HomeMy WebLinkAboutRESO 2278360 f ,,, that R E S 0 1 U T I Q li N C • 2278 OF INTEKTION TO MAKE IMPROVEMENTS BRYANT STREET, BT AL PROJECT NO. 51-17 RESOLVED, by the Council of the City of Palo Alto, California, 1. lr• 1te opinion the public interest, convenience and neces- sity requ!re, and that it ls the intention of ea1d Council to order the t'ollowing work to be done and improvemente to be made in said e1ty, to-wit: A. The improving of Bryant Street from Porest Avenue to Embarcadero Road by grading and constructing storm water catch basins, manholes, dra:tn pipe and appurtenances, and by reconstruct- ing and rehabilitating the drainage system at intersections, in- cluding roconstruction of Cllrbs and gutters, and sidewalks where necessary. B. The erad1ng and construction or storm water catch basins, m~nholes, dra1n p1pe and appurtenances in Homer Avenue from High Street to Bryant Street, in Channing Avenue from Emerson Street to Bryant Street, 1n L1ncoln Avenue from Ramona Street to Bryant Street, and 1n Ramona Street and High Street from Homer Avenue to .Forest Avenue. Whenever any public way 1s herein referred to as running 1 between two public ways, or from or to any public way, the inter--, sections of the public ways referred to are included to the extent that work shall be shown on the plans to be done thereon. 3. Said streets, avenues, roads, courts and rights of way are more particularly shown i~ the records of the 0ffice or the County Recorder of Santa Clara County, Cal1,forn1a, and are shown upon the plans herein referred to and filed with the City Clerk. 4. All or said work and improvements are to be constructed at the places and in the particular locatlons, of the forms, sizes1 dimensions and materials, and to the lines and grades, and at the elevat:tons, ae ohown and delineated upon the plan1:3, profiles and spec1&at1ons made therefor and preliminarily approved by the Coun- cil at a regular meeting thereof duly held on the 28th day of April, 1952, and on file in the office of the City Clerk in the City Hall, reference to which 1s hereby made for a full and detailed deacr1pt1on of said propoBed work and for further particulars. 5. There is hereby excepted from the work above described any of such work already done to line and grade, and marked excepted or shown not to be done on the plans, prof'iles and specificat1ons. 6. The Council does hereby adopt and establish as the grades for said work the grades and elevations shown upon said plans and profiles, to which reference is hereby made for a d~scr1pt1on there- of. All such grades and elevations are 1n feet and decimals there- of in reference to the official base and datum of said City. In many cases said grades are new or different t'rom the surface of the ground. 7. All or said work and improvements shall be done 1.mder the superv1s1:m of the City Engineer and all said work and materials ahall be done and fu.rn1ahed to his aat1sfact1on. 361 9. Notice is hereby given that, pursuant to Section 2 of Article V of Ordinance No. 844 of said City, commonly dea1gnated 11 Palo Alto Improvement Procedur·e Code", adopted January 13, 1941, the City Engineer has filed with the City Clerk, accompanying the plans and spe~1f1cat1ona above referred to, a statement of the total and 1 tem1zed est~.ma·ted cost of said improvements, inclusive of incidental costs and expenses of this proceeding, stating there- 1n separately the estimated cost or ea~h class or construction pro- posed, and the incidental expenses such as engineering and inspec- tion, and the cost of preparing proceedings, the total estimated cost or which is stated as $37,707.90, which is open to pub-lic inspection. 10. Said contemplated improvements, in the opinion of this Council_. are o!' more than local or ordinary public benefit, and the cost and expense of doing said work and the expenses incidental thereto, ahall be made chargeable upon the district benefited there- by, the exterior boundaries of wh:tch are described as follows: Beginning at the intersection of the centerlines of Bryant Street and Hamilton Avenue, thence southwesterly along the centerline of Hamilton Avenue to the centerline of Alma Street, thence southea.sterly along said centerline of Alma Street to the centerline of Cha~ning Avenue, thence northeasterly along said centerline of Channing Avenue to the centerline or Ra.mona Street, thence southeaste...