DETERMINING CONVENIENCE AND NECESSITY AND
ORDERING CH.. ~Q!!:S AND MODIFICATIONS
PROJECT NOo 51-15
LOMA VERDE AVENUE, ET AL
ACQUISITION AND IMPROVEMENT
RESOLVED, by the City Council or the City of Palo Alto, California, that
WHEREAS, on March 10, 1952, this Council adopted its
Resolution No. 2252 or Preliminary Determination and or Intention
to Make Changee and Mod1f1catione, wherein it did prel1m1nar1ly
determine that the public interest, convenience and necessity
require, and that it intends to order certain changes and modifi-
cations, therein particularly described, in the work to be done
and proceedings being conducted under Resolution No. 2184 of
Preliminary Determination, adopted November 26, 1951, and Resolu-
tion No. 2221 of Intention, adopted February 11, 195Z; and
WHEREAS, pursuant to said Resolution No. 2252, notice has been duly given of the time and place when and where said C~unc11
will consider and finally determine whether the public interest,
convenience and necessity require said changes, and when and where
1t will consider and finally act upon the matte?' of making said chang~s and mod1ficat1ons and when and where it will hear all pro-tests in relation thereto; and
WHEREAS, no written objections to the undertaking of said
proceedings ~1thout first complying with the provision of said
Inveetigat1on Act have been filed with the City Clerk at or
before the time fixed for this hearing by persons interested,
owning or having an interest 1.n, real property w.'Lthin the proposed
assessment d1etr1ct, bearing their signature, a description of
their property, and a statement or the nature of their interest therein; and
WHEREAS, all persons interested have been given an opportun-
ity to be and were fully heard, and said Council has duly con-
sidered any and all objections and protests made, and the said
proposed improvements, and the public convenience and necessity for making same.
NOW, THEREFORE, IT IS FOUND, DETERMIN!t'D and ORDERED, as i'ollows:
1. The public convenience and nec.easi ty require the improve-
ments described 1nsa1d Resolution No. 2252 of Preliminary Determina-
tion and or Intention to Make Changes and Modifications.
2. Any and all objections and protesto made pursuant to
the sa1d Resolution are hereby overruled and denied.
3. The work and proceedings under Resolution Ne. 2184 of
Preliminary Determination and Resolution No. 2221 of Intentiori
are hereby modified to include the impro\•ements and mod1f1cat1ons
described in ea1d Resolution No. 2252 of Preliminary Determination
and or Intention to Make Changes and Mod1f1cat1ons, and the
Special Assessment Investigation,, !..imitation and Majority Protest
Act of 1931 shall not apply to said proceedings.
