CONFIRMING ASSESSMENT

RESOLVED, by the Council of the City of Palo Alto, Califor-nia that
WHEREAS, the Council did on the 24th day of March, 1952,
adopt 1ta Resolution or Intention No. 2267 to order certa1.n
improvements to 'be made 1n said City, unde1" and pursuant to
Article V of Ordinance No. 844 or said City, adopted January 13,
1941, entitled "Palo Alto Improvement Procedure Code", and to
issue bonds pursuant to Part 4, Bond Plan C of Article IV of said
Ordinance No. 844, reference to which resolution 1a hereby ma.de
for a particular descriptiou or the improvements to be made, the
boundaries or the assessment district and the bonds to be issued;
WHEREAS, said Resolution of Intention No. 2267 has been
duly published twice 1n the Palo Alto Times, a newspaper of
general c1rculat1on printed and published in said City, wherein
all persons interested having any objections to the proposed
improvements or against the district to be assessed for the costs
and expenses thereof, or against the grades at which said work
shall be done, or to the Engineer's estimate of the costs and
expenses thereof, or against the diagram or assessment, were
notified ~or the time and place of the hearing as contained in
said resolution of intention; said resolution was duly published
within the time and in the manner provided in said Improvement
Procedure Code, and as directed by said resolution of intention,
as appears from the affidavit of publication on file 1n the
office or the City Clerk of said City;
WHEREAS, at the time and place fixed for said hearillg no
protests or objections were made or preser.ted to the proposed
improvements, or to the district to be assessed, or to the grades
at which said work was to be done, or to the bonds to be issued
to pay the costs and expenses thereof, or to the Engineer's
estimate of the coats and expenses thereof, or against the diagram
or assessment, and all persons interested desiring to be heard
were given an opportunity to be heard, and ali matters and things
pertaining to said proposed improvements were duly heard and
considered by said Council, and sa1d Council has acquired juris-
diction to order said improvements and to confirm said assessment to pay the costs and expenses thereof;
NOW, THRREFORE, said Council does hereby FIND, DETERMINE and ORDER, as follows:
1. That the assessment and diagram for the cost and ex-
penses of the improvements described 1n said Resolution of Inten-
tion, as modified, bep and the same is hereby, ratified, approved
and confirmed aa the assessment and diagram to pay the costs and expenses of said improvements.
2. That the City Clerk Of said City shall deliver said
diagram and assessment to the Superintendent of Streets or said
City, together with a certified copy of this resolution thereto
attached, and said Superintendent of Streets shall thereupon re-
cord such assessment and diagram in his office 1n a suit.able book
to be kept for that purpose and append thereto his certificate of

the date of' such record.1ng, and such record shall be the assessment
roll to pay for the coats and expenses of said improvements.
3. Immediately upon such recordat1on said Superintendent
or Streets shall g1ve notice thereof by two publications in the
Palo Alto Times, a newspaper or gener~l circulation printed and
published 1nsa.1d City, which notice shall set forth~ among other
things, that all sums assessed therein are due and payable at his
office immediately, and that payment thereof is to be mnde to him
within thirty days after the date or recording said assessment,
which date shall be stated in said notice, and such other matters
as are required by Sect1on 7 of Article V of aaid Improvement
Procedure Code.

I hereby certify the foregoing to be a true copy or
re3olutlon adopted by the City Council of the City of Palo Alto,
California, at a regular meeting thereof held on the 12th day of
May, 1952, by the following vote of the members thereof;
AYES, and in favor thereof, Councilmen:
Bishop, Blois, Bower, Cashel, Cathcart, Drysdale, Gaspar,
Hill, Marshall, Miller, Mitchell, Simpson, Wickett.
NOES, Councilmen: None.
ABSENT, Councilmen: Bowden, Montreuil.
