ACQUISITION AND IMPROVIMBNT
RESOLVED, by the Council of the C1ty of Palo Alto, Calif-
ornia, that
1. In its opinion the public interest, convenience, and
necessity require, anJ that 1t is the intention of said Council
to order tha following work to be done and 1mprove11enta to be
made in 8&1d City, to wit:

l(a) The improving or Loma Verde Avenue from Alma Street
to Middlefield Road, Bl Carmelo Avenue rrom Alma Stre~t to
Waverley Street, Bryant Street and South Court from Matadero Canal
to Loma Verde Avenue, Waverley Street from Matadero Canal to the
Stanford University Villa Tract, and Cowper Street from Matadero
Canal to the Southeasterly line or Tuolumne Park, by acquiring
and abandoning easements necessary to attain uniform 60-root
width on all the foregoing streets except Waverley Street, where
no acqu1s1tione or abandonmente will be had, and Loma Verde Avenue
rrom a point approximately 150 feet northerly or Ramona Street to
Alma Street, where easements necensary to attain uniform 65-root
width w.111 be acquired, and by grading, removing trees and/or
existing structures, constructing Portland cement concrete side-
walk, curbs and gutters, conetruct1ng crushed rock bane pavement
and aaphalt1c concrete wearing surface~ conatruct1ng storm water
catch basine, manholes, drain pipe and appurtenances, construct-
ing vitrified clay pipe .sanitary aewer laterals, copper or gal-
vanized iron pipe water services, and wrapped steel pipe gas
services, &nd installing electrolier-a complete with Portland
cement concrete baeee and with underground conduit and conductor
cable.
{b) The constructirm of storm water catch baa1ne, man-
holes, drain pipe and appurtenances in M1ddlet1eld Road from
Ms.tadero Canal to Dry Creek, in Cowper Street rrom the south-
easterly line of Tuolumne Park to Dry Creek, and 1~ Loma Verde
Avenue from Middlefield Road to the northeasterly line of
Sterling Garden~, Unit No. 1.
(c) The construction or all work auxiliary to the above
and which may be required to carry out same.
2. Whenever any public way is herein referred to as runn-
ing between two public ways, or from or to any public way, the
intersections or the public waya referred to are included to the
extent that work shall be shown on the plans to be done thereon.
3. Said streets, avenues, roads, courts, and rights or
way are more particularly 1ho~1ng the records or the orr1ce or
the County Recorder or Santa Clara County, Cal1torn1a, and are
ahown upon the plans herein referred to and filed with the City
Clerk.
4. All of aaid work and improvements are to be constructed
at the places and in the particular locations, or the torms,
sizes, dimensions, and materials, and to the line! and grades,

and at the elevatione, as shown and delineated upon the plans,
prot1lea, and spec1f1cat1ons made therefor and prel1~1nar1ly
approved by the Council at a regular 1teeting thereof duly held on
the 11th day or February, 1952, and on file in the orr1ce or the
City Clerk in the City Hall, reterenoe to which is hereby made ror
a full and detailed description or said propoeed work and tor
further particulars.
5. There is hereby excepted from the work above described
any of such work already done to lifle and grade, and marked excep-
ted or shown not to be done on the plana, ~rotilea, and apecifica-
tione.
6. The Council does hereby adopt and establish as the
grades tor eaid work the grades and elevations shown upon said
plane and profiles, to which reference ia hereby made tor a descrip-
tion thereor. All such grades and elevations are 1n feet and
decimals thereof in reference to the ort1c1al base and datum of
aa1d City. In many cases said grades are new or different from the
aurraee of the ground.
7. Notice is hereby given or the ract that in many cases
said work and improvements will bring the finished grade to a
grade different from that formerly ex1et1ng, and that to said
extent said grades are hereby changed and that said work will be
done to ea1d changed grades.
8. All of said work and improvements shall be done under
the supervision or the City lllgineer, and all said work and
materials shall be done and turn1ehed to his sat1efaet1on.
9. Notice is hereby given that,, pursuant to Section 2
or Article V or Ordinance No. 8-~ of said City, commonly desig-
nated "Palo Alto Improvement Procedure Code", adopted January 13,
1941, the City Engineer has filed with the City Clerk, accompany-
ing the plans and spee1f1cations above referred to, a statement
or the total and itemized estimated cost or said improvements,
inclusive or incidental costs and expenaee of this proceeding,
stating therein separately the estimated cost of each class of
construction proposed, and the incidental expenses such aa engin-
eering and 1nspect1on, and the cont of preparing proceedings, the
total estimated cost or whieh is stated as $327,465.65, which is
open to public inspection.
10 .. Said contemplated acqu1s1t1ons and improvements, in the
opinion of this Council, are of more than local or ordinary pub-
lic benefit., and the co8t and expense or doing said work and the
e:xpense3 incidental thereto, shall be made chargeable upon the
d1str1ct benefited thereby, more particularly shown on the map
of said assessment district on r11e in the orr1ce ot the City
Clerk, to which reference is hereby made for a more detailed
description thereof.
11. Notice 18 further given that there is on file with the
City Clerk a diagram or the aaseeamen·t di:strict showing each
lot or subdivision or land to be assessed and the d1mene1ons
thereof, and an assessment or the estimated coat ot said work
and improvements upon said lots and parcels according to benefits
to be received from said work and improvements, each of which
have corresponding numbers or each such lot or parcel.
12. All public streets, alleys, and ways in use in the
performance or the public functions shall be omitted from the
assessment hereinafter to be made to cover the cost ot said im-
provement.

13. Notice ia hereby given that aerial bonds to represent
the unpaid assessments and bear 1ntereet at the rate or not to
exceed tour per cent (4~) per annwt1 wtll be 1aaued pursuant to
Part 4, Bond Plan C of Article IV of the Palo Alto Improvement
Procedure Code, the last 1nsta1111&nt or which shall mature nine
(9) years trom the second day or July next aucceed.1ng ten 110nth8 rrom their date.
14. Except as herein otherwise provided tor the ieeuance ot bonds, all or the above proposed work shall be done in pursu-
ance or the proV1aions or Article V of said Palo Alto Improvement Procedure Code.
15. Proceedings have been had and taken by said Council 1n
full compliance with the provisions or Article I or said Palo Alto Improvement Procedure C0de.
16. Notice ia hereby given that Monday I the 25th day or
February, 1952, at the hour ot 7:30 o'clock P.M. at the Council
Chambers, City Hall, Palo Alto, Cal1fornta, is hereby fixed as the
t1me and place when and where any and all persona having any
objections to the propoeed improvements or against the district
to be assessed for the coat .. and expenses thereof', or to the City
Engineer's estimate or the coats and expenses thereof, or against
the grades at which s~id work shall be done, or against the
diagram or assessmer.t, may appear betore the Council and show
cause why said proposed 1mproven.ents should not be carried out 1.n accorda.nc~ with this Resolution ot Intention.
17. The City Clerk shall cause this Resolution or Intention
to be publj.ahed twice 1n the Palo Alto T1mea, a daily newspaper,
published and circulated in the City of Palo Alto, which said
paper is hereby dee1gnated ror that purpose, and which is hereby
designated as the newspaper in which all further notices required to be made herein shall be published.

I hereby certify that th.e above and foregoing resolution
was duly and regularly adopted by the Council or the City or
Palo Alto, California, at a regular meeting thereof held on
the 11th day or February, 1952, by the following vote or the members thereof:
