RESOLVED, by the Council of the City of Palo Alto, Califor-
n)a, that
WHERE.AS .• the Coun~il did on the 9th day of April, 1951,
adopt its Resolution or Intention No. 2089 to order certain acq:11-
s i tion:3 and improvement~ to be made in said C1 ty, under and pur-
suant to Article V o:f Ordinance No. 844 of said City, adoptedJanua-
ry 13, 1941, entitled 11 Palo Alto Improvement Procedure Code",
and to issue bonds purst:a.nt to Part 4, Bond Plan C of Art:tcle IV
of said Ordinance No. 844, reference to which resolution is hereby
made for :i particular deacr1ptton of the acquisitions and improve-
ments to be made, the boundaries of the assessment district and
the bonds to be issued;
WHEREAS, :.'laid Resolution of Interition No. 2089, has been
duly published twice tn the PaJ.o Alto Times, a newspaper of general
circulation printed and published in said City, wherein al1 persons
interested, having any objections to the proposed acquisitions
nnd improvements or against the d:L~trict to be assessed for the
cos ts and expenges 'thereof, or against the grad.es at which said
work shall be done, or to the Engineer's estimate of the costs
r.i.r.1 expenses thereof", or against the diagram or assessment, were
notified Cf the time and place of the hearing as contained in s;.~id
resol11tion of intention; said resolution was duly published within
the time and in the manner provided in sa1d Improvement Procedure
Code, ~nd as directed by said resolution of intention, as appears
!"rom the aff:tdavit of publ:i.cat:lon on file in the office of the
City Clerk of said City;
WHF..REAS, at the time and place fixed for said hearing pro-
tests or obJections were made or presented to the propo3e::l acqui-
:.>1 tions and improvements, or to the district to be assessed, or
to the grades at which said work was to be done, or to the bonds
to be issued to pay the costs and expenses thereof, or to the
Engineer's estimate of the cost~ and expenses thereof, or against
the diagram or assessment, and all persons interested desiring to
be heard were given an opportunlty to be heard, and all matters
and things pertaining to said proposed acquiaitlons and 1mprove-
ment8 were duly heard and considered by said Council, and were
overruled, and said Council has acq•1ired j11r1sd1ct1on to order
said acquisitions and improvements and to conf~•rm said as3essment
to pay the CO$tS and expenses thereof; and
WHEREAS, on July 9, 1951, said Counc:U adopted Resolution
No. 2132 Ordering Acquisitions and Reserving Jurisdiction to order
Improvements and Confirm Assessment, Pro,Ject No. 49-10, Amarillo
Avenue, et al., Acquisition and I~provement;
NOW, THEREFORE, said Cocmcil does hereby F'IND, DETERMINE
and ORDER, ns follows:

1. The plan3 and specifications for 3treet improvements
under said Resolution of Intention as modifled are hereby finally
ndopted and appro7ed as the plans and spec1f1cat1ons to whlch 3aid
work and improvements shall be done as called for 1r. said Resolu-tion of Intention.
2. The Engineer's est:lmate of the itemized and total esti-

mated cost nnd expenses for said improvement3, as modified, ls .
hereby finally adopted and approved as the Engineer's total 3nd I
detailed estimate of the costs and expenses of ~nid improvements. -1
3. All public streets, alleys and ways 1TI use in the per-
formarice or the public function shal 1 be omitted from the assess-
ment hereinafter to be made to cover the cost of said acquisitions and improvements.
4. The public lnterest and convenience require, and said
Council does hereby order the imorovements to be made an described
ln and ln accordance with said Resolution of Intention on flle 1n
the off:tce of the C:t ty Clerk of said City, as mod.tf'ied, reference
to which 1a hereby made for a more particular description of said
lmprcvemerits and also for further part:'..culars, pursuant to the
provisions of Article V of said Improvement Procedure Code.
5. The map of the ansessment district, as modifled, is
hereby f1naJ.ly adopted and opproved as the map of the as!)essment
dlstrict, and the boundary of said ~issessment cHstr:tct as shown
thereon and as modi fled, is hereb~r determ1ned and establlshed
to be the boundary of the assessment district to pay for the costs
and expenses of Dald ocquls1t1ons and improvements.
6. The aesessment ~nd diagram for the cost and expenses of
the ncq1J1s1t1ons and improvementn described in said Resolution or Intention are hereby ratified, app~oved and conformed as the
::i.sserrnment and diagram to pay the cm:ts nnd expenses of s2ld acqai-
s1 tions and improvements.
7. The City Clerk shall deliver ~aid diagram and assessment
to the Supertntendent of Streets, together with a certified copy
of this resol~t1on thereto attached, and said Superintendent of
Streets shall thereupon record su:::h assessment and diagram in
his of'fice 1n a sul table bc .. ok to be kept for that purpose and
append thereto h!s cert1f1cate of the date of s~ch recording, and
such record oh2ll be the assessment roll to pay for the costs
:.ind expenses of sald acqu:tsitiona and improvements.
8. Immediately upon such recordat:lon aaid Super.lntendent or Streets shall give notice thereof by two publications 1n the
Palo Alto Times, a newspaper of general circulution printed and
published in said City, wh~ch notice shal1ret forth, among other
things, that all sums assessed therein are due and payable at h1s
office immediately, and that payment thereof is to be made to h1m
within thirty days after the date of recording said assessment,
which date shall be stated in said notice and such other matters
as ire required by Section 7 or Article V of said Improvement
Procedure Code.
