OVERRULING PROTESTS AND DETERMINING TO PROCHKO
WITHOUT COMPLIANCE WITH INVESTIGATION ACT
HOMER AVE. , ET AL
PROJECT NO. 51-16
ACQUISITION AND IMPROVEMENT
RESOLVED, by the Council of the City of Palo Alto, Cali-fornia, that
WHEREAS, on November 26, 1951, this Council adopted 1tG
Resolution No. 2185 of Preliminary Determination to make cer-
tain acquisitions and improvements more particularly described
therein and did fix Monday, January 28, 1952, at the Council
Chambers in the City Hall, as the time and place when and where
any and all persons intere3ted may appear and show cause, if
any they have, why the Council should not find and determine
that the public convenience and necessity require the acquisi-
tions and improvements described and referred to in said
resolution, without compliance with the Special Assessment In-
vestigation, Limitation a.nd Majority Protest Act of 1931;
WHERE.AS~ notice of the adoption or said preliminary resolu-
tion and of said time and place of hearing was given by the City
Clerk by publ1cat1on and posting for the time and in the manner
provided in said Resolution of Preliminary Determination and
Article l of the Palo Alto Improvement Procedure Code, as
appears from affidavits on file with the City Clerk;
WHEREAS written objections to the undertaking of
said proceedings without first complying with the provisions of
said Investigation Act have been filed with the City Clerk at or
before the time fixed for this hearing by persons interested,
owning or having an interest 1n real property within the proposed
assessment district, bearing their signature, a description of
their property, and a statement of the nature of their interest
trerein, and
WHEREAS, all persons interested have been r;1ven an oppor-
tunity to be and were fully heard, and said Council has duly con-
sidered any and all objections and protests made, and the said
proposed acquisitions and improvements, and the public conven-
ience and necessity for making sa.me.
NOW, THEREFORE, IT IS FOUND, DETERMINBD AND ORDERED, s.s
follows:
l. The public convenence and necessity require the acqu1-
s1 tions and improvements described :tn~a.1d Resolution of Prelim-
inary Determination; ·
2. Any and all objections and protests made pursuant to
said Resolution of Preliminary Determination are hereby, over
ruled and denied;
3. The acquisitions and improvements described in said
Resolution shall be made under and pursuant to the provisions
of the Palo A2to Improvement Procedure Code more particularly
referred to in said Resolution, and the Special Assessment In-
vestigation, Limitation and Majority lmtest Act of 1931 shall
not apply to said proceedings.

Palo Alto, California, at a regular meeting thereof held on the
28th day of January, 1952, by the following vote of the
