In 1ts opinion the public interest, convenience and necessity require .• and that it 1s the 1ntent:1.on of said Council to order the tollowi~.g work to be done and improvements to be made 1n aa1d ~1ty, to-wit: (.a) The improving of Bno1na Avenue from Bl Camino Real to the Southern Pacific Railroad Right or Vay 'by grading, removal of trees and ex1at1ng atructurea, constructing or reconstructing Portland cement concrete ourba, gutters, sidewalks, driveway apron•, atorm water drain pipe, ca.tcti baaina and manholes, con- structing crushed rock base pavement and wearing surface, and constructing sanitary sewer, water, and pa aerv1ces. {b) Tho 1mpr-,i1ng of Homer Avenue and, Vells Avenue irom El Camino Real to Ur'ban Lane and Urba.n Lane from Homer Avenue northwesterly 325 1 .. eet more or less by grading, removing trees and existing structures, constructing or reconstructing etorm water catch b&airus, manholes,, and appurtenances, construoM.ng crushed rock base pavement and a standard wearirlg surface, and construct- ing sanitary sewer, water, and gag serv1cee. (a) The construction of all work auxiliary to the above and which may be necessary to carry out the same. ~, 2. Whenever any public way is herein referred to as running be- tween two public ways, or from or to any public way, the intersec- tionrs or the public ways referred to are included to the extent that work shall be shown on the plans to be done thereon. 3. Said streets, avenues, roads, courte, and rights or way are mo:re particularly shown in the records of the oi'fice of the County Recorder or Santa Clara County, California, and are shown upon the plans herein referred to and filed w1~h the City Clerk. 4. All of aaid work and improvements are to be constructed at the places and in the particular locations, or the rorms, sizes, dimensions and materials, and to the 11ne8 and grades, and at the elevations, as shown and delineated upon the plans, profiles and spec1fioationa made therefor and preliminarily approved by the· Council at a regular meeting thereof' duly held on the 24th day of March, 1952,, and on file in the office or the City Clerk in the City Ha.ll,, reference to which 1.e hereby ms.de for a full and detailed description or said proposed work and for :urther particularB. 5. There is hereby excepted from the work above described any of such work already done to line and grade, and marked excepted or shown not to be done on the plane, profiles and speo1f1oat1ons. 6. Notice is hereby given ot the fact that 1n uny eases 5a1d work and improvements will bring the finished grade to a grade different from that formerly existing, and that to said extent said grades are htr,aby changed and that said work will be done to said changed grades • 8. City, commonly dea1gnated "Palo Alto Improvement Procedure Code", adopted January 13, 1941, the City Engineer has filed with the C1ty Clerk, accompany- ing the plans and specifications above referred to, a statement of the total and itemized estimated cost or said improvements, inclusive of incidental coste ~nd expenses or this proceeding, stating therein separately the estimated cost or each claes or construction proposed, and the incidental expenses such as engineering and 1napect1on, and the cost or pre\)&ring proceedings, the total estimated coat of which 1s 3tated ae J34,9-9.92 which is open to publie 1nepect1on. 10. Said contemplated 1mproTementa, 1n the opinion or th1a Council, are or more than local or ordinary public benefit, and the cost and expense or doing said work and the expenses incidental theretoJ shall be made chargeable upon the district benef'.ited thereby, the exterior boundaries or which ar•~more particularly shown on the aap or said aeaeaament district on tile in the office of the City Clerk, to which reference is hereby :raade !'or e. more detailed de1cr1p·t1on thereof. 11. Notice 1a further given that there 1• on file with the City Clerk a diagram or the assesement district showing each lot or subd1v1e1on or land to be assessed and the d1mana1ons thereot, and an amaeaeaent or the estimated coat or said work and improvements upon said lots and parcels according to bene-r1 ta to be r0ce1ved trom eaid work and 1111>rove .. nts, each ot which have corresponding numbers or ea~h such lot or parcel. 12. All publicly owned property in said aaaeaaaent d1etr1ct, shall be assessed tor its aha.re or the coat or said benefits and the amount thereor p~1d in cash by the City. Proceedings have been had and taken by said Council in full compliance with the prov1e1ons or Article I or ea1d Palo Alt~ Improvement Procedure Code. 16. Notice is hereby given that Monday, the 14th day of April, 1952, at the hour or 7:30 o~clock P.M. at the Council Chambers, City Hall, Palo Alto, California, is hereby fixed as the t1me and place when and where any and all persons having any objections to the proposed improvements or against the district to be assessed tor the costs and expenees thereof, or 349 to the City Engineer's estimate or the costs and expenses thereof, or against the grades at which said work sh.all be done, or againet the diagram or assessment, may appear before said Council and show cause why 3a1d proposed improvements should not be carried out in accordance with this Resolution or Intention. 17.
