RB.SOLVED, by the Council or the c 1 ty Of Palo Al to I Cal1f'er.-n1a, that
WHEREAS, on ~.arch 26, 1951, this Council adopted its Resolu-
tion No. 2086 of Preliminary Determination to make certain acqu1-
s1t1ona and improvements more particularly described therein and
did fix Monday~ A~ril 9, 1951, at the Council Chambers 1n the City
Hall, •ls the time and place when and where any and all persons
1ntere11ted may appear and show cause, if any they have, why the
C1'.>unc11 ehould not find and deter111ne that the public convenience
and necessity require the acqu1e1t1one and improvements described
and referred to in eaid resolution, without compliance with the
Special AasesBment Investigation, Limitation and Majority Protest Act Of 1931;
WHEREAS, notice or the adoption of said preliminary resolu-
tion and or ea.id time and place or hearing was given by the City
Clerk by publication and posting for the time and 1n the manner
provided 1n said Resolution or Preliminary Determination and
Article l or the Palo Alto Improvement Procedure Code, as appears
from aff1dav1te on file with the City Clerk;
WHEREAS, no written objections to the undertaking or
aaid proceedings without first complying with the provisions or
said Inve5tigation Act have been filed with the City Clerk at or
before the time fixed tor th1e hearing by persons interested,, own-
ing or having an interest 1n real property •1 ~;hin the proposed
assessment d1etr1ct, bearing their signature, ~ description of
their property, and a stat~ment or the nature or their interest therein; and.
WHEREAS, all persons interested have been given an oppor-
tuni tJ to be and were fully heard, and said Council has \!•tly con·-
sidered any and all objections and protests made~ and the sa11
proposed acqu1s1t1one and improvements, and the public conven-ience and necessity for making same.
NOV~ THERE.PO~, IT IS FOUND, DETERMINED and ORDBRED, ae fol-lows:
l. The public convenience and necessity requ1re the acqu1-
s1t1ons and improvements described in said Resolution of Prel1~1nary Determination;
2. Any and all objections andprotests made pursuant to
said Resolution or ITe11minary Determination are hereby, over-ruled and denied;
3. The acquisitions and improvements described in said
Reeolut1on shall be made under and pursuant to the provisions or
the Palo Alto Improvement Procedure Code more particularly rer~r
red to in said Resolution, and the Special Assessment Invest1Gat1on,
L1m1tat1on and Majority Protest Act or 1931 shall not apply to said proceedings.
