OVERRU'LING PROTESTS AND D&TRRMININO
TO PROCEED WITHOUT COMPLIANCE WITH
Ih'VF.STIOATION ACT

RF.SOLVED, by the Council of the City of Palo Alto, California,
WHEREAS, on November 26,, 1951, this Co:!.ncil adopted lts
Resolution No. 2186 of Preliminary Determination to make certain
improvements mer.a particularly desc::-1bed therein and did fix Mon-
day, January 28, 1952, at t~e Council Chambers in the City Hall,
as the t1mc and place when and where any anct all persons interested
may appear and show cause, if any they have 1, why the Council should
not find and determine thn t the public convi:.m1er.ce and n(?cese1 ty
requ1r~ the improvements deacr1bed and referred to 1n said resolu-
tion, without compliance with the Special Aeseaament Investigation,
L1m1tat1on and Majority Protest Act of 1931;
WHEREAS, on January 28, 1952, said Council adopted 1ts Reso-
lution No. 2214 of Intention to Modify Preliminary Proceedings
by mal-:-1ng ce:rtain changes more pa.rticularly described therein and
did fix Monday, February 11, 1952,. at the Council Chambers in the
City Hall, as the time arid place when and where any and all persons
interested may appear and show cause, 1r any they have, why the
Council sho1J.ld not find and determine that the public ~onven1ence
and necessity require the improvements described and referred to
in said resolution, without compliance with the Spec1p.1 Asses3ment
Investigation, Limita.tion and Majority Protest Act of 1931;
WHEREAS, notice of the adoption or said preliminary resolu-
tions and of said time and place of hearlng was given by the.City
Clerk by publication and posting for the time and 1n the manner
provided in aa1d Resolutions and Article I of the Palo Alto Improve-
ment Procedure Code, as appears from aff1dav1te on file with the
City Clerk;
WHEREAS, written objections to the undertaking or
ea1d proceedings without first complying with the provisions of
said Investigation Act have been filed with the City Clerk at or
before the time fixed for this hearing by persons interested, own-
ing or having an intereat in real property within the proposed
assessment d1str1ct, bearing their signature, a description of
their property, and a statement or the nature or their interest
therein; and
WHEREAS, all persons interested have been given an opportunity
to be and were fully heard, and sa1d Council has duly considered
any and all objections and protests made, and the said proposed
improvements, and the public convenience and neeeesity for making
same,and has ordered mod1f1cat1on of said preliminary procee~1ngs
in accordance with sa1d Resolution of Intention to modify.
NOW~ THEREFORE, IT IS FOUND, De'TER.MINED AND ORDERED, as
follows:
l. The public convenience and necessity require the improve-
ments described in said Resolution of Prell.m1nary Deter~ination
as modified;

2. Any and all objectione and protets mllde pursuant to sa1d
Resolution of Pr411minary Determination and said Resolution or
Intention to modify are hereby, overruled and denied;
3. The improvements deecr1bed in eaij Resolution as modified
shall be made under and pursuant to the prov1sione of the Palo Alto
Improvement Procedu~e Code more particularly referred to 1n said
Resolution, and the Special Aeeeesment Investigation, L1m1tat1on
and MaJority ltt>test Act of 1931 shall not apply to said proceedings.

was duly and regularly a.dopted by the Council or the City or Pa.Jo
Alto, Ca11f.orn1a, at a regular meeting thereof held on the 24th
day or March, 1952, by the following vote of the members thereof:
