall be payable in each year preceding the date of
maturity for each of the several series of bonds issued, and such
proportion of each assessment coming due in any year, together
with the annual interest thereon, shall in turn be payable in
installments as the general taxes ~r said City on real property
are payable, and shall become delinquent at the same times and
1n the same proportionate a~ounts and bear the same proportionate penalties for de~inqueney.
6. That the signatures or the Mayor and Treasurer be
impressed upon said bonds by engraved or lithographed process
and that said City Clerk physically sign said bonds and affix
thereto the corporate seal of said City; the interest coupons
affixed thereto shall be signed by said Treasurer or bear his
engrav~d, printed, or lithographed signature; and such a1grl1ng
and sealing or said bonds by said officers, and signing or said
coupons by aa1d Treasurer shall constitute and be a sufficient
and binding execution of each or every one of said bonds and all
of the coupons thereof reepectively. Said bonds shall be
substantially 1n the form set forth 1n Bond Plan C of Article rv
of said Palo Alto Improvement Procedure Code; said Treasurer and
said fi'ayor and said Clerk are hereby authorized and directed to ·so sign and attest respectively.
7. That the interest couponstttached to each or said
bonds and ev1de·ncing the interest to accrue thereon shall be
numbered consecutively and be substantially in the following form, to w1t:
