EXECUTE DEBJ) TO BROPHY, ET UX
WHERBAS, on the 13th day or November, 1951, an agree-ment was entered into between the City or Palo Alto and WILLIAM M.
BROPHY, under which W1111am M. Brophy agreed to pay the coat or
materials, labor and superv1a1on for the !netallat1on or a 30-inch
1ns1de diameter reinforced concrete storm drainage pipe along the
entire length or the hereir.iafter deeor1bed property, not to exceed $3,500.00; and
WHEREAS, said drainage pipe has been installed, and
'Wllliam M. Brophy has paid the cost of said 1natallat1on and
completed all things to be done by him under said agreement;
NOW, THKR.!FORB',the Council of the City of Palo Alto DOE.~ RESOLVE as follows:
That the Mayor and City Clerk be and they are hereby authorized to execute a grant deed on behalf or the City, con-
veying the following described property to William M. Brophy and
Mary H. Brophy: his wife, as joint tenants, with right of
nurv1vorsh1p, sub,1ect to the following reservations:
All that certain real property situate in the City of
Palo Alto, County of Santa Clara, State of California,
described as follows:
PARCEL NO. 1: Beginning at the point of intersection of the present Easterly line of Middlefield Road
(70 feet wide) with the Southeasterly line or Lot l
1n Block 8 as shown upon the map hereinafter re-
ferred to; running thence along the said Easterly
line of Middli!field Road, N. 51° 45• W. 31.288 feet;
thence leaving said Easte?!y line and running
parallel with the said Southeasterly line or said Lot
1, N. 54° 45' E. 320.22 feet to a point 1n·the line
dividing Lots 1 and 2 1n0said Block 8An thence along
said d1v1d1ng line S. 51 45 1 E. 31.2~ feet to the
most easterly corner or said Lot 1; thence along the

hereinafter referred to; running thence along the

running parallel with the said Northwesterly line

point of intersection thereof with the South-
easterly prolongation of the Northeasterly line or

RESERVING to the City an easement for the construction,
operation, repair, relocation and maintenance or a
!ltorm eewer p.tpe line, or lines, and gas and water pipe
11nee, deecr1'bed. as follows:
That certain otrlp or property uniformly 10 feet in
w1dth and perpen61cularly distant 8 feet Southeasterly
from the Northwesterly line of Lot 67 here1nbefore
described 1n Parcel No .. 2 (said Northwe~terly line
being also the center line or that certain 60.00
feet wlde right or way known as Saale Canal), and
extending 1n ~aid Lot 67 from the Northeaeterly line
of M1ddlef1eld Road, a3 wldened to 70.00 feet in
width, to the Southeasterly prolongation of the
Northeasterly line of Lot l hereinberore described
in Parcel No. 1.. The City shall place all pipes
within said eastJment underground and W1111am M. Brophy,
his heirs and assigns, shall have the right to use the
surface of said property, except that no structures
may be erected thereon.
RESERVING to the City an eaeement for the construction,
operation, repa1r, relocation and maintenance of an
electrical and communication pole line and appurtenancee
necessary across the following de~cribed property:
Commencing at a point upon the Northeasterly line
of Middlefield Road as widened to 70 feet in width,
distant theTeon S. 510 45' E, (called S. 520 00'
E. in description of Parcel No. 2) 10.23 feet from
the po1nt of beginning hereinbefore described in
Parcels No. l and No. 2 (the southea5terly line or
Lot l described :tn Parcel No. 1 being co-linear
with the Northwesterrly line of Lot 67 11escr1bed in
Parcel No. 2 and also co-linear with the center
line of that certain 60 feet wide right of way lmown
a~ Se1'le Canal); thence from said po:tnt or commence-
ment N. 430 07 1 56" E. 140.38 feet; thence N. 520
25' 2311 E. 172.42 feet to a po!nt upon the North-
ea3terly 11ne of said Lot 1, d1~tant S. 510 45 1 E.
thereon 5.22 feet from the Northwesterly line of
said right of way.
The above and foregoing resolution was .duly and regular-
ly passed by the City Council at its regular meeting held on
Monday, the 14th day of January, 1952, by the following vote:
