HomeMy WebLinkAboutRESO 2291.... · 'I; ~ i' l, .,. ............ ..,. ....... . - R E S 0 L U T I 0 N N 0 • ORDERING IMPROVBMENTS PROJECT NO. 51-17 BRYANT STREET, ET AL 2291 RESOLVED, by the Council of the City of Palo Alto, Ca.11forn1a, that WHEREAS, the Council did on the 28th day of April, 1952. adopt its Resolution of Intention No. 2278 to order certain 1mp~ovements to be made 1n said City, under and pursuant to Article V of Ordinance No. 81~4 of said City, adopted January 13, 1941, entitled "Palo Alto Improvement Procedure Code", and to iesue bonds pursuant to Part 4, Bond Plan C of Article IV of said Ordinance N'o. 8'+4, re.ference to which' .resolution is hereby made for a particular description of the improvements to be made, the boundaries of the assessme·_,t district and the bonds. to be issued; WHEREAS, said Resolution of Intention No. 2278 has been duly published twice in the Palo Alto Times, a newspaper of general c1rcula.t1on printed and published in said City, wherein all ~ersons interested having any objeccions to the proposed improvements or against the district to be assessed for the costs and expenses thereof, or against the grades at which said work sha:..1 be done 1 or to the Engineer's estimate of the costs and expenses thereof, or against the diagram or assessment, were notified of the time and place of the hearing ~a contained in said resolution of intention; said resolution was duly published within the time and in the man·ner provided 1n said Improvement Procedure Code, and as directed by said resolution of intention, as appears from the affidavit of publication on file in the office of the City Clerk of said City; WHEREAS, at the time and place fixed for said hearing no protests or objections were made or presented t~ the proposed improvements, or to the district to be assessed, or to the grades at wttich said work was tobe dona, or to the bonds to be issued to pay the costs and expenses thereof, or to the Engineer's estimate of the costs and expenses thereof, or against the J1agram or assessment, and all persona interested desiring to be heard were given an opportunity to be heard, a.nd all matters and things pertaining to said proposed improvements were duly heard and considered. by said Council, and said Council has acquired jurisdiction to order said improvements and to con!'1rm aa1ci assessment to pay the costs and expenses thereof; NOW, THEREFORE, said Council does hereby FIND, DETERMINE, and ORDER, as follows: 1. That the plans and speeif1cat1ons for street improve- ments under said Resolution or Intention be, and they are here- by, finally adopted and approved as the plans and specifications to which said work and improvements shall be done as called for in said Resolution of Intention. 2. That the Engineer's estimate of the itemized an0. total estimated cost and expenses for said improvements, as modified, be, and 1t ls hereby, finally adopted and approved as the Engineer's total and detailed estimate of the costs and expenses or said improvements. 3. That the map of the assessment d1str1ct be, and the same is hereby, finally adopt~d and approved as the map of the assessment district, and the boundary or said assessment district na shown thereon is hereby determined and established to be the boundary or the assessment district to pay for the coats and expenses of aa1d improvements. * * * * * • * I hereby certify the foregoing to be a true copy or resolu- tion adopted by the City Council of the City of Pale Alto, California, at a regular meeting thereof held on the 12th day or May, 1952, by the following vote or the members thereof: AYES, and in favor thereof, Councilmen: Bishop, Blois, Bower, Cashel, Cathcart, Drysdale, Gaspar, Hill, Marshall, Miller, Mitchell, Simpson, Wickett.
