IMPROVEMENTS AND MODIFICA~IONS WITHOUT COM-
PLIANCE WITH INVESTIGATION ACT

RESOLVED, by the Council o!' the City of Palo Alto, ca11rorn1a,
WHEREAS, on April 9, 1951, th1s Council adopted its Resolution
No. 2092 of Intention to Modify Preliminary Proc9ed1ngs
under Resolution No. 2067 or Preliminary Determination, adopted
February 13, 1951, and did fix therein thie date as the time and
place when and where any and all persons interested may appear and
show cause, if any they have, why the Council should not find and
determine that the J)ubl1c conven:l.ence and necessity require the
improvements described and referred to in said Resolution, w:thout
compliance with the Special Asseasment Investigation, Limitation and Major1ty Protest Act of 1931;
WHEREAS, notice of the adoption or said preliminary Resolu-
tion No. 2092 and or said time and place or hearing was gi~en
by the City Clerk by publication and posting for the time and in
the manner provided 1n said Resolutjon and Article I of the Palo
Alto Improvement Procedure Code, as appears from affidavits on file with the City Clerk;
'WHEREAS, no written objections to the undertaking of
said proceedings without first complying with the prov1a1ons of
said Investigation Act have been filed with the City Clerk at or
before the time fixed for this hearing by persons interested,
owning or having an interest in real propet"ty within the proposed
asses:Jment district, bearing their signature, a description of
their property, and a statement of the nature of their interest thereln; and
WHE.f.\EAS, all persons interested have been g1 ven an opportun-
1 ty to be al"!d were fully heard, ancl sa1d Council has duly con-
sidered any and all objections and protests made, and the said
proposed improvements, and the public convenience and necessity for making same.
NOW,, THEREFORE, IT IS FOUND, DETERMINED and ORDERED, ~s follow3:
1. The public convenience and necessity require the improve-
ments described in said Resolution No. 2092 of Intention to Mod1fy Preliminary Proceedings.
2. Any and all objections and ~retests made pursuant to
the said Resolution are hereby overruled and denied. ·
3. The Preliminary Proceedings under Resolution No. 2067 or Preliminary Determination are hereby modified to include the
improvements and modifications described in said Resolution No.
2092 or Intention to Modify Preliminary Proc~edings, and shall b~i made under and pursuant to the provisions or the Palo Alto Im-
provement Procedure Code more particulariy referred to 1n said
Resolution No. 2067 or Preliminary Determination and the Special
Assessment Investigation, Limitation and Majority Protest Act of
1931 shall not apply to said proceedings.

I hereby certj,fy that the above and foregoing resolution was
duly and regularly adopted by the City Council of the City of Palo
Alto, California, at a regular meeting thereof held on the 23rd
day of April, 1951, by the following vote of the members thereof:
AYES, and in favor thereof, Councilmen:
Blois, Bolander, Bowden, Bower, Cashel. Cathcart, Drysdale,
Gaaparp Hill, Lind~r, Mitchell, Montreuil, Wickett.
NOES, Councilmen: None.
ABSENT, Councilmen: Freedman.
