R E S 0 L U T I 0 N N 0 • ------------ OR PRELIMINARY DE'I'ltRMINATION PROJEC'l1 NO. 52-4 ENCINA AVB., ET AL 309 2242 RESOLVED, by the Council or the City of Palo Alto# California, that it does hereby pre11m1nar11y determine that the public con- venience and necessity require, and that 1t intends to order the following improvements to be made in and for said City,, to-wit: l(a) The improving of Rnc1na Avenue from Bl Camino Real to the Southern Pac11·1c Railroad Right or Way. by grading, removal or trees and existing structures, constructing or reconstructing Portland cement concrete curbs, gutters, sidewalks, driveway aprons, storm water drain pipe, catch basins and manholes, con- structing crushed roek baae pavement and wearing surface, and constructing sanitary sewer, water, and gs.a services. (b) The improving of Homer Avenue and Wells Avenue from El Camino Real to Urban Lane and Urban Lane from Homer Avenue north- westerly 325 feet more or less by grading, remov1ng treee and existing structures, constructing or reconstructing storm water catch basins, manholes, and appurtenances, constructing cruahed rock base pavement and a standard wearing surface, and construct- ing sanitary sewer, water, and gas services. (c) The construction or all work auxiliary to the above and which may be required to carry out the same. 2. There is hereby excepted from the lbove work that which is already done to line and grade. 3. Notice is hereby given of the fact that in many cases said work and improvement w111 bring the finished surface 01' the im?roved streets to a grade different from the surface of such streets as they now exist, and that to said extent said grades are hereby changed and that said work will be done to said changed grades. 4. All of said work shall be done under the supervision of the 61ty Engineer of the City of Palo Alto, and all or said work and materials~ shall be done and 1'urn1ahed to h.ts sa t1sfact1on. 5. Said coritemplated work and improvements are or more than local or ordinary public benefit, and the cost and expense of doing said work and the expenses incidental thereto, shall be made chargeable upon the district benefited thereby, the boundaries of which are more particularly shown on the map or said assessment district on file in the office or the City Engineer of said City, to which reference is hereby made for a more detailed description thereof. 6. Notice is hereby given that serial bonds to represent the unpaid assessments and bear interest at the rate ofnot to exceed four per cent (4%) per annum, will be issued pursuant to Part 4, Bond Plan C of Article rv or the Palo Alto Improvement Procedure Code, the last installment of which shall mature nine ( 9) years !'1-r.un the second day or July next succeeding ten months from their date. 7. Notice 18 hereby given that Monday, the 24th day of March, 1952, at the hour of 7:30 P.M. at the Council Chambers of the City Coullc11 or said City in the C1ty Hall or sa1d City are hereby fixed as the time and place when and where any and all persons interested may appear and ohow cause, 1r any they have. why the City Council should not f1nd and determine that the public tonvenience and necesa1ty require the improvements deecr1bed and referred to in this resolution, without further compliance with the Special Assessment Invest1.gat1on, Limitation ~nd Majority Protest Act or 1931. 9. The Clerk of the City or Palo Alto shall give notice of the adoption ot th1s resolution by publishing a Notice or Pro- pose1 Local Improvement once in the Palo Alto Times, a daily newspaper publ1ohed and circulated 1n said City, and by posting same on or near the Council Chamber door or said Council, said posting and publication to be had at least ten days before said date or hearing. * * * • .. * I hereby certify the foregoing to be a true copy or resolution adopted by the City Council o!' the City of Palo Alto, California, at a regular meeting thereof held on the 25th day of February, 1952, by the following vote of the members thereof: :.,,.
