RESOLVED, 'by the Council or the C1 ty of Palo Al to,, Ca.l1forn1a,
WiiltREAS, the Council did on the 11th day of February, 1952,
adopt its Resolution of Intention No. 2223 to order certain
acquisitions and improvements to be made in eaid City, under and
purau.~nt to Article V of Ordinance No. 844 or said City, adopted
January 13, 1941, entitled "Palo Alto Improvement Procedure
Coden, and to 1ssue bonds pursuant to Part 4, PJOnd Plan c or
Article TV of said Ordinance No. 844, referen~e to which resolution
13 hereby made for a particular description of the acquisitions
and improvements to be made, th~ boundaries of the assessment
d1str1ct and the bonds to be issued;
WHEREAS, ea1d Resolution of Intention No. 2223 has been duly
published twice in the Palo Alto Times, a newapaper or general
circulation printed and published in said City, wherein all persons
interested having any objections to the proposed aequ1s1tions
and improvements or against the district to be assessed for the
co&ts and expenses thereof, or against the grades at which said
work shall be done, or to the Engineer's estimate or the costs
and expenses thereof, or against the diagram or assessment, were
notified or the time and place of the hearing as contained 1n
said reso~ution of intention; said resolution wae duly published
within the t1rne and in the manner provided in said Improvement
Pr-0cedure Code, and as directed by said reeolut1on or intention,
as appears from the affidavit of publication on file 1n the office
or the City Clerk of 8a1d City;
WHEREAS, at the time and place fixed for said hearing no
protestB or object1one were made or presented to the proposed
acquisitions and improvements, or to the district to be assessed,
or to the gr•ades at which said work was to be done, or to the
bonde to be issued to pay the costs and expenses thereof, or
to the Engineer's estimate or the coats and expenses thereof, or
against the diagram or assessment, and all persons interested
desiring to be heard were given an opportunity to he heard, and
all matters and things perta1n1ng to sa1d propoeed acquisitions
and improvements were duly heard and eonsidered by said Council,
and said Council has acquired jurisdiction to order said acqui-
a 1 t1ons and improvements and to confirm said assessment to pay
the costs and expenses thereof;
NOW, THEREFORE, eaid Council does hereby FIND, DETERMINE
and ORDER, as follows:
1. That the plans and specifications for street improve-
ments und~r said Resolution or Intention, as modifie•, be, and
they are hereby, finally adopted and approved as the plans and
epec1f1cat1ons to which said work and improvements shall be done
ae called tor in said Resolution of Intention.
2. That the Engineer's eet1ma.te of the 1tem1ze<1 and total
estimated cost end expeneee for said acquisitions and improvements

as modified, be, and 1t is hereby, finally adopted and approved
as the !ng1neer'e total and detailed estimate of the eoste and expenses or said acqu1e1t1ons and improvements.
3. All public streets, alleys and w-ys in use 1n the per-
formance or the public function shall be omitted from the aaeess-
ment hereinafter to be made to cover the co!t of ea1d acqu1s1t1one and improvements.
4. Tha +; the maps and descr1p·t1one of the lands and ease-
ments to be acquired be, and they are hereby, finally adopted and approved.
5. Tha'f; the public interest and convenience require, and
said Council does hereby o,.der the acrqu.1s1t1ons and improveinents
to be made as described in ~md in accordance with said Resolution
of Intention on file in the orr1ce of the City Clerk of aa1d
City, as modified, reference to which 1n hereby made for a more
pa.rt1eular description or ea.id aequie1t1ons and 1mprovemente and
also 1·or further particular, pursuant to the provisions of Article
V or said Impro'!ement Procedure Code.
6. That the map of the aeses:sment district as mod1f'1ed, be,, and the same 1e hereby finally adopted and approved as the map or the aasesement district, and the boundary of said assessment
d.1.strict as shown thereon is hereby determined and established
to be the boundary or the aeaessm~nt district to pay for the
coets and expenses or said acqu1a1t1ons and improvements.
7. That the asseeBment and diagram ror the coet arid ex-
-,ensee of the acqu1s:1t1on and 1mprovemente described in said
Reeolut1on or Intention as modified, be, and the same is hereby,
rat1 fied, approved and con!'i?med as the assessment and diagram
to pe.y the costs and expenses or said acqu1s1t1onB and 1mprovementR.
8. That the City Clerk or said City shall deliver sa:td
diagram and aeseesment to the Superirtendent or Streets of said.
City, together with a certified copy of this resolution thereto
attached, and aa1d Superintendent or Streete shall thereupon
record such assessment and di~~ram in his office 1n a suitable
book to be kept for that purpose and append thereto his certifi-
cate of the date of such recording, and such record shall be the
assessment roll to pay for the costs and expenses of sa1d a.cqul-· s1t1ona and improvements.
9. Immediately upon such racordation said Superintendent
of Streets shall giv~ notice thereof by two publications in the
Pa lo Al to Tl mes, a newspaper of gene1•al circula t1on printed and
published 1n sa1d C1ty, which notice shall set forth, among other
things, that all sums assessed therein are clue and payable at
his office 1mmed1ately, and that payment thereof is to be made to
h1m w1th1n thirty days after the date of recording said aseess-me~it, which date shall be a·tated ir: sa· .. a noti.ce, and such other
matters as are requ.ir(~d by Section 7 of Artj.cle V of said Impr.'.)vement Proced·ure Code.

I hereby certify the foregoing to be a t.rue copy of resolution
adopted by the City Council of the City of Palo Alto, California,
at a regular meeting thereof held on the 24th day of March, 1952,
by the following vote or the memb<~rs thereof'~
