PROVIDING FOR THE ISSUANCE OF BONDS
AMARILLO AVENUE, ET AL
ACQUISITION AND IMPROV'KMRNT
PROJECT NO. 49-10
RESOLVED, by the City Counc11 or the City of Palo Alto, Ca11rorn1a. that

WHEREAS, said Council did on the 9th day of April, 1951,
adopt its Resolution or Intention No. 2089 relating to certain
work to be done and improvements and acquisitions to be made 1n
said. City under and pursuant to the provisions or Article V or
Ordinance No. 844 of said City, adopted January 13, 1941, entitled
"Palo Alto Improvement Procedure Code11 , and did therein px·ov1de
that serial bonds would be issued thereunder pursuant to the pro-
v1aione of Part 4, Bond Plan C of Article rv of said Code, refer-
ence of said Resolution of Intention, as amended, being hereby
expressly made for further particulars;
WHEREAS, on December 26, 1951, the Superintendent of Streets
of said City ot Palo Alto, filed with the Clerk or said City a
complete list of all assessments unpaid therew1der upon the re-
epect1 ve assessment and diagram numl1ere thereon,, wh0reupon said.
Clerk gave notice or th8 filing of said list and fixed in said
notice Monday, the 14th day or January, 1952, at the hour or 7:30
O·'clock P.M. as the time when interested persons might appear
before the City Council of said City, at the regular meeting place
of said Council, City Hall, in said City and show cause why bonds
should not be issued upon the security or the unpaid assesements
shown on said list, all of' which appears from affidavits on file in the office of said Clark;
WHEREAS, no ~rotesta or objections against the issuance or said bonds were presented before or at the time fixed for
said hear111g;
NOW, THEREFORE, IT IS HEREBY RESOLVED, FOUND AND DETERMINED, aa follows:
1. That sa1d list of asseesrnents unpaid filed by sald
Superintendent or St1·eets as aforesaid was at the time of filing
thereof in all respects complete and correct, and that since the
time of f111ng thereof no assessments have been paid and also that
the unpaid assessments in the proceedings duly had and taken under
and pursuant to eaid Resolution of Intention, are as shown on
Exh1b1 t 11 A'' hereto attached and by reference made a part hereof.
2. That for a particular description of the lots bearing
the respect1 ve assessment numbers above set forth s.nd upo~1 :1h1ch
assessments remain unpaid as above stated, severally an~ respec-
tively, reference is hereby made to said assessment and to the
diagram recorded in the o.f:f1oe of the said Superintendent of
Streets after confirmation by said City Council, the several lots
represented by sa1d aaeeasment number8 above set forth being so
numbered and designated upon said diagram and assessment as so
confirmed and recorded, severally and respectively.
3. That the total or ag~regate amount of said assessments unpaid is the Aum or $211,518.55.
4. That bonds shall be issued upon the security or said un~aid asseeemente 1n the amount of $211,518.50 in accordance with

5. :rhat said bor1ds ahall· be issued 1n series, and the un-
paid assessments as shown on said list filed by the Superintendent
of Streets and determined by said City Council, together with the
1.nterest thereon, shall remain and constitute a trust fund for the
redemption and payment of said bonds and of the interest which may
be due thereon, which unpaid asseaements shall be payable in annual
series corresponding in number to the number of series of bond.a
issued, and an even proportion or each assessment shall be
payable in each year preceding the date or inatur1ty for each of the
several aer•:tes of bonds issued, and such proportion of each assess-
ment coming due in any year, together with the annual interest
thereon, shall in turn be payable in installments as the general
taxes of said ~ity on real property are payable, and shall become
delinquent at the same times and 1n the same proportionate amounts
and bear the same proportionate penalties !'or delinquency.
6. That the signatures of the Mayor and Treasurer be impressed
upon aa1C bonds by engraved or lithographed proceBs and,that said
City Clerk physically sign said bonds and affix thereto the cor-
porate seale of said City; the interest coupons affixed thereto
shall be signed by said Treasurer or bear his engraved, printed or
lithographed a1gnatu~e; and such signing and sealing or ea1d:bonds
by s~id officers, and signing or said coupons by said Treasurer
shall constitute and be a sufficient and bonding execution or each
and every one or said bonds and all or the coupons thereof respectiv-
ely. Said bonds shall be eubstant1al.ly 1n the form aet forth 1n
Bond Plan C of Article rv of said Palo Alto Improvement Procedure
