R E 3 0 L U T I O N N 0 • ---------- ORDERING IMPROVEMBNTS PROJECT NO. 52-4 BNCINA AVE. I BT AL 2282 RESOLVED, by the Council of the City of Palo Alto, Cal1fornla, that WP.ERE.AS, the Council did on the 24th day or March, 1952, adopt its Resolution or Intention No. 2267 to order certain improvements 367 to be ma.de 1n said City, under arid pursuant to Article V of Ordi- nance No. 844 of sa1d City, adopted January 13, 19,1, entitled !fPalo .A.lto Improvement Procedure Code", and to issue bonds pursuant to Part 4, Bond Plan C of Article IV or said Ordinance No. 844, reference to which resolution is hereby made for a particular des- cription of the improven~nt to be made, the boundaries of the assess- ment district and the bonds to be issued; WHEREAS, said Resolution of Intention No. 2267 has been duly published twice in the Palo Alto Times, a newspaper of general circulation printed and published in said City, whe'.l"ein all persons interested having any objections to the proposed improvements or against the d1str1ct to be assessed for the costs and expenses thereof, or against the grades at which aaid work shall be done, or to the Engineer's estimate of the c::osts and expenses thereof, or against the diagram or assessment, were notified of the time and place or the hearing as contained in said resolution of inten- tion; said resolutlor. was duly published within the time and 1n the manner provided in said Improvement Procedure Code, and as directed by said resolution of intention, as appears from the aff1- dav1t of publication on file 1n the of1~1ce of the City Clerk of said City; WHEREAS, at the time and place fixed for aa1d hearing no protests .or objections were made or presented to the proposed im- provements, or to the district to be assessed, or to the grades at which said work was to be done, or to the bonda to be issued, to pay the coste and expenses thereof, or to the Engineer's estimate of the costs and expenses thereof, or against the diagram or assess- ment, and all persons interested desiring to be heard were given an opportunity to be heard, and all matters and things pertaining to said proposed improvements were duly heard and considered by said Council, and said Council has acquiI•ed jurisdiction to order said improvements and to confirm said assessment to pay the costs and expenses thereof; NOW, THEREFORE, said Council does hereby FIND, DETERMINE and ORDER, as follows: 1. That the plans and spec1f1cations for street improvements under said Resolution of Intention be, and they are hereby, finally adopted and approved as the plans and specifications to which said work and improvements shall be done as called for in said Resolu- tion of Intention. 2. That the Engineer1 a estimate of the itemized and total eat~.nated cost and expenses for said 5.mprovements ~ as modified, be, • 368 ( J ~· '• and it is hereby, finally adopted and approved as the Engineer's total° and detailed estimate or the costs and expenses or. said improvements. 3. That the public interest and convenience require~ and said Council does hereby order the improvements to be made as described in and in accordance with the said Resolution of Inten- tion on file 1n the office or the City Clerk of ea1d City, refel"- ence to which is hereby liade for a more particular deacr1ptlon or said improvements and also for further part1cular8, pursuant to the provisions or Article V of said Improvement Procedure Code. 4. That the map of the assessment district be, and the same ts hereby, finally adopted and approved as the map or the assess- ment d1st~1ct, and the boundary or said assesament district as shown thereon is hereby determined and established to be the bound- ary of the assessment district to pay for the costs and expenses c•f sald improvements. ~ * * • + * * I hereby cert:ify the foregoing to be a true copy or resolu- tion adopted by the City Council of the City of Palo Alto, Cal1- forn1a, at a :regula:c• meeting thereof held on the 28th day of April, 1952, by the follow1.ng vote of the membe1·a thereof: AYES, and in favor thereof, Councilmen: Bishop, Blois, Cashel, Drysdale, Gaspar, Hill, Marshall, Miller, Simpson, Wickett.
