""'' •• '" •, " > <>., ' , 0 f '0 • R E S 0 L J T I 0 N ----------~: 0 • .?11§ ORDERIN~ ACQUISITIONS AND IMPROVEMENTS Ah'D CONFIRMING ASSESSMENT PROJECT NO. 51-1 THIRD STREET, et al ACQUISITION AND IMPROVEMENT RESOLVED, by the Council of the City of Palo Alto, cal1fornlD, WHERI::AS, the Council did on the 9th day or April, 1951, adopt lts Resolution of Intention No. 2093 to order certaln acquls;t~ons and improvements to be made 1n said City~ under and pursuant to Article V of Ord1nance No. 844 of said City, adopted January 13, i94l, entitled "Palo Alto Improvement Procedure Code11 , and to :,r:nu.e bonds pursuant to Part 4, Bond Plan C or Article IV of sa.:.ct Ordinance No. 844, refererice to whlch resolution is hereby made 'or a particular description of the acquls1tlons and improvements :-.c be ma.de, the bo;;.ndarl~s cf the assessment district and the bends to be issued; WHEREAS, sa:td Resolution of Intent:l.on No. 2093 has been duly published twice in the Palo Alto Times, a newspaper of general circulation printed and published in said City, wherein all persons 1nterE:eted, having ar1y ob._iect!.ons to the proposed acqu.isi tions and improvements or agalnst the district to be assessed ror the co~ts and expenses thereof, or against the grades at which sald work ~1hull b€' don.:', or to the Engine~r-'s estimate of the costs and expenses thereof, or against the d~agram or assessment, were notlf1ed or the time and place or the hearing as contained ln said resolution of intent1or, ~ said resolut.1 on was duly publ.l.shed w1 thin the tlme and :n the manner provlded ln sa:d Improvement Procedure Code, and as directed by said resolution or 1ntent1on, as appears from the affldav:J.t of publication on file in the office of the City Clerk or said C!ty; WHEREAS, at the time and place f~.xed for said hear:J.ng pro- te:9ts or o'b,1ectlons were made or prc3ented to the proposed acqul- s::.tions and .1mprovemerits, or to the d1str.lct to be a.sscssed, or to the grades at whlch said work was to be done, or to the bonds to be issued to pay the costs and expenses thereof, or to the Engineer's estimate of the costs and expenses thereof, or agalnst the diagram or assessment, and all persons lntereated desiring to be ''.'leard were given an opportunity to be heard,, and all matters and things pertainj.rig to said proposed acquisitions and lmprove- men•:;s were duly heard and considered by said Council, and were overruled, and sald Council has acquired jurisdiction to order said acquisitions und improvements and to confirm said assessment to pay the costs and expenses thereof; and WHEREAS .• on June 11, 1951, said Council adopted Resolution No. 2117 Orde:;:-lng Acqulsi tions and Reserving Jur1sc'1.ction to 6rder Improvements and Co"!firm Assessment, Project No. 51-1, Thlrd Street, et al., Acquisition and Improvement; NOW, THEREFORE, said Council does hereby FIND, DETF.RMINE and ORDF.R, as fol1ows: l. The plans and specif1cat.:.ons !'or street improvements under said Resol~t1on or Intention as modified are hereby finally adopted cc en to c... M.: ! I, -... J ~ ,, ~ 133 :ind approved as t.he plans and specifica t1ons to wh1ch sald work and improvements shall be done as called for 1n said Resolution of Intent.Lon. 2. 'I'he Engineer's estimate of the 1 tem1zed and tota.l estima- ted cost and exper1sea for sa.!d improvements, as mod1:i~led, 1s hereby finally adopted and approved as the Engineer's total and detailed estimate of the costs and expenses of said lmprove:ne~~ts. 3. All public streets, alleys and ways ln use in the perform- ance of the public function shall be omitted from the assessment Lere1nafter to be made to cover the cost of said acqu1a.lt1one and lmprovements. 4. The public interest and convenience require, and sn1d Counc:l l doe a hereby 01·der the 1.mprovements to be made as des er~ bed ln and ln accordance w~. ti-, sa:td Resolution of' Inter1tion on fl le in the office of the City Clerk or said City, as modified, reference to which ls hereby made for a more particular description of sa1d improvements and also for further particulars, pursuant to the provislom1 of Art!.c le V of' said Improvement Procedure Code. 5. The map of the assessment dlstrlct, as modified, is hereby finally adopted and approved ao the map or the assessment district, and the bo11ndary of said assessment district as shown thereon and ac modlfLed, ls hereby dctermlned and est~blished to be the boundary Of the 33SC3Sment dlstr!ct to pay for the costs a1~1 cxpensco of said acquisitions and improvements. 6.