-ly along said centerline of Ramona Street to the centerline of Addison Avenue, thence southwesterly along said centerline of Addison Avenue to the centerline of Emerson Street, thence south- easterly along said centerline of Emerson Street to the centerline of Embarcadero Road, thence northeasterly along said centerline of Embarcadero Road to the centerl!ne of Melville AvenMe thence northeasterly along said centerline of Melville Avenue to the point of 1ntersection with the southeasterly extension of the centerline of Scott Street, thence northwesterly along said aoutheasterly extension or the centerline of Scott Street to the centerline of Addison Aveniie, thence southwesterly along said centerline of Addison Avenue 137 .5 feet, therice northwesterly parallel to B1-yant St~eet to the centerline of Channing Avenue 1 thence northeast- erly al<:>ng said centerline of Channing Avenue 137. 5 feet to the northwesterly extension cf' the centerline of Scott Street, thence northwea terly along aa.1d northwesterly ex- tension or the centerline or Scott Street and parallel to Bryant Street to ·a point 150 feet northwesterly from the northwesterly line of Homer Avenue; ·thence southwesterly parallel to Homer Avenue 100 feet; thence northwesterly parallel to Bryant Street 50 feet; thence northeasterly parallel to Homer Avenue 100 feet to ;;he southeasterly ex- tention of the center line of Gilman Streetj thence north- westerly along Ba1d southeasterly extension of the center- line of Gilman Street to the centerline or Forest Avenue, thence southwesterly along said centerline of Forest Avenue to the centerline of Bryant Street, thence northwesterly· along said centerline of Bryant Street to the centerline of Hamilton Avenue and the point of beginning. . 362 ~· .;:. ~· The properties eo benefited, and the boundaries thereof, are more particularly shown on the ~ap of said assessment district on file in the office of the City Clerk, to which reference is hereby ~ade for a more detailed description thereof. 11. Notl.ce 1a further given that there is on file with the City Clerk a diagram of the assessment district showing each lot or st:.bd1 v1e1on of land to be assessed and the dimensions thereof, and an aeseaament of' the estimated cost of said work and improve- ments upon said. lots and parcele according to benefits to be re- ce1 ved from said work and lmpro\rements, each of which have corre- sponding numbers of each such lot or P'rcel. 12. A:tl publicly owned property in said assessment district, shall be assessed for 1ta share of the cost of said benefits and the amount thereof paid in caeh by the City. All public streets, alleya and ways 1n use 1n the .performance cf the public function shall be omitted from the assessment hereinafter to be made to cover the cost of said improvement. 13. Notice is hereby given that 3er1al bonds to represent the unpaid assessments and bear interest at the rate of not to exceed 1"our per cent (4%) per annum, will be 1asued pursuant to Part 4, Bond Plan C of Article IV of the Palo Alto Improvem·~nt Procedure C·:ide, the last installment of which shall mature nlne (9) years from the second day of July next succoeding ten months from their du tt'. 14. Except as here1ri otherwise provided for the issuance of bo·nds, all of the above proposed work shall be done 1n pursuance of th~ provisi.ona of Article V of ~aid Palo Alto Improvement Pro- cedure Code. 15. Proceedings have been had .':lnd taken by said Council in f:.111 compliance with the provisions of Article I of said Palo Al to Improvement Procedure Code. 16. Notice !s hereby given that Monday, the 12th day of May, 1952, at the hour of 7:30 o'clock P.M. at the Council Chambere, City Hall, Palo Alto, California, is hereby fixed as the tlme and place when and where any and all persons having any ob- jections to the ?reposed improvements or against the district to be assessed for the costs and experieee thereof, or to the Ci t~r Engineer'n estimate of the costs and expenses thereof, or against t.he grades at which satd worl-c shall bt~ done, or against the diagram or assessment, may appear before said Co~ncil and show cause why said proposed improvements should not be carried out 1n accordance with this Resolution of Intention. 17. The City Clerk shall cause this Resolution of Intention to be publiehed twice in the Palo Alto Times, a daily newspaper, pub- lished and circulated in the City of Palo Alto, which said paper is hereby d~?eignated for that purpose, and which is hereby desig- nated as the t'!(!Wspaper in which all rur-ther notices required to be made herein shall be published. * * * * * * * * I hereby certify that the above and foregolng resolution was duly and regularly adopted by the Council or the City of Palo Alto, California, at a regular meeting thereof held on the 28th day of April, 1952, by the following vote or the members thereof: ~1 ~j ~ l l • f.
