ACQUISITION AND IMPROVEMENT 51 RESOLVED, by the Council of the City of Palo Alto~ Cal1forn1a, a8 follows: l. That the Council does hereby preliminarily determine that the public convenience and necessity require, and that it intends to order the folloW1ng acquisitions to be had, work to be done and improvements tc be made 1n And for sald City, to wit: A. The j,mprov1ng of Amarillo Avenue between Louia Road and Bayshore H1ghwa~ by acquiring 10 feet on each side thereof to obtain uniform 60-root ·width and Diss Road from Alma Street to Middlefield Road by acquiring 30 feet on the northwesterly side or the monument line thereof from its 1ntersect1on with the north- easterly line or Tract No, 587, recorded January 2~, 1951. Book 31 of Maps at pages 39, 40, and 41. to Middlefield Road, and acqulr1ng 35 feet on the southeasterly aide of the monument line thereof from the northeasterly line of Cha~leston Meadows Sub.- di vision No. 3 to Middlefield Road, by grading, removing trees and ex1st1ng structures, constructing or reconstructing Portland cement concrete curb,s, gu·tters, sidewalks, storm water catch basins, manholes~ and drain pipe, constructi'ng crushed rock base pavement with plant mix wearing surface.between gutter 11pa, constructing vitrified clay pipe ean1tary sewer services, copper or galvanized iron pipe water services, and wrapped steel pipe gas services, and installing electrol1era complete with cond~1t and conductor cable, Portland cement concrete bases and appurte- nant equipment and fixtures •. B. The 1mprov1ng of Louis Road between Embarcadero Road and Colorado Avenue by aequirlng 5 feet on each aide thereof to obtain uniform 60-·foot width and Rosa Road from Seale-Wooster Canal to Colorado Avenue by acquiring 10 feet on each aide thereof to ob- tain uniform 60-foot width, by grading, removing trees and existing structures, constructing or reconstructing Portland cement con- crete curbs, gutters, e1dewalka, storm water catch basins, and drain pipe, constructing crushed rock base pavement with plant mix wearing surface between gutter 11ps, constructing vitrified clay pipe sanitary aewer services, copper or galvanized iron pipe water servicea, and wrapped steel pipe gas services, and 1nstall- 1ng electroliers complete with conduit and conductor cable, Portland cement concrete bases and appurtenant equipment and fixtures. C. The improving of Colorado Avenue between Middlefield Road and Louis Road by acquiring 10 t~et on each s1de thereof to obtain uniform 60-toot width, by grading, removing trees and existing structures, constructing or reconstructing Portland cement concrete curbs~ gutters, sidewalks, driveway aprona, storm water catch basins, and drain pipe, constructing crushed rock base pavement w1tb plant mix wearing surface between gutter lips, constructing v1tr1f1ed clay pipe sanitary sewer services, copper or galvanized iron p1pe_water ser~ices, and wrapped steel pipe gas services, and installing electroliers complete with conduit and conductor cable, Portland cement concrete bases and appurtenant equipment and fixtures. D. E. All other work auxiliary to any ,of the above, which may be required to carry out the same. 2. All of said work and improvements are to be constructed at the places and in the particular locations, or the forms, sizee, d1mfms1one, and materials, and to the lines, gradee, and eleva- tions as shown and delineated upon the plans and specifications prepared therefor, and on file in the office of the City Engineer 1n the City Hall of said City, reference to which 1s hereby made f'cir full and detailed description or sa1d pr-opo5ed work and tor further particulars. 3. There 1a hereby excepted from thed:>ove work that which 1a already done to line and grade and marked excepted or shown nc•t to be done on the plans, profiles, and apeclf1cat1ona. 4. The Council does hereby adopt and establish as the off1c1al grades for said work the grades and elevations shown upc>n oa1d plans, profiles, and specifications. All auch grades and elevations are in feet and decimals thereof in reference to the official base and datum or said City. 5. All of said work shall be done under the supervision · of the City Engineer of the City or Palo Alto, and all of said work and materials shall be done and furnished to his satisfaction. 6. A map or plat of the lands and improvements necessary or convenient to be taken for such proposed improvement has been filed with the City Clerk and approved by the Council, to which reference is hereby made for further particulars. 7. A statement of the total estimated cost of said improvement, stating separately the estimated cost of each class of construction proposed, and of each parcel of land or improvement proposed to be acq\.l1red,, and of the incidental expenses of said proceedings, and of said acquisit1~ns and improvements has been filed with the City Clerl{ and approved by the Council, to which reference 1s hereby made for further particulars. 8. Sa1d contemplated acqu131tions and improvements, in the op1n1on of th1s Council, are of more than local or ordinary public benefit, and the cost and expense ot doing said work and the ex- penses incid.ental thereto, shall be made chargeable upon the dis- trict benefited thereby, which district shall consist of the con- solidated and composite areatS or all or the parcels of property fronting on said acquisition and work, together w1th all proper- ties fronting on any street within one-half cf an intersec- tion which is being improved, and the exterior boundaries of said district are hereby declared to be the coterminous boundaries of said composite and consolidated area. The properties so benefited and the boundaries thereof, are more particularly shown on the map of said: assessment district on file 1n the office of the City Clerk or said City, to which reference 1e hereby made ror a more detailed descr1pt1on thereof. All public streets, alleys, and ways in use in the per- formance of the public function shall be omitted from the assess- ment herein&fter to be made to cover the cost or said improvement. 10. Notice 1s hereby given that serial bonds to represent the unpaid assessments and bear interest at the rate of not to exceed four per cent (4%) per annum, will be issued pursuant to Part 4, Bond Plan C of Article IV of the Palo Alto Improvement Procedure Code, the last installment of which shall mature nine (9) years from the second day or July next succeeding ten months from their date. 11. Except as herein otherwise provided for the issuance or bonds, all or the above proposed work ehall be done in pursuance of the provisions or Article V or said Pa.lo .Alto Improvement Procedure Code. sa 12. Said acquisition and improvement proceedings are analo- gous and ej.m1lar in effect to those provided in th~ Municipal Im- provement Act or 1913 and said bond proceedings are analogous and similar 1n effect to those provided in the Refunding Assessment Bond Act of 1935, and, excepting as herein otherwise provided, these proceedings shall respectively be deemed taken pursuant thereto. 13. Notice 1a hereby given that Monday, the 9th day of April, 1951, at the hour of 7:30 o'clock P.M., at the Council Chambers in the City Hall are hereby fixed as the time and place wheri and where any and all persons interested may appear and show cause, ii' any they have, why the Council should not find. and determine that the public convenience and necessity require the acquisitions and improvements described and referred to in this resolution, without further compliance with the Special Assess- ment Investigation, Limitation and Ma,1or1ty Protest Act of 1931, as provided 1n Article I or said Ordinance. 14. The City Clerk shall give notice or the adoption of thiB resolution by publishing a Notice of Proposed Local ImproV'ement once in the Palo Alto Times, a daily newspaper published and circu- lated in said City, and by posting same on or near the Council Chamber door or aa1d Council, said posting and publication to be had at least ten days before said date of hearing. * * * * * * I hereby certify the foregoing to be a true copy of resolu- tion adopted by the Council of the City of Palo Alto~ California, at a regular meeting thereof held on the 26th day of Mar.ch, 1951, by the following vote of the members thereof: AYES, and in favor thereof, Councilmen: Blois, Bolander, Bowden, Bower, Cashel, Cathcart, Drysdale, Freedman, Gaspar, Hill, Linder, Mitchell, Montrou11, Wickett.
