R E S 0 L U T I 0 N N 0 • 2212 ---------- OVER.RULING PROTESTS AND DETERMINING TO PROCEED WITHOUT COMPLIANCE WITH INVESTIGATION ACT LOMA. VERDE AV!. I ET AL PROJECT NO. 51-15 ACQUISITION ANl' IMPROVEMENT RESOLVED, by the Council 01~ the City of Palo Alto, Califor- nia., that WHEREAS, on November 26, 1951, this Council adopted its Resolution No. 2184 of ·Preliminary Determination to make certain acqu1e1t1ona and improvements more particularly described there- in and did f1x Monday, January 28, 1952, at the Council Chambers in the City Hall, as the time and place when and where any and all persons interested may appear and show cause, if any they have, why the Council ghould not find and determine that the p~blic convenience and necessity require the acquisitions and improvements described and referred to 1n said resolution, with- out compliance with the Special Assessment Inveet1gat1on, L1m1ta- t1on and Majority Prote~t Act of 1931; · WHERE.AS, notice of the .adoption or said preliminary re3olu- t1on and of said time and place or hearing was given by the City Clerk by publication and posting for the time and in the manner provided 1n said Resolution of Preliminary Determination and Article 1 of the Palo Alto Improvement Proced.ure Code., as appears from affidavits on file w1th the City Clerk; WHEREAS, written objections to the undertaking or said pt"oceedings wit1i'Oiit fj,rst complying w1 th the provisions or said Investigation Act have been filed w:1.th the City Clerk at or before the time fixed for this hearing by persons interested, owning or hav1rig an interest in real property within the pro- posed a5seaement district, bearing their signature, a descr1pt1cn of their property, and a statement of thehature of their in- terest therein; and WHEREAS, all persons interested have been given an opportunity to be and were fully heard, and said Council has duly considered any and all ob,jections a·nd protests made, and the said p1•opoaed acquisitions and improvements, and the public convenience and necessity for making same. NOW, THEREFORE, IT IS FOUND, DETERMINED AND ORDERED, as follows: 1. The public convenience and necessity require the acqui- sitions and improvements described in aaid Resolution of Prelimin- ary Determination; 2. Any and al:t objections and protests maae pursuant to said Resolution of Preliminary Determinat1on are hereby, over- ruled and denied; 3. The acquisitions and improvements described in said Resolution shall be made under and pursuant to the provisions of the Palo Alto Improvement Procedure Code more particularly refer- red to in saj.d Resolution, and the Special Assessment Invest1ga- t1on, Lim:t ta ti on and l"'.a,)or1 ty 'Protest Act of 1931 shall not apply to said proceedings. * * * * * * * * cc rJ': 0: c... --c ~ l .J !
