RESOLVED, by the Council of the City or Palo Alto, Calif"1"'nia,
W!n!!REAS, on February 25, 1952, th1s Council adopted its
Resolution No. 2242 or Preliminary Deter~1nation to make certain·
improvements more particularly described therein and di:!fix
Monds.:r .• March 24, 1052, at the Council Chambers in the City Hall,
a9 the time and place when and where any and all persons inter-
ested may appear and show cause, 1C any they have, why tile
Caru.ncil should not find and determine that the public c11venience
and necessity require the 1mprovementa deacr1'bed and referred to
ln said resolution, without compliance with the Special Assessment
Inventigation, Limitation and Majority Protest Act of 1931;
WHEREAS, notice of the adoption of aaid preliminary resolu-
tion t:md o.f sa1d tim~ and place of hearin1; was given by the C1 ty
Clerk by p1.;bl1cation and posting for ti..e time and in the manner
provided in aa1d Resolution of Preliminary Determination and
Artlcle 1 of the Palo Alto Improvemt:mt Procedure Code, as appears
from affidavits on file with the Clty Clerk;
WHEREAS, no written objections to the undertaking
of so1d procecd:lngs w1 thout ·first co1;iplying with t:ie provisions of
said Invest~gation Act have been filed w~th tte City Clerk at or
before the time f:1.x:ed for this hearing by persons interested,
ownlr.g or having an interest in real p:t•opcrty within the proposed
~s~essment district, bearing th~1r oignature, a description of
their property, and a statement of the nature of their 1ntere~t
therein; and
WHEREAS, all persons intereatc-d have been given an oppor-
tunity to be and were fully heard, and said Council has duly con-·
s1dered any and all objections and proteats made, and the said
proposed improvements .. and the publ:ic convenience and necessity
for making same.
NOW J THEREFORE, rr IS .F01JND, DETERMINED AND ORDERED, AS
FOT...LOWS:
1. The public convenience and necessity require the
improvements described :tn sald Resolution. of Preliminary Deter-
m1nat1on;
2. Any and all objections and protests made pursuant to
aaid Resolution o:i' Preliminary Determination are hereby,over-
ruled and denied;
3. The 1mprovem6nts described in said Resolution shall be
made under and pursuant to the provislons of the Palo Alto
Improvement Proced·ure Code more particularly rei'erred to in
said Resolution, and the Special A38essment Investigation,
11m1t~t1on and Majority Protest Act of 1931 shall not apply
to said proceedings.
